Summary


The legal increases in lifetime annuities arise from several texts adopted at the end of the 1940s, in particular Law 49-1098 of 2 August 1949 for the revision of certain lifetime retirement annuities Of insurance, by the national pension fund for old age or by individuals subject to the alienation of capital in kind. These increases are paid by the insurance companies, the mutual insurance funds or the LWOP to their beneficiaries, the State reimbursing them all or part of these payments, depending on the nature of the pension and the date of subscription of the Contract. Thus, for contracts prior to 1 January 1977, 97 % of the annuities paid by the LWOP and by the mutual insurance funds and 80 % of the annuities paid by the insurance companies are the responsibility of the State. For contracts after 1 January 1977, 10 % of the amounts paid shall be reimbursed by the State. Finally, 100 % of the pension increases paid to the old combat are reimbursed by the State. Under the terms of s. 34 of Decree 70-104 referred to above, these payments are made in the form of payments made on 28 February, regularized on 30 June, on the basis of credentials certified by the Minister responsible for the economy for insurance companies and by the Minister Responsible for mutuality for the mutual insurance funds. This payment in two stages, down payment and regularisation, is a source of frequent errors for insurance and management complexity bodies for administration. In addition, payment of the deposit occurs frequently after February 28, due to delays in the transmission of the supporting documents. For these reasons, the purpose of this Decree is to simplify the refund procedure, which would be carried out only once on 30 June of each year, on supporting documents, all otherwise unchanged. It is therefore a measure of administrative simplification. Amendment of Art. 34 (al. 1) of the aforementioned decree. Effective 1 January 2003.

In view of Law No. 48-957 of 9 June 1948 on the increase of lifetime retirement pensions for the benefit of the veterans to the autonomous mutual funds, together with the texts which amended it;
In the light of Law No. 49-1098 of the 2 August 1949 revising certain life annuities constituted by the insurance companies, by the National Pension Fund for old age or by individuals, subject to the alienation of cash in cash, together the texts Which amended it, and in particular Decree No. 57-1356 of 30 December 1957;
In the light of Act No. 51-695 of 24 May 1951 concerning the increase of certain life annuities and pensions, together with the texts which amended it, and in particular Decree No. 57-1356 of the 30 December 1957;
