Decree of 17 January 2003 implementing Decree No 94-566 of 7 July 1994 as amended with regard to the indication of the energy consumption of electric ovens for household use

The Minister of Economy, Finance and Industry, the Minister responsible for Industry, and the Secretary of State for Small and Medium Enterprises, Trade, Craft, professions and consumption,
In the light of Commission Directive 2002/40/EC of 8 May 2002 laying down detailed rules for the application of Council Directive 92/75/EEC as regards the indication of consumption Energy of electric furnaces for household use;
In view of the law of 24 May 1941 on standardisation;
In view of Decree No. 94-566 of 7 July 1994 on the indication of the consumption of energy and of the noise from appliances to Domestic use, as amended by Decree No. 98-281 of 8 April 1998;
In the light of the decree of 23 July 1987 amended to implement compulsory standards,
Stop:

Item 1


1. The provisions of this Order shall apply to electric ovens for domestic use and to furnaces forming part of a larger installation, powered exclusively by the power supply network with low voltage power, with the exception of :
-ovens capable of operating with other energy sources than that provided by the low voltage electricity distribution network;
-ovens not covered by the harmonised standards referred to in Article 7;
-ovens Mobile, weighing less than 18 kilograms, not fixed and not intended for installation.
2. Energy consumption in "mode" Steam ", other than mode" Hot steam ", is not covered by this order.

Item 2


When offered for sale, lease or hire-sale, the ovens referred to in section 1 shall be:
-equipped with one (or more) label (s) in accordance with the provisions of section 3 of this Order. In particular their energy consumption;
-accompanied by a fact sheet specifying the particulars on the label referred to above and in accordance with the provisions of Article 4 of this Decree.

Article 3


The label provided for in item 2 above shall conform to the model set out in Annex I. It shall be filled in according to the indications specified in Annexes I and IV Of this Order.
Sections I, II, III, V, VI, VII and IX of the label must be filled in. Headings IV and VIII are provided on an optional basis.
A label for each premises concerned shall be supplied by the manufacturer or his authorised representative established in the territory of one of the Member States of the European Union or, failing that, by Any person who proposes to the consumer one of the products listed in section 1 of this Order.
It is placed on the door of the appliance by the person who exposs it to the sale or for the purpose of renting or leasing it in a manner that Be clearly visible. When the device has more than one speaker, all the loudspeakers are provided with a label, except those that do not fall within the scope of the standards referred to in section 7.

Article 4


The information sheet provided for in Article 2 above shall be drawn up and presented in accordance with the provisions of Annex II to this Order.
It is provided by the manufacturer or An agent established in the territory of one of the Member States of the European Union or, failing that, by any person who proposes to the consumer one of the appliances listed in Article 1 of this
. The potential purchaser by the person who exposs it to the sale, lease or rental-sale.
It may be part of a brochure or catalogue, or any other equivalent support.
Headings 1, 2, 3, 5, 6, 7, 8, 10 and 11 Be filled in. Sections 4 and 9 are optionally filled in.

Article 5


By way of derogation from the provisions of Article 2 of the present If any of the apparatus referred to in Article 1 of this Order is offered for sale, lease or hire-sale, by means of a remote communication in printed form or by any other means that does not enable the prospective customer to See the apparatus, in particular a mail-order catalogue or advertisements by electronic means, this communication shall include the information contained in Annex III to this Order.
Headings 1, 2, 3, 4 and 5 shall be Information. Item 6 is optional.
This provision also applies to offers for built-in kitchens.

Article 6


The technical documentation referred to in Article 3 of the Decree of 7 July 1994 referred to above, that the manufacturer or his authorised representative established in the territory of one of the Member States of the Union European or, failing that, any person who proposes to the consumer one of the appliances listed in Article 1 of this Order shall make available to the agents responsible for control, the following information:
-the name, the trade mark and the The address of the supplier;
-a general description of the product to identify it;
-information, possibly in the form of drawings, relating to the main features of the model, in particular to the elements exercising a Significant influence on energy consumption;
-test reports and measurements carried out on a model in accordance with the procedures set by the standards referred to in section 7 of this Order;
-the directions for use, if any.

