Decree No. 2005-91 of 7 February 2005 on the duties of the Secretary-General of the ministries responsible for social affairs

The Prime Minister,
On the report of the Minister of Employment, Labour and Social Cohesion, the Minister of Solidarity, Health and the Family and the Minister of Parity and professional equality,
Given the code of public health, including articles L. 6115 -1, R. 1421-1 and R. 1421-2;
Due to Organic Law No. 2001-692 of 1 August 2001 on financial laws;
Given the Law of Guidance N ° 92-125 of 6 February 1992 as amended relating to the territorial administration of the State;
In the light of Decree No. 67-390 of 11 May 1967 bringing together the general inspection services of social affairs within the general inspection of Social affairs;
In view of Decree No. 75-506 of 25 June 1975 on the organisation of the central administration of the Ministry of Labour;
In the light of Decree No. 77-1288 of 24 November 1977 on the organization of the external services of the Work and employment, together Decree No. 94-1166 of 28 December 1994 concerning the organisation of the decentralised services of the Ministry of Labour, Employment and Vocational Training;
In view of Decree No. 88-1015 of 28 October 1988 Creation of a national council and an inter-ministerial committee of cities and urban social development and an inter-ministerial delegation to the city and urban social development, as amended by Decree No. 2002-7 of 3 January 2002;
Vu Decree No. 90-665 of 30 July 1990 on the organisation of the central administration of the Ministry of Labour, Employment and Vocational Training and the Ministry of Solidarity, Health and Social Protection, Together Decree No. 97-531 of 27 May 1997 establishing a delegation to European and international affairs at the central administration of the Ministry of Labour and Social Affairs;
In view of Decree No. 93-57 of 15 January 1993 The organisation of the central administration;
Having regard to Decree No 94-1046 of 6 December 1994 on the tasks and responsibilities of the regional and departmental directorates of health and social affairs;
Given the decree n ° 95-863 of 31 December 1994 July 1995 establishing an inter-ministerial delegate for persons with disabilities;
In view of Decree No. 97-213 of 11 March 1997 on the coordination of the fight against illegal employment;
In view of Decree No. 97-244 of 18 March 1997 Creation of a general delegation to employment and vocational training at the central administration of the Ministry of Labour and Social Affairs;
In view of Decree No. 98-919 of 14 October 1998 establishing a Directorate of Solidarity and the health of Corsica and South Corsica;
Having regard to Decree No. 2000-685 of 21 July 2000 on the organisation of the central administration of the Ministry of Employment and Solidarity and the powers of some of its members Services, as amended by Decree No. 2003-462 of 21 May 2003 on the Regulations of Parts I, II and III of the Public Health Code;
In light of Decree No. 2001-574 of 2 July 2001 establishing the Health Directorates and the Social development in Guadeloupe, French Guiana and Martinique;
In view of the Opinion of the Joint Ministerial Technical Committee at the Ministry of Labour and Social Affairs of 17 December 2004;

A Secretary-General is placed with the ministers responsible for social affairs. It is responsible for coordinating administrative action and for preparing and implementing the policy for the improvement of public management.
To this end, in liaison with the Directors-General, Directors and other heads of administration :
It implements and tracks departmental reform strategies;
It ensures the modernization of public management and can represent, in this area, ministers in relevant interdepartmental forums;
It ensures the coordination of the legal activity of the services;
It ensures the development of the management by objectives, the principles and methods of which it lays down, as well as the corresponding action plans. It monitors their implementation and evaluates their results;
participates in the preparation of departmental budgets, proposes to ministers the allocation of resources between services, and ensures the implementation of the law Organics of 1 August 2001;
It ensures the adaptation of administrative structures and the implementation of objective conventions;
It contributes to the animation and coordination of the action of the decentralised services;
It Defines the principles of human resources management and ensures their application, in particular for the management of senior management;
It controls the optimal management of resources and conducts projects of common interest, in particular in matters relating to Information, purchasing and property policy systems.

For the exercise of its powers, the Secretary-General has, as appropriate, central administrative divisions and services as well as deconcentrated services. He chairs, where appropriate, the Directors' Committees which periodically bring together the Directors-General and the Directors. He may chair, as the representative of ministers, the Joint Ministerial Joint Technical Committee.
