Decree of 31 December 2004 approving bodies authorised to carry out checks on the exposure of workers exposed to crystalline silica dust at work sites

The Minister of Employment, Labour and Social Cohesion and the Minister of Agriculture, Food, Fishing and Rurality,
Given the Labour Code, and In particular Articles R. 231-55 and R. 231-55-1;
In view of Decree No. 97-331 of 10 April 1997 on the protection of certain workers exposed to the inhalation of siliceous dust in their workplaces;
Having regard to the order of 20 August 1996 Amended quality control to be complied with by the bodies seeking authorisation for the control of certain chemical hazards referred to in Article R. 231-55 of the Labour Code;
In view of the Decree of 10 April 1997 on control Exposure of workers exposed to crystalline silica dust;
In view of the orders of 31 December 2002 and 26 December 2003 approving bodies authorised to carry out checks on the exposure of workers exposed to the Crystalline silica dust in the workplace;
Given the advice of the Higher Council for Occupational Risk Prevention;
In the opinion of the National Commission for Occupational Health and Safety in Agriculture,

Item 1


Approved for sampling and analysis of crystalline silica dust for a duration of Three years, from 1 January 2005 to 31 December 2007, the following organisations:

Article 2


Only samples of crystalline silica dusts for a period of three years, from January 1, 2005 to December 31, 2007, are approved for sampling. Following:

Approved, to perform only analyses of crystalline silica dust, for a Three years from 1 January 2005 to 31 December 2007, the following organism:

Article 4


The organization's address " Air Analysis Agency-L 3 A " Appearing in Article 2 of the said Decree of 31 December 2002 is amended as follows:
The words: 18, rue Liancourt, 75014 Paris " Are replaced by the words: " 18, rue Roger-Salengro, 92130 Issy-les-Moulineaux ".

Item 5


Accreditation Is granted on a precarious and revocable basis at any time by the Ministers responsible for labour and agriculture.

Article 6


The organization shall notify the employing department of any withdrawal or suspension of accreditation, regardless of the extent of this measure.

Article 7


The body that is the subject of a suspension or a withdrawal of accreditation no longer fulfils the conditions of accreditation and can no longer proceed with the sampling and analysis of the Crystalline silica dust during the duration of this suspension or withdrawal.
This information is published in the Official Journal.

Article 8


This Order is taken without prejudice to the provisions of the orders of 31 December 2002 and 26 December 2003 referred to above.

Article 9


The Director of Labour Relations and the Director General of Forest and Rural Affairs shall each have responsibility for the execution of this Order, which shall be published in the Official Gazette of the Republic French.
