§ 1 Purpose of surveys and survey areas

(1) The statistical surveys referred to in paragraph 2 are carried out as federal statistics as a contribution to the presentation of the energy supply and use of energy, in particular in the form of energy balances of the federal and state governments, for purposes of
1.
the design of the energy policy framework for a secure, economic and environmentally sound energy supply,
2.
the preparation of the report of the Federal Government pursuant to § 63 paragraph 1 sentence 1 of the Energy Economic Law of 7 July 2005 (BGBl. I p. 1970, 3621), most recently by Article 1 of the Law of 27 January 2017 (BGBl. 130), as amended, and in accordance with Section 98 (1) of the Renewable Energy Sources Act of 21 July 2014 (BGBl. I p. 1066), most recently by Article 2 of the Law of 22 December 2016 (BGBl. 3106), as amended, as well as for the energy reporting of the Federal Government and the Länder,
3.
The fulfilment of the European and international reporting obligations of the Federal Republic of Germany.
(2) Statistics shall comprise the surveys
1.
in the electricity industry, including renewable energies (§ 3),
2.
in the gas industry, including renewable energies (§ 4),
3.
in the heat industry, including renewable energies (§ 5),
4.
on coal imports and exports (§ 6),
5.
Liquefied petroleum gas, sewage sludge, sewage sludge, deep geothermal energy, biofuels, mineral oil and petroleum products (§ 7) and
6.
on the use of energy, including renewable energies (§ 8).

§ 2 Definitions

(1) "operators of installations for production" within the meaning of this Act are natural or legal persons or associations of persons who have a decisive influence on the nature and operation of the plant for production. Where the plant is used for production in an establishment or in a company, the farmer or the owner of the plant shall be the operator of the plant for production. Operators of the plant for production may be both their owner and the natural or legal persons or associations of persons who are entitled to operate on the basis of a compulsory school-law obligation. (2) "Production facilities" in the sense of This law is an installation that generates electricity, gas or heat for supply to others or to own supplies. If the same renewable energy is used in multiple production units at one site, these production units shall be considered as an asset. (3) "fuels" within the meaning of this Act are solid, liquid and gaseous energy sources. Nuclear fuels, waste, heat, including waste heat, and the energy from depressurization of compressed gases are the same as fuels. (4) "Renewable energies" within the meaning of this law are

renewable energies according to § 3 (21) of the Renewable Energies Act and
2.
Energy from sewage sludge and from vegetable oil methyl ester as well as energy from the biodegradable fraction of waste from commerce, trade and services.
(5) "usable storage capacity" within the meaning of this law is the maximum acceptable amount of energy, less charging, storage and discharge losses. (6) The definitions shall also apply to the following definitions:

of the Energy Industry Act,
2.
of the Renewable Energies Act,
3.
of the Renewable Energies Heat Act of 7 August 2008 (BGBl. I p. 1658), most recently by Article 9 of the Law of 20. October 2015 (BGBl. 1722), as amended, and
4.
of the Force-Heat-Coupling Act of 21 December 2015 (BGBl. I p. 2498), most recently by Article 1 of the Law of 22 December 2016 (BGBl. 3106), in the current version.

