Summary the legal of annuities increases stem from several texts adopted at the end of the 1940s, in particular the law 49-1098 on August 2, 1949, revising some annuities established by the insurance companies, by the n National Fund of retirees for old age or by individuals for an alienation of capital in case. These increases are paid by insurance companies, independent unions or the NOC to their beneficiaries, the State reimbursing these organizations all or part payments, depending on the nature of the pension and the date of subscription of the contract. So, for contracts prior to January 1, 1977, 97% of the pension increases paid by the NOC and the independent unions and 80% of the increases in pensions paid by insurance companies are the responsibility of the State. For contracts subsequent to January 1, 1977, 10% paid premiums are refunded by the State. Finally, 100% of pension increases paid to former combat are reimbursed by the State. Under the terms of art. 34 of the Decree 70-104 above, these payments are made in the form of instalments intervening on 28 February, regularized June 30 in the light of documents certified by the Minister responsible for the economy for the insurance companies and the Minister responsible for the mutual society for autonomous unions. This payment in two steps, down payment and regularisation, is prone to frequent errors for bodies of insurance and complexity of management for the administration. In addition, the payment of the deposit comes frequently after February 28, due to delays in the transmission of supporting documents. For these reasons, this Decree is intended to simplify the procedure of refund that would be performed only once on June 30 of each year on supporting documents, all other things remaining unchanged.
