ARRETE
Order of 23 January 2002 establishing a state of natural disaster

The Minister of Economy, Finance and Industry, the Minister of the Interior and the Secretary of State for the Budget,
In view of Law No. 82-600 of 13 July 1982 on Compensation for victims of natural disasters, in particular Article 5, paragraph 2;
In view of Law No. 90-509 of 25 June 1990 amending the Insurance Code and extending to the overseas departments and the territorial authorities of the Natural disaster compensation scheme;
In view of Act No. 92-665 of 16 July 1992 on the adaptation of the applicable insurance and credit legislation to the European Single Market, and in particular Articles 34 and 35;
Vu The orders of 5 September 2000 amending, respectively, Article A. 125-1 of the insurance code and creation of article A. 125-3 Insurance Code;
After reviewing reports showing the abnormal intensity of a natural agent whose harmful consequences are not insurable,
Stop:

Article 1


Pursuant to the provisions of Article 1 of the aforementioned Act of 13 July 1982, the state of disaster Shall be established for damage caused by land movements, floods and mudslides and floods by upwelling of ground water in the departments and the dates specified in the Annex.

Article 2


The state of natural disaster found in Article 1 of this Order may open the right to insured persons against Effects of natural disasters on the property subject to the insurance contracts referred to in Article 1 (1) of the aforementioned Law of 13 July 1982, where the resulting direct material damage has been the determining factor The effect of this natural agent and the usual measures to prevent such damage could not prevent their occurrence or could not be taken.
In addition, if the insured person is covered by a contract referred to in Article 1 (2) of the Law of the 13 July 1982, the declared state of natural disaster may open the right to the aforementioned guarantee, under the conditions laid down in the relevant insurance contract.

Article 3


The applicable franchise is modulated according to the number of orders taken for the same risk since February 2, 1995, in municipalities that do not have a prevention plan Foreseeable natural hazards for the risk involved.
For these communes, the number of such orders appears in brackets, in the annex. It takes into account not only previous orders made for the same risk, but also this order.

Article 4


The present Order will be published in the Official Journal of the French Republic.