§ 3 Surveys in the electricity industry, including renewable energies

(1) The survey shall be recorded on a monthly basis by all operators, based on the domestic
1.
from those installations for the production of electricity from an installed net power of 1 megawatt, which use fuels or hydropower as an energy source, provided that they are not covered in accordance with Article 7, first sentence, point 2 or 3, Information on the following survey characteristics:
a)
the quantity of electricity produced or electricity and heat produced, separately from the sources of energy used and the types of process used,
b)
the amount of heat dissipated, broken down by groups of customers;
c)
the amount of self-consumption, in each case of electricity and heat,
d)
the net net performance of electricity or electricity and heat production facilities,
e)
the high-efficiency property of CHP plants, separated according to process types,
f)
primary energy savings of CHP plants, separately according to process types,
g)
the quantity of the stock of fuels for the production of electricity or of electricity and heat in CHP plants, each separately according to energy sources and energy content,
h)
the quantity of fuels used for the production of electricity or of electricity and heat in the case of cogeneration plants, in each case separately from energy sources and energy content,
2.
of installations for the storage of electricity from an installed net power output of 1 megawatt, electrically or from a storage capacity of 1 megawatt-hour, data on the following survey characteristics:
a)
the quantity of electricity stored in and out of storage, separated by storage technology, in the case of pumped storage power stations, separately after production from the pumping operation and from natural inflow,
b)
the installed electrical net power output, in the case of pumped storage power plants separately after generation and pumping operation,
c)
the usable storage capacity,
3.
of electricity supply networks, in relation to the networks they operate, information on the following survey characteristics:
a)
The number, the installed net output of the production facilities directly connected to the grid operated by them, and the supply of electricity in physical quantities, in each case separately according to the number of energy carriers as well as within the energy carriers in each case separately according to plants under and from a net power output of 1 megawatt electric,
b)
the import and export of electricity in physical quantities, separately by Member State,
c)
the amount of network losses,
d)
the amount of electricity taken, separately according to customer groups.
(2) The survey shall cover, in each country and country, all energy supply companies, including electricity traders supplying electricity to the final consumer, each year for the previous year: Survey characteristics:
1.
the amount of electricity that has been put off, separated by groups of customers;
2.
the proceeds from the sale of electricity, separately by groups of customers;
3.
the proceeds from the sale of electricity to special contract customers pursuant to section 2 (3) (1) of the concession tax regulation.
(3) The survey shall cover, in each case in relation to the domestic market, all operators of electricity supply networks, in relation to the networks operated by them, each year for the previous year's data on the following survey characteristics:
1.
the special contract customer pursuant to section 2 (3) (1) of the Concession Tax Regulation on charges for the use of the network,
2.
the quantity of power supplies to the final consumer and the supply of electricity from electricity, separated by energy sources,
3.
the sites, the number and the installed net output of the production facilities directly connected to the network operated by them.
The information referred to in the first and second sentences of the first sentence shall also be recorded in a country-by-country basis. (4) The survey shall cover, in each case, the country and the country in each country, with all operators of electricity supply networks, in relation to the activities of the Member State concerned. 1.
the quantity of electricity produced or the electricity and heat produced, separately from the sources of energy used and the types of process used,
2.
the amount of self-consumption, in each case of electricity and heat,
3.
the net net performance of the installations;
4.
the high-efficiency property of CHP plants, separated according to process types,
5.
primary energy savings of CHP plants, separately according to process types,
6.
the quantity of the stock of fuels for the production of electricity or of electricity and heat in CHP plants, each separately according to energy sources and energy content,
7.
the quantity of fuels used for the production of electricity or electricity and heat in the case of cogeneration plants, in each case separately from energy sources and energy content.

§ 4 Surveys in the gas industry, including renewable energies

(1) The survey shall be recorded on a monthly basis for all operators of installations, based on the national territory.
1.
for the extraction of natural gas the quantity of natural gas obtained,
2.
for the transport of natural gas, information on the import and export of natural gas in physical quantities, separated by neighbouring countries,
3.
for the storage of natural gas data on the following survey characteristics:
a)
storage balance at the end of the month,
b)
Storage levels at the end of the month.
(2) The survey shall be collected, in each case based on the domestic, monthly
1.
in the case of all operators of installations for the production of natural gas, information on the following survey characteristics:
a)
the amount of natural gas obtained,
b)
the amount of self-consumption,
2.
Information on the following survey characteristics for all operators of installations for the transport of natural gas or biogas by means of transmission:
a)
the quantity of natural gas fed into the transmission system;
b)
the quantity of biogas fed into the transmission system;
c)
the quantity of gas which is supplied from the transmission system;
d)
the import and export of natural gas in physical quantities, separated by neighbouring countries,
e)
the amount of self-consumption,
3.
Information on the following survey characteristics for all operators of natural gas storage facilities:
a)
the storage balance at the end of the month,
b)
the storage levels at the end of the month,
c)
the amount of self-consumption.
(3) The survey is recorded annually for the previous year, based on the national territory.
1.
in the case of all operators of gas extraction and production facilities, information on the following survey characteristics:
a)
the quantity of gas obtained and produced,
b)
the quantity of the gas deposited, separately according to the groups of customers,
c)
the revenue from the sales of gas, broken down by groups of customers;
d)
the import and export of natural gas by volume of contracts, separated by country of origin and destination,
e)
the amount of torched gas,
f)
the amount of self-consumption,
g)
the amount of other losses,
2.
in the case of all operators of installations for the transport of gas by means of transmission, information on the following survey characteristics:
a)
the amount of gas injected,
b)
the import and export of natural gas in physical quantities, separated by neighbouring countries,
c)
the amount of self-consumption,
d)
the amount of other losses,
3.
in the case of all operators of gas storage facilities, information on the following survey characteristics:
a)
the number, type, volume of work, and maximum output of storage,
b)
the cumulative amount of gas injected at the end of the year and the accumulated amount of gas which is accumulated at the end of the year;
c)
the amount of self-consumption,
d)
the amount of other losses,
4.
for all operators of gas distribution networks, information on the following survey characteristics:
a)
the quantity of gas fed into the gas distribution system;
b)
the amount of self-consumption,
c)
the amount of other losses,
5.
in the case of all gas suppliers and wholesalers, information on the following survey characteristics:
a)
the import and export of natural gas by volume of contracts, separated by country of origin and destination,
b)
the quantity of the gas deposited, separately according to the groups of customers,
c)
the proceeds from the sales of gas, separately according to customer groups.
The information referred to in point 2 (a) of the first sentence and point 4 (a) shall also be recorded separately by gas. The information referred to in points 2 (c) and (d) and 4 (b) and (c) of the first sentence shall include gas compressor stations. The information referred to in point 3 (c) of the first sentence shall include a gas of cushion gas. The particulars referred to in points 1 (b) and (c), 2 (a), (c) and (d), (3) (b), (4) (a) and (5) (b) and (c) shall also be recorded in a country-by-country manner. Unofficial table of contents

