ARRETE
Decree of 18 December 2001 on individual substitutable volumes for certain controlled origin of the 2001 harvest

In view of Decree No. 74-871 of 19 October 1974 as amended on the analytical and organoleptic examinations of wine with name Of controlled origin;
In light of Decree No. 91-368 of 15 April 1991 on the organisation and operation of the National Institute of Appellations of Origin;
In view of Decree No. 93-1067 of 10 September 1993 on the performance of the Vineyards producing wines with a controlled designation of origin;
In view of the proposal of the National Wine and Life Committee of the National Institute of Appellations of Origin on 5 and 6 September 2001,

Item 1


As part of the 2001 harvest for all controlled appellations of origin (AOC) of the Gironde department With the exception of designations " Cadillac, " Let's hope, " Loupiac "," Sainte-Croix-du-Mont ", any producer may, in his declaration of harvest, claim as a controlled appellation of origin an individual substituted volume, called" VSI ", Exceeds the maximum volume allowed for the current year, but does not exceed the performance limit provided for in the third paragraph of Article 4 of the Decree of 10 September 1993.

Article 2


For the 2001 harvest for controlled appellation of origin " Chinon ", any producer may, in his or her declaration of harvest, claim as a controlled appellation of origin a" VSI " Greater than the maximum volume allowed for the current year, but not exceeding the yield of 60 hectolitres per hectare.

Item 3


For the 2001 harvest for controlled appellations of origin " Beaujolais "," Beaujolais Villages "," Beaujolais supérieur ", Beaujolais followed by the name of the commune of origin," Brouilly "," Chénas "," Surgery "," Coast De Brouilly "," Fleurie "," Juliénas "," Morgon "," Windmill "," Redenied "," Saint-Amour ", for red, rosé and white wines, any producer may, in his declaration of harvest, claim as a controlled appellation of origin a" VSI " Exceeds the maximum allowable volume for the current year, but does not exceed the performance limit provided for in the third paragraph of Article 4 of the Decree of 10 September 1993.

Article 4


The right to AOC can be granted to " VSI " By the National Institute of Appellations of Origin, subject to:
-the conditions for the production of all the wines produced In the operation for which the appellation of origin is claimed has been verified;
-the individual substitutable volume has successfully undergone the analytical and organoleptic examinations provided for in the Decree of 19 October 1974 Above, concomitantly and under the same conditions as the maximum permissible volume;
-the producer destroys by distillation, and by no later than 31 July 2002, a volume of equivalent wine, of the same name and of the same colour Vintage vintages, produced on the same operation. The distillation must be carried out in the department of Gironde for the AOC provided for in Article 1 of this Order, in the department of Indre-et-Loire for the AOC " Chinon " And in the departments of the Rhône and Saône-et-Loire for the AOC Pursuant to Article 3 of this Order.

Article 5


The certificate of approval provided for in Article 1 of the Decree of 19 October 1974 Shall be issued to the producer, in a single case for the individual substitutable volume, after presentation by 31 July 2002 of proof of the destruction provided for in the fourth paragraph of Article 4 of this
. Destruction to be carried out by 31 July 2002 at the National Institute of Appellations of Origin shall consist of:
-proof of delivery from the operation to the distillery, corresponding to the transfer of the wines referred to in the Fourth paragraph of Article 4 of this Order. This certificate, bearing in mind the identity of the holding in question (social reason, number ONIVINS) and containing the characteristics of the distilled volumes, is covered by the services of the Directorate-General for Customs and Indirect Rights and Transmitted by the producer to the National Institute of Appellations of Origin;
-a certificate of destruction corresponding to the distillation of wines established by the official services.

Article 6


In the event of failure to comply with all or part of the provisions of this Order, the quantities claimed under the individual Distillation in accordance with the conditions laid down in Article 6 of the aforementioned Decree of 10 September 1993.

Article 7


The Director of Department of Agriculture and Fisheries, the Director General of Competition, Consumer Affairs and Enforcement, and the Director General of Customs and Excise, Department of The economy, finance and industry shall each have responsibility for the execution of this Order, which shall be published in the Official Journal of the French Republic.
