DECRET
Decree of 9 February 2005 on delegation of signature (direction of water)

The Prime Minister,
On the report of the Minister of Ecology and Sustainable Development,
Given the Public Procurement Code;
Given the Administrative Justice Code ;
In view of Decree No. 47-233 of 23 January 1947, as amended authorizing the ministers to delegate, by order, their signature;
In light of Decree No. 62-1587 of 29 December 1962 on the general regulation on public accounting;
In view of Decree No. 2000-426 of 19 May 2000 amending the organization of the central administration of the Ministry responsible for the environment;
In view of Decree No. 2002-895 of 15 May 2002 on the powers of the Minister of Ecology and Sustainable Development ;
Given the Order-in-Council dated November 20, 2002 appointing the Director of Water;
Given the decree of 30 March 2004 appointing the Prime Minister;
In light of the decree of 22 April 2004 on the delegation of signature;
In the light of the decree of 29 November 2004 on the composition of the Government;
In view of the decree of 19 May 2000 amending the organisation of directorates of the central administration of the Ministry responsible for the environment;
In view of the decree of 19 May 2000 on the organisation of the Ministry of Environment headquarters services and sub-directorates, as amended notably by the Order of 26 November 2004;
In view of the Order of 2 June 2003 establishing the Central Hydrometeorology and Support Service Flood forecasting;
In view of the Order of 2 June 2003 establishing the Central Hydrometeorology Service and Flood Forecasting Support;
In view of the September 18, 2003 Order appointing the Head of the Central Service Hydrometeorology and flood forecasting support;
Given the April 9, 2004 signing delegation order,
Describes:

Article 1


The provisions of Article 2 of the aforementioned decree of 22 April 2004 are replaced by the following provisions :
" Art. 2. - In the event of the absence or incapacity of Mr Pascal Berteaud, Director of Water, the delegation provided for in Article 1 of the decree of 9 April 2004 shall, under the same conditions, vest in Mrs Fabienne Helvin, Deputy Director, directly Under the authority of Mr Pascal Berteaud. "

Article 2


An article 3-1 of the decree of 22 April 2004 is added as follows:
" Art. 3-1. -In the event of the absence or incapacity of Mr Pascal Berteaud, Director of Water, delegation shall be given to Mr Alexis Delaunay, chief engineer of rural engineering, water and forests, responsible for the sub-direction of the territorial action, of the Framework directive and fisheries, to Mr Noël Godard, general engineer of the bridges and pavements, in charge of the aquatic and water management sub-directorate, directly under the authority of Mr Pascal Berteaud, to sign, on behalf of the The Minister of Ecology and Sustainable Development and within the limits of their powers, acts, decisions, orders, contracts and conventions and the related documents, excluding the decrees and replies to the Court of Justice Accounts. "

Article 3


The provisions of Article 5 of the Decree of 22 April 2004 are replaced by the following provisions:
" Art. 5. - In the event of the absence or incapacity of Mr Pascal Berteaud, Director of Water, and Mrs Fabienne Helvin, Deputy to the Director, delegation is given to Mr Jean-Michel Tanguy, Chief Engineer of the bridges and pavements, Head of the Central Service Hydrometeorology and flood prevention support, to sign, on behalf of the Minister of Ecology and Sustainable Development and within the limits of its powers, all acts, decisions, contracts and conventions, including Orders within the limit of EUR 15 000, as well as the related documents, excluding the orders, decrees and replies to the Court of Auditors' application. "

Item 4


Section 2 of the Order of April 9, 2004, with delegated signing authority, is repealed.

Article 5


The Minister of Ecology and Sustainable Development is responsible for the execution of this Decree, which will be published in the Journal Official of the French Republic.