§ 5 Surveys in the thermal economy, including renewable energies

The survey collects, in each case in relation to the domestic market, with all operators of heating plants from an installed net power of 1 megawatt, thermally and with all operators of systems for grid-connected heat supply, including heat-guided combined heat and power plants, in so far as their installations are not already covered in accordance with § 3, and in the case of third parties using these installations for distribution, annual data on the following survey characteristics:
1.
the quantity of heat generated and, in the case of heat-guided installations, the quantity of electricity produced, in each case separately from the sources of energy used,
2.
the amount of heat related, separated by supplier groups,
3.
the amount of heat dissipated, broken down by groups of customers;
4.
the quantity of the stock of energy sources, separately according to energy content,
5.
the quantity of energy sources used for the production of heat and electricity, in each case separately by species and energy content,
6.
the amount of self-consumption of heat and electricity,
7.
the installed thermal storage capacity,
8.
the amount of network losses,
9.
the type and level of electrical net electrical power and thermal net power of the installations,
10.
in the case of heat networks, the predominantly used heat transfer medium,
11.
the number of heat nets and the total length of the tracks,
12.
the scope of the supply and rebuilding of heat networks,
13.
the amount of heat introduced and the amount of heat executed.
All information, except as provided for in the first sentence of the first sentence of paragraph 7 and 13, shall be recorded on a national basis. Unofficial table of contents

Section 6 Surveys on coal imports and exports

The survey shall cover, in each case, in relation to the national territory, in all undertakings which enter or export lignite, lignite, hard coal, coal coke or briquettes, monthly data on the following survey characteristics:
1.
the import and export of coal, in each case separately by country and by coal, energy and border crossing values,
2.
the quantity of the stock, separately from the coal,
3.
the quantity delivered, in each case separately from the coal level and within the cohort, in each case separately by consumer and consumer groups.

Section 7 Surveys on liquefied gas, sewage sludge, sewage sludge, deep geothermal energy, biofuels, mineral oil and petroleum products

