DECISION
Decision No. 2005-1080 of 13 December 2005 laying down conditions for use of wireless access including wireless LANs in the 5 GHz band

The Electronic Communications and Postal Regulatory Authority,
In view of Directive 98 /34/EC of the European Parliament and of the Council of 22 June 1998 providing for an information procedure In the field of technical standards and regulations and rules on the services of the information society, and in particular notification 2005 /0418/F;
In view of the decision of the European Commission of 11 July 2005 on the use of Harmonised radio spectrum in the 5 GHz frequency band for the implementation of wireless access systems including local radio networks (WAS/RLAN);
In view of Decision ECC/DEC/( 04) 08 of the European Conference of Postal and telecommunications (CEPT) administrations of November 12, 2004, relating to the harmonized use of the 5 GHz frequency bands by wireless access systems including local radio networks (WAS/RLAN);
T/R recommendation 70-03 of the European Conference of Postal and Telecommunications Administrations (CEPT) on the use of low-range devices;
Given the postal code and electronic communications, and in particular its Articles L. 33-3 (1 °), L. 36-6 (4 °), L. 36-7 (6 °);

On the legal framework:
In accordance with article L. 33-3 (1 °) of the postal code and electronic communications (CPCE), radio installations not using frequencies specifically assigned to their users shall be established freely and the conditions for the use of such facilities shall be determined in accordance with the conditions laid down in Article L. 36-6 of the CPCE. This decision of the Authority laying down the technical requirements applicable in order to ensure, in particular, the proper use of the frequencies shall be taken in accordance with Article L. 36-6 of the ECCC. It shall be published in the Official Journal after approval by the Minister responsible for electronic communications.
This Decision concerns wireless access installations including local radio networks, also known as WAS/RLAN (Wireless Access System including Radio Local Area Network). These broadband radio installations allow wireless access to public and private applications regardless of the topology of the underlying network.
In accordance with Directive 1999 /5/EC of the European Parliament and of the Council and In particular Article 4.1, Member States shall notify the Commission of the interfaces which they have regulated.
On frequencies:
The conditions of use laid down in this Decision for wireless access installations including Radio local networks (WAS/RLAN) apply to the frequency bands 5150-5350 MHz and 5470-5725 MHz assigned to these facilities by Decision No. 2005-1081 referred to above.
On the definition of technical conditions :
The technical requirements laid down in this Decision transpose the provisions of the European Commission Decision of 11 July 2005 referred to above on the harmonised use of radio spectrum in the frequency band 5 GHz for the implementation of wireless access systems including local radio networks (WAS/RLAN).
The Commission's decision proposes power limitations for the frequency bands 5150-5350 MHz and 5470-5725 MHz and Requires the use of emission control and the use of mitigation techniques. These restrictions are intended to ensure compatibility with satellite networks as well as with existing radar systems in the band.
This Decision takes into account the recommendations of the CEPT T/R Recommendation 70-03 Referred to above and ECC/DEC/( 04) 08 of the aforementioned CEPT which provide for harmonised frequency bands for wireless access installations including local radio networks.
In accordance with the European decision of 11 July 2005 referred to above, the installations covered by this Decision refer to the harmonised standard EN 301 893 of the European Institute for the Standardization of Telecommunications (ETSI), enabling the protection of radiolocation installations at Fixed frequencies present in this frequency band by the Dynamic Frequency Selection (DFS) mechanism, or any other recognized equivalent standard. Wireless access systems, including local radio networks (WAS/RLAN), must in no way be broadcast on channels occupied by another system, in particular by a radiolocation system used by the Ministry of Defence. They should refer to version 1.3.1 (2005-08), or a later version, of ETSI EN 301 893 or equivalent recognized functionality. The harmonised frequency bands in Europe for these radio installations are the bands 5150-5350 MHz and 5470-5725 MHz,

This Decision covers wireless access facilities including local radio networks (WAS/RLAN). These broadband facilities allow wireless access to public and private applications regardless of the topology of the underlying network.

Article 2


The technical conditions for the use of frequencies by wireless access installations including local radio networks (WAS/RLAN) in the 5 GHz band are the
In the frequency band 5150-5350 MHz, wireless access facilities including local radio networks (WAS/RLAN) are limited to indoor use of buildings with radiated isotropic power Equivalent (PIRE) average of 200 mW. In addition, the maximum average PIRE density is limited:
-at 0.25 mW/25 kHz in any 25 kHz band, in the band 5150-5250 MHz; and
-at 10 mW/MHz for any 1 MHz band, in the 5250-5350 MHz band.
In the frequency band 5470-5725 MHz, the use of wireless access facilities including local radio systems (WAS/RLAN) inside and outside buildings is limited to a maximum average PIRE of 1W and to an average PIRE density of 50 MW/MHz in any 1 MHz band.
Wireless access facilities including local radio networks (WAS/RLAN) operating in the 5250-5350 MHz and 5470-5725 MHz bands must, on average, mitigate at least 3 dB on The maximum allowable output power of the installations, by a transmitter power control mechanism (TPC: Transmitter Power Control).
If this transmitter power throttling mechanism is not used, the PIRE Average maximum allowed as well as the corresponding average PIRE density limits for the 5250-5350 MHz and 5470-5725 MHz bands are reduced by 3 dB.
Wireless access facilities including local radio networks (WAS/RLAN) operating in the 5250-5350 MHz and 5470-5725 MHz bands use dynamic frequency selection (DFS) functionality as described in ETSI Harmonised Standard EN 301 893 or equivalent recognized functionality, Guaranteeing at least, for other applications authorised in the band concerned, in particular the radiolocation systems, a degree of protection identical to that provided by the harmonised standard. These mitigation techniques equalize the probability of selecting a specific channel for all available channels, in order to ensure, on average, a quasi-uniform distribution of the spectrum load.

Article 3


Decision No. 2002-1092 is repealed with the approval of the Minister responsible for electronic communications of this Decision, which Replaces.

Article 4


The Director General of the Authority shall be responsible for the implementation of this Decision, which shall be published in the Official Journal of the French Republic, after its approval by the Minister responsible for electronic communications.
