ARRETE
Decree of 18 January 2005 laying down detailed rules for calculating the contribution to the social rental guarantee fund.

Given the Construction and Housing Code, and in particular Article L. 452-4;
In the opinion of the Board of Directors of the Guarantee Fund Social rental housing as of December 15, 2004,

Item 1

As part of the contribution due to the Social Rental Guarantee Fund for 2005, the organizations Moderate rent housing and mixed economy companies referred to in Article L. 452-4 of the Construction and Housing Code declare and send to the said body the information contained in the Annex attached to this
. 2005 is calculated on the basis of the products referred to in the 2004 fiscal year.

Item 2

The Rate of the Assessment due For 2005 shall be set at 1.40 % of the rent set out in Article L. 452-4 of the aforementioned code.
The amount of the reduction by the lessee of the aid provided for in Articles L. 542-1 and L. 831-1 of the Social Security Code and L. 351-1 of the Code of Social Security Construction and housing is fixed at 35 euros.
The amount of the reduction by housing or shelter located in the quarters mentioned in the fifth paragraph of Article L. 452-4 of the Construction and Housing Code is fixed at 27
amount of the reduction by housing or shelter referred to in the sixth paragraph of Article L. 452-4 of the Construction and Housing Code and having been first put into service in the year 2004 shall be set at 600 Euros.

Article 3

The Director General of Town Planning, Housing and Construction and the Director of the Budget are responsible. Each in respect of the execution of this Order, which shall be published in the Official Journal of the French Republic.

(1) The number of homes-households is equal to the number of residents' entitlement units (bed, room, or Housing, as the case may be, without a specific calculation of housing equivalents). The number of homes and homes-homes is appreciated as of December 31 of the last fiscal year. (2) The assessment of the HLM organizations has as its basis the rent called, including the rent solidarity supplement (SLS), in the last fiscal year for rental units and residential units and on which they are holders A real right. For residential homes, the assessment is based on the element of the charge equivalent to the rent or, in the case of third-party management, the rent paid by the manager. The assessment of the mixed economy companies is based on the rent called, including the rent solidarity supplement (SLS), in the last financial year ended for rental units and homes-households belonging to them, and Under the conditions laid down in Article L. 351-2 of the Construction and Housing Code or, in the overseas departments, constructed, acquired or improved with the financial assistance of the State. (3) The number of tenants is appreciated as of December 31 of the last fiscal year.