The surveys cover, in each case, in relation to the national territory, each year for the previous year
1.
in the case of all undertakings which emit at least 100 tonnes of liquefied gas per year to the final consumer or reseller, the quantity of liquefied petroleum gas which is emitted in a country-by-country basis, broken down by group of customers,
2.
Information on the following survey characteristics for all operators of plants producing sewage gas or sewage sludge for the production of electricity and heat:
a)
the quantity of sewage gas obtained and the quantity of sewage sludge obtained for the production of electricity and heat, separately according to energy content,
b)
the quantity of sewage gas used, separated by type of use;
c)
the quantity of discharged sewage gas, separated by groups of participants;
d)
the quantity of electricity and heat produced and produced from sewage sludge and sewage sludge,
e)
the installed electrical net net power and the thermal net power of the electricity and heat generation plants,
3.
Information on the following survey characteristics for all operators of installations for the use of deep geothermal energy:
a)
the nature and performance of the installations,
b)
the quantity of heat and electricity produced, separately by type of use,
c)
the quantity of heat and electricity delivered, separated by groups of customers;
4.
Information on the following survey characteristics for all operators of biofuel production plants:
a)
the nature and performance of the installations,
b)
the quantity of bioenergy carriers used, in each case separately according to type and origin from home and abroad,
c)
the quantity of biofuels produced, separated by species;
d)
the quantity of biofuels imported and the quantity of biofuels exported, broken down by species;
e)
the quantity of biofuels delivered, separated by species;
5.
Information on the following survey characteristics for all undertakings which promote mineral oil or produce or produce mineral oil products:
a)
the quantity of mineral oil that is being transported,
b)
the quantity of mineral oil used, of petroleum products intended for processing and of other materials used in processing plants,
c)
the quantity of mineral oil and petroleum products used for the manufacture of petroleum products,
d)
the quantity of petroleum products produced,
e)
the quantities of mineral oil and petroleum products,
6.
In the case of all undertakings which supply fuel oils or aircraft fuels to the final consumer, the quantity of petroleum products deposited, broken down by product and group of products, shall be the country of origin.
To the extent that the statistical offices of the countries are provided with the data set out in point 5 of the first sentence from surveys of other authorities, the application of the survey shall be carried out in accordance with the first sentence of point 5. Unofficial table of contents

Section 8 Surveys on the use of energy, including renewable energy sources

The survey covers, in each case, in relation to the national territory, in the case of holdings in the mining sector, the extraction of stones and earth and of the manufacturing sector, to the extent that the holdings are the reporting group for the surveys according to § 2 of the Law on Statistics in the production industry, as amended by the Notice of 21 March 2002 (BGBl. 1181), as last amended by Article 271 of the Regulation of 31 August 2015 (BGBl). 1474), in which the current version is in force, annual data on the following survey characteristics for the previous year:
1.
the quantity of the reference, the stock, the consumption and the supply of energy sources, separately in accordance with the nature and energy content,
2.
the amount of the production and consumption of electricity,
3.
the quantity of electricity and heat related to the supply of electricity and heat, separately from supplier groups and imports;
4.
the quantity of electricity and heat delivered, separately by group of customers and exports,
5.
the quantity of energetic and non-energy use of energy sources.

§ 9 auxiliary characteristics

The auxiliary characteristics of the survey are:
1.
the name, address, telephone number and e-mail address of the company, the company or the other body,
2.
the name and contact details of the persons available for inquiries,
3.
Type and location of the plants.
In the case of operators of electricity supply networks, the location of the installation is not an auxiliary feature, but rather a survey characteristic in accordance with § 3 (3), first sentence, point 3. Unofficial table of contents