Article 7


Definitions relating to ovens (or enclosures) falling within the scope of this Order, the information Prescribed by the label and the information sheet referred to in Article 2 of this Order as well as those contained in the technical documentation referred to in Article 6 above shall be determined in accordance with the standards whose references are published in the Official Journal of the French Republic.

Article 8


The provisions of this Decree shall apply to devices subject to Article 1 and manufactured six months after the publication in the Official Journal of the French Republic of the standards necessary for the determination of the information required on the label and on the information sheet referred to in the Section 2 of this Order.

Section 9


The Director General of Energy and Raw Materials and the Director General of Competition, consumption and the suppression of fraud shall each be responsible for the execution of this Order, which shall be published in the Official Journal of the French Republic.

    1. The label contains the following information:
    I.-Vendor Name or Brand.
    II. -Vendor-defined model reference.
    III. -The classification of the enclosure (of the loudspeakers) according to its energy efficiency shall be carried out in accordance with the indications in Annex IV. The index bearing the letter relating to the classification of the enclosure appears at the height of the corresponding arrow. The index bearing the classification letter should not be less than the height of the arrows next to it or exceed twice the height of the index.
    IV. -The Community eco-mark may be affixed to the appliances holding it.
    V.-Energy consumption, expressed in kilowatt/hour, of the heating function (s) (conventional or forced convection), determined in charge Standard in accordance with the standards set out in section
    . -Volume of the enclosure in litres, determined in accordance with the standards referred to in section
    . -Device type as follows:
    Low volume: 12 l volume < 35 l;
    Average volume: 35 l volume < 65 l;
    Large volume: 65 l volume.
    The arrow must be placed in front of the appropriate device type.
    VIII. -Noise level, measured during the operating mode in which energy efficiency is determined.
    IX. -Reference of the standard used to measure energy consumption.
    The colours and dimensions of the label will be specified by an opinion published in the Official Journal of the French Republic. It can be provided in two parts: a framework that can be used for all devices and a specific part with information about a particular device type.

  • BACKGROUNDER


    The form contains the following information that must be presented in the order shown. This information can be presented in a table covering a series of devices supplied by the same provider:
    1. Name or trademark of the manufacturer or his agent;
    2. Model reference, defined by the provider;
    3. Classification of the enclosure (of the loudspeakers) according to its energy efficiency, in accordance with the indications in Annex IV below, on a scale from A to G. When this information is given in one table, it may be expressed in another Form, provided that the classification of A to G appears clearly. The heating function used to determine the energy class must be specified;
    4. When the information is given in tabular form and some of the devices listed have been given a " Community eco-label " Under Regulation (EC) No 1980/2000, the latter information may be included in a heading Titled " Community eco-label " In which the label logo is reproduced;
    5. Energy consumption, expressed in kilowatt hours on the basis of heating (conventional and/or forced convection and/or steam), determined in normalized load, in accordance with the standards referred to in Article 7 of this Order;
    6. Useful volume of the enclosure in litres, determined in accordance with the standards referred to in section 7 of this Order;
    7. Device type as follows:
    Low volume: 12 l volume < 35 l;
    Average volume: 35 l volume < 65 l;
    Large volume: 65 l volume.
    The arrow must be placed in front of the appropriate device type;
    8. Standard laden cooking time, determined in accordance with the test procedures of the standards referred to in section 7 of this Order;
    9. Noise level measured during the mode of operation in which energy efficiency is determined;
    10. Energy consumption when the oven does not heat and is in the minimum energy consumption mode, in accordance with the test procedures of the standards referred to in Article 7 of this Order;
    11. Surface of the largest baking plate, expressed in cm² and determined as " Surface area ", in accordance with the standards set out in section 7 of this Order.
    If a copy of the label, either in colour or in black and white, is Included in the fact sheet, only information that is not on the label must be added

SALE BY MATCH
AND OTHER TYPES OF SALE A DISTANCE


Mail-order catalogues and other remote print communications, advertisements On the Internet or other electronic media referred to in Article 5 of this Order, shall contain the following information set out in Annex II and presented in the order shown below:
1. Manufacturer's name or brand name or its agent and model reference;
2. Energy efficiency class;
3. Energy consumption;
4. Useful volume;
5. Size;
6. Noise level.
If additional information is also provided, the information is presented in the form set out in Appendix II and included in the order fixed for the record.
