ARRETE
Order of February 9, 2004 approving the merger involving transfer of portfolio of bulletins d' adherence to mutual regulations and contracts

The Minister of Social Affairs, Labour and Solidarity and the Minister of Health, Family and People with Disabilities,
Given the code of mutuality, and in particular the Articles L. 212-11 and L. 212-12;
In view of the requests made by the Mutual staff of the establishments Rivoire and Carret, whose head office is in Marseille (13011), 55, rue du Doceur-Heckel, the Mutuelle des engines Baudouin, whose headquarters Social is in Marseille (13010), 165, boulevard Pont-de-Vivaux, the Mutuelle des professions du spectacle, whose head office is in Marseille (13010), 146 A, avenue de Toulon and la Mutuelle d' entreprise Dassault Aviation, whose head office is at Istres (13800), for the approval of the transfer, by way of merger-absorption, with their rights and obligations, of all their respective portfolios of membership bulletins to regulations and contracts to the Mutual Life of the Enterprises, whose head office is in Marseille (13002), 1, rue François-Moisson;
In view of the deliberation of 17 September 2003 of the General Assembly of the Company Mutual Company Dassault Aviation;
In view of the deliberation of 22 September 2003 The General Assembly of the Staff of the Rivoire and Carret institutions;
In view of the deliberation of 22 September 2003 of the General Assembly of the Mutuelle des engines Baudouin;
In view of the deliberation of 22 September 2003 of the Assembly General of the Mutuelle des professions du spectacle;
In view of the deliberation of the General Assembly of the Mutuelle du Mutuelle des entreprises on 22 September 2003;
In view of the opinion published in the Official Journal of 26 November 2003 inviting creditors The mutual companies concerned to submit their observations on the transfer project;
Having regard to the certificate of solvency of 17 December 2003 issued by the Committee on the Control of Mutuals and Provident Institutions;
Seen the parts to be Support, including the Merger Treaty,

Item 1

Approved, effective January 1, 2003, the merger involving the transfer, under the conditions set out in L' article L. 212-11 du Code de la mutualité, avec leurs droits et obligations, de l' ensemble des portfolios de bulletins d' accession à des by-laws et de contracts de la Mutuelle du personnel des establishments Rivoire et Carret, de la Mutuelle des Grands Baudouin engines, from Mutuelle des professions du spectacle et de la Mutuelle d' entreprise Dassault Aviation au profit de la Mutuelle provençale des entreprises.

Article 2

The Director of Social Security is responsible for the execution of this Order, which will be published in the Official Gazette of the French Republic.
