DECRET
Decree No. 2006-96 of 1 February 2006 amending Decree No. 67-715 of 16 August 1967 on the special status of the body of telecommunications engineers

The Prime Minister,
On the Report of the Minister of Economy, Finance and Industry and the Minister of the Public Service,
Seen Order No. 58-1136 of 28 November 1958 Organic Law on Appointments to Civil and Military Employment of the State;
In the light of Law No. 83-634 of 13 July 1983 as amended relating to the rights and obligations of civil servants, by Act No. 84-16 of 11 January 1984 Amended laying down statutory provisions relating to the public service of the State;
As amended by Act No. 90-568 of 2 July 1990 on the organisation of the public postal and telecommunications service;
In the light of Act No. 2003-1365 31 December 2003 on the public service obligations of telecommunications and France Télécom;
In view of Decree No. 67-715 of 16 August 1967 concerning the special status of the body of telecommunications engineers;
Given the decree N ° 85-986 of 16 September 1985, as amended, relating to the special arrangements of certain positions of officials of the State and certain arrangements for permanent termination of office;
Having regard to Decree No. 91-84 of 21 January 1991 on the Secondment and non-executive positions to carry out functions specific to La Poste and France Télécom, as amended by Decree No. 2004-981 of 17 September 2004;
In view of the opinion of the Joint Technical Committee of the Ministry of Economy, Finance And industry as of January 18, 2005;
The Conseil d' Etat (Finance Section) heard,
Describes:

Item 1
Article 1 of the decree of 16 August 1967 is replaced by the following provisions:
" Art. 1. -Telecommunications engineers form an inter-ministerial body reporting to the Minister responsible for telecommunications.
They are competent to deal with any issue of a scientific, technical or administrative nature. Organisational, economic or social in relation to the development, use or control of the information and communication technologies and the services associated with
. Supervision, supervision, inspection, evaluation of public policies, studies, expertise and research or teaching.
Telecommunications engineers may perform their duties in the position of activity in Administrations and public administrative establishments of the State.
They are also intended to serve in the position of activity in the services of La Poste. ' Art. 19. - When serving in La Poste, telecommunications engineers fall within the framework category within the meaning of Article 3 of Decree No. 90-1111 of 12 December 1990 on the status of La Poste. "

" Art. 20. - Can be placed in position of detachment in the body of telecommunications engineers:
1 ° Officials belonging to the bodies recruited by way of the Polytechnic School;
2 ° Officials belonging to the framework Of the employment of the territorial engineers or the body of the hospital engineers, holders of the diploma of the Ecole Polytechnique.

TRANSITIONAL PROVISIONS

Item 16

Article 20


On the date of publication of this Decree and without prejudice to the provisions of Article 30-1 of the Law of 2 July 1990 abovementioned governing the conditions for the granting of end-of-career leave to France Télécom:
1 ° Telecom engineers in positions of activity in France Télécom or in position of secondment within France Télécom or its Subsidiaries are attached for their management to the Ministry of Economy, Finance and Industry and secondment ex officio to France Télécom or its subsidiaries for a period of fifteen years.
The conditions of the planned secondment Above are governed by Articles 22, 23, 24, 28, 31, 32, 33 and 34 of the decree of 16 September 1985 referred to above;
2 ° Telecom engineers who, while in the position of activity in France Télécom, were placed in position Of secondment or non-executive positions outside France Telecom and its subsidiaries are attached for their management in the Ministry of Economy, Finance and Industry;
3 ° The telecommunications engineers who, when they were in Position of activity in France Télécom, have been placed in a different statutory position than those mentioned in 1 ° and 2 ° above are attached for their management to the Ministry of Economy, Finance and Industry.

Article 21


The Joint Administrative Committee responsible for the body of telecommunications engineers remains competent For the grades created by this Order, in accordance with the correspondence set out in sections 16 to 19 above, to the expiration of the term of office of its members.
