ARRETE
Decree of 31 January 2002 extending the rules laid down by the fruit and vegetables economic committee of the Rhône-Mediterranean basin

The Minister of Economy, Finance and Industry and the Minister for Agriculture and Fisheries,
In view of Regulation (EC) No 2200/96 of 28 October 1996 Common organisation of the markets in the fruit and vegetable sector;
In view of Articles L. 554-1 and R. 553-7 of the Rural Code;
Having regard to Decree No. 2000-1053 of 24 October 2000 on the economic organisation in the fruit and vegetable sector ;
Seen the request of the Fruit and Vegetables Agricultural Economic Committee of the Rhône-Mediterranean basin;
In view of the opinion of the specialised technical committee of the Conseil supérieur d' orientation et de coordination de l' économie agricole and Food on December 12, 2001,
Stop:

Article 1


The following rules laid down by the Agricultural Fruit and Vegetables Committee of the Rhône-Mediterranean basin are: For the years 2001-2002, 2002-2003 and 2003-2004, to all producers of asparagus, cucumbers, salads and tomatoes on the departments of Aude, Gard, Hérault, Lozère and Pyrénées-Orientales.


1 ° Production Knowledge Rules


A. -Supply each year, on a date fixed in accordance with the attached Annex by the relevant regional section of the Economic Committee, of a condition of area planted by variety and type of planting
The annex attached by the regional section concerned:
-declaration of harvest forecasts, by variety;
-declaration of harvested tonnages, by variety;
-periodic declaration, from the beginning to the end of the campaign, of tonnages Harvested by period (total and intended for marketing).


2 ° Production rules


Compliance with production rules (variety choice) defined by the relevant regional section.


3 ° Marketing Rules


A. -Compliance with the packaging, presentation and packaging rules laid down by the relevant regional section of the Economic Committee for the first marketing.
B.-Obligation, at certain periods, to withdraw the products from the market Comply with the rules laid down in the above point and comply with the market intervention arrangements applied by the regional section.
C.-Obligation to market or market the product with marking by affixing of a Identification label conforming to the model approved by the Economic Committee.
This label will be affixed to the packaging for delivery or marketing and will provide justification for the application of the rules.
La Release of the label will not be refused to producers who have complied with the rules.


4 ° Environmental Protection Rules


The obligation to comply with the rules for the use of the Fertiliser and manure.
Obligation to comply with the rules on the use of plant protection products and other methods of crop protection.
Obligation to comply with the rules on maximum residue levels of products
Obligation to comply with the rules for the disposal of used byproducts and materials.
The obligation to comply with the rules for the destruction of recalled products.


5 ° Application of the withdrawal price


The obligation to respect, at certain periods, the withdrawal prices applied by the Economic Committee, within the limits of the provisions of the Community regulations and Taking into account, possibly, packaging adjustment factors for packaged products.
Obligation to withdraw from the market products which could not be sold at a price at least equal to the withdrawal price, taking into account, possibly, Of the coefficients mentioned above.
The obligation to respect the market intervention arrangements applied by the Economic Committee with regard to the periods of intervention and the destination of the unsold.

Article 2


The specific rules that will be set annually for each product on each campaign in application of 3 ° and 4 ° above will be Forwarded for approval to the guardianship authorities.

A. -In the context of the extension of the abovementioned rules, the Economic Committee shall be authorised to levy from producers who are not members of producer organisations whose amounts will be fixed annually, by Adopted by the competent administrative authority, by reference to the contributions levied by the same groups to their members.
These contributions are intended:
-to the administrative management fund (operation and control) put into effect Place by the Economic Committee in order to ensure its administrative functioning;
-to the promotion, studies and research fund set up, where appropriate, by the Economic Committee in order to cover general actions benefiting the whole The production of the region concerned.
These contributions may not exceed the contributions levied by the members of the producer organisations.
B.-In order to ensure compliance with the extended rules, the authorised agents of the Economic committee shall participate in conjunction with those of the competent administrative authorities, in particular those of the service responsible for the enforcement of fraud, to control the application of the rules defined above
Control, without prejudice to the laws and regulations applicable to the shelf-life of such documents, the producer shall keep for a minimum period of three years at the disposal of the screening officers a copy of the Delivery vouchers and a copy of the invoices showing the tonnages and prices by size and category.

Item 4


The The Director General of Competition, Consumer Affairs and Fraud Prevention and the Director of Economic and International Policy shall each have responsibility for the execution of this Order, which shall be published in the Journal Official of the French Republic.