§ 10 The obligation to provide information

(1) There is a duty to provide information for the surveys. The information provided according to § 9 sentence 1, point 2 is voluntary. (2) Information required to provide information
1.
for the surveys in accordance with § 3 (1) to (4):
a)
the lines of undertakings, undertakings or other establishments operating installations for production or storage, supplying energy to others, supplying electricity to another energy supplier, or a general supply network; operate,
b)
the lines of undertakings, undertakings or other bodies which use the equipment for transmission and distribution;
c)
the lines of undertakings, undertakings or other facilities for the thermal recovery of waste,
2.
for the purposes of the survey referred to in Article 3 (5), the lines of undertakings or establishments in the mining, manufacturing or extraction of stones and earth, to the extent that these undertakings or establishments are responsible for the production of their own resources operate,
3.
for the purposes of the survey referred to in Article 4 (1), the lines of undertakings, establishments or other establishments which operate installations for the production, transport or storage of natural gas,
4.
for the survey in accordance with Article 4 (2):
a)
the lines of undertakings, undertakings or other establishments which operate installations for the production, transport or storage of natural gas,
b)
the lines of the companies that are wholesalers and operate on and out of export;
5.
for the survey in accordance with Section 4 (3):
a)
the lines of undertakings, undertakings or other establishments operating installations for the production, production, transport, storage, distribution or distribution of gas for the distribution of gas,
b)
the lines of undertakings, undertakings or other bodies which use the equipment for the distribution of gas in line with the line;
c)
the lines of undertakings which are gas suppliers or wholesalers;
6.
for the survey according to § 5:
a)
operate the lines of undertakings, establishments or other facilities which operate heating plants or installations for the supply of heat, including heat-controlled combined heat and power plants,
b)
the lines of the undertakings, undertakings or other bodies which use the equipment for distribution;
7.
for the survey in accordance with § 6, the lines of the undertakings,
8.
in the case of the survey referred to in paragraph 7, first sentence, point 1, the lines of the undertakings supplying liquid gas to the final consumer or reseller;
9.
in the case of the surveys referred to in Article 7, first sentence, points 2 to 4, the lines of undertakings, establishments or other establishments operating the installations,
10.
in the case of the surveys referred to in point 5 of the first sentence of paragraph 7, the lines of undertakings which promote mineral oil or produce or have mineral oil products produced,
11.
in the case of the surveys referred to in paragraph 7, first sentence, point 6, the lines of undertakings supplying fuel oils or aircraft to the final consumer,
12.
for the survey according to § 8 the lines of establishments and facilities.
The obligation to provide information in accordance with the first sentence of the first subparagraph shall be exempted from undertakings, establishments or other facilities which operate installations for the production, transport or storage of biogas. Unofficial table of contents

Section 11 Implementation of the survey, time limit for transmission

(1) The surveys in accordance with § 4 (1) and (2) and § 6 are carried out by the Federal Statistical Office (Statistisches Bundesamt). (2) The data on § 4 (1) shall be published by the Federal Statistical Office at the latest by the 27th. Day of the month following the month of the report. Unofficial table of contents

§ 12 Regulation empowerment

(1) The Federal Government is empowered to act by means of a legal regulation with the consent of the Federal Council for the surveys to be carried out in accordance with § § 3, 4 (3), § § 5, 7 and 8
1.
To suspend the collection or collection of individual survey characteristics, to extend the periodicity of the surveys, to postpone the survey periods and to limit the number of respondents, if the results are not or no longer required in the originally intended detail or frequency or at other times, or where the actual conditions for a survey have been or have been substantially altered,

(2) The Federal Government is authorized to suspend individual survey characteristics or to introduce individual new survey characteristics by means of a decree law which does not require the consent of the Federal Council for the surveys according to § 4 (1) and (2) and § 6 of the Federal Government. to shorten or prolong the periodicity of the surveys, to postpone the dates of the survey and to limit the number of respondents, if this is in accordance with the obligation to provide the Federal Republic of Germany with a view to the transmission of information pursuant to Regulation (EC) No 1099/2008 of the European Parliament and of the Council of 22 October 2008 on energy statistics (OJ C 327, 18.12.2008, p. 1, L 41, 12.2.2009, p. 34), as last amended by Regulation (EU) No 431/2014 (OJ L 304, 30.9.2014, p. 1), as amended, does not affect the reliability of the results, as amended. § 13 Data transfer

(1) The Federal Statistical Office and the Federal Statistical Office may not apply to the competent federal and state authorities responsible for their use in relation to the legislative bodies and for the purposes of planning, but not for the regulation of individual cases. statistical offices of the Länder tables with statistical results, even so far as the table fields have only one case. Reporting on these emissions and on other climate-relevant information at the level of the Member States and the Union and repealing Decision No 280 /2004/EC (OJ L 145, 31.7.2006, p. 13), as amended by Regulation (EU) No 662/2014 (OJ L 164, 30.6.2014, p. 155), as amended, but not for the regulation of individual cases, is transmitted by the Federal Statistical Office (Statistisches Bundesamt) with statistical results, even to the extent that table fields are only available Have a single case. § 14 Use of data collected according to energy-related regulations

The Federal Statistical Office uses the following data for the compilation of the respective federal statistics, insofar as these data are qualitatively suitable for the production of the respective federal statistics:

the data stored in the market master data register in accordance with § 111e of the Energy Business Act, and
2.
the data published on the basis of provisions of the Energy Economic Act, the Renewable Energy Act or the Force-Heat-Coupling Act, or the legal regulations issued pursuant to these laws.
