For the following reasons:


1. Regulatory framework


The powers of the Electronic Communications and Numbering Regulatory Authority are provided for in the provisions of Articles L. 36-7 and L. 44 of the Postal Code and of the Electronic communications:
" Art. L. 36-7. -The Telecommunications Regulatory Authority:
" (...)
" 7 ° Establishes the national telephone numbering plan, assigns the operators the numbering resources necessary for their activity under the conditions laid down in Article L. 44 and ensures their proper use; (...) "

" Art. L. 44. -The national telephone numbering plan shall be drawn up by the Telecommunications Regulatory Authority and managed under its control. It ensures equal and simple access for users to the various electronic communications networks and services and the equivalence of numbering formats. It allows, subject to technical and economic feasibility, users located in other Member States of the European Community to access non-geographical numbers accessible throughout the national
. The Authority Shall award, in objective, transparent and non-discriminatory conditions, to operators who request it, prefixes and numbers or blocks of numbers, subject to a fee fixed by decree in the Council of State, intended to cover the costs of Management of the telephone numbering plan and control of its use.
" The award decision specifies the conditions for the use of these prefixes, numbers or blocks of numbers that relate to:
" A) The type of service to which Use of allocated resources is reserved;
" (b) Requirements to ensure proper utilization of assigned resources;

" (d) Assignment duration, which cannot be longer than 20 years.

Directive 2002 /20/EC of 7 March 2002 (" authorisation ") Also has:
" Art. 5. - Right of use of radio frequencies and numbers.

. 4. The conditions of the general authorisation are not taken up by the Member States when granting rights of use of radio frequencies or numbers. "
Finally, Directive 2002 /2l/EC of 7 March 2002 (" framework ") Has:
" Art. 10. - Numbering, Naming and Addressing.
" 1. Member States shall ensure that national regulatory authorities have control over the assignment of all national numbering resources and the management of national numbering plans. Member States shall ensure that appropriate numbers and numbers of numbers are provided for all publicly available electronic communications services. National regulatory authorities shall establish procedures for assigning objective, transparent and non-discriminatory national numbering
. 2. National regulatory authorities shall ensure that numbering plans and associated procedures are implemented in a manner that ensures equal treatment for all providers of electronic communications services Accessible to the public. In particular, Member States shall ensure that a business to which a range of numbers is assigned does not discriminate against other providers of electronic communications services in respect of sequences Numbers used to provide access to their services.

"
In application of these articles, this Decision establishes the structure of the French numbering plan. This Decision also sets out the conditions for eligibility and the conditions of use for the different categories of numbers.
The structure of the French numbering plan is the result of developments In order to adapt the numbering plan to the needs of users and operators.
The French plan was stabilised in 1996 around a ten-digit main structure, with short
. The structure of the numbering plan has been the subject of consultations with all the parties concerned: operators, manufacturers and users.
In particular, the updating of the structure of the plan in 2005 has been the subject of consultations Carried out by the Electronic Communications and Postal Regulatory Authority. A call for comments on the numbering plan was launched in October 2004 and contributions to this call for comments were published in March 2005. Syntheses by subject were also published by the Authority. Finally, the Authority's projects on the subject have been discussed in a number of consultation fora and in particular the Numbering Advisory Committee.
The sound management rules for all numbering resources are Defined in the Authority's Decision on Numbering Plan Management Rules.


2.1. Definitions


The main concepts used in this Decision are defined by the Electronic Communications and Position Code. Other terms, which are of particular significance in this context, must, however, be specified.

The provisions of Article L. 32 of the Code of Posts and Electronic Communications specify the concepts of networks open to the Public, electronic communications services, public telephone service and operator:
" 1 ° E-Communications.
" Electronic communications means broadcasts, transmissions or receptions of signs, of Signals, writings, images or sounds, by electromagnetic means.
" 2 ° Electronic communications network.

" 15 ° Operator.
Operator means any natural or legal person operating a network of electronic communications open to the public or providing a service to the public Electronic communications.

Article 2 of Directive 2002 /21/EC of the European Parliament and of the Council of 7 March 2002 introduces more the following definitions:
" (h) " user: a natural or legal person who Uses or requests a publicly accessible electronic communications service;

" (n) " end user: a user who does not provide public communication networks or electronic communications services Accessible to the public; "
Finally, Act No. 86-1067 of 30 September 1986 on the freedom of communication as amended provides in Article 2:
" (...) An electronic communication to the public means any provision of the Public or categories of public, by means of electronic communication, signs, signals, writings, images, sounds or messages of any kind that do not have the character of a private correspondence. (...) "
In addition, the provisions of Article L. 44 specify the notion of portability:
" (...) Operators are required to propose to a reasonable price to their subscribers the offers enabling them to keep their number Geographical location when changing operators without changing geographical location and maintaining their non-geographical, fixed or mobile number, when they change operators while remaining in metropolis, in the same overseas department, at Mayotte or Saint-Pierre and Miquelon. 2.2. Terms used in this Decision


Interpersonal Communications:
Interpersonal communications refers to all electronic communications, including telephone communications, Between specific or professional end users that are not realized as part of the access to a value-added service.
Interpersonal communication numbers are the following numbers:
-the numbers The value of Z is 1, 2, 3, 4, or 5, called geographical numbers;
-the numbers whose value of Z is 6, called mobile numbers;
-the numbers whose value of Z is 9, called non-geographic numbers.
Value-added services :
Value-Added Services refers to the benefits of providing primarily communications to the public electronically accessible with a numbering resource.
Access Numbers for Value-Added Services Include the numbers whose value of Z is 8, the four-digit numbers of the 3BPQ form, called short numbers, and the six-digit numbers of the form 118XYZ.
Definitions of allocation, assignment and making available Numbers are present in the decision of the Authority approving the rules for the management of the numbering plan.
Number series: 1 million consecutive numbers identified by their first three digits ("a ZAB").
Block of Numbers: smaller number of consecutive numbers due outside the numbers assigned to the unit. It is usually 10 000 numbers (form " ZABPQ "), it may be 1,000 numbers in certain specific cases (form " ZABPQ M "), after consulting the affected operators.


3. Using numbers


The two main functions of the number.
The telephone number performs two main functions:
-an addressing function;
-a naming function.
The function Of addressing is the historical function of numbering plan E. 164. Indeed, in switched networks, numbers are used as is to route calls from one subscriber to another. This dimension remains very present for geographical numbers, which are based on a geographical organization that allows calls to the right end point. Non-geographic numbers (mobile, service, short, etc.) Only identify the operator to which the call should be delivered.
Addressing the addressing function involves taking into account the constraints of organizing networks that technically use the numbers.
On the other hand, The development of new transport technologies that are not based on switching reduces the interest of numbers as routing elements for certain networks. This is the case today of networks based on IP technology, for which the number is only one recipient's identifier. These technologies use other addressing systems (IP addresses, MAC addresses, etc.).) -universality: the national numbering plan being integrated into the global plan E. 164 in place in all countries of the world, the use of numbers remains the main means of gaining access to Electronic communications services in France and around the world;
-simplicity: the use of the plan is very simple for the user and remains a very ergonomic solution, compared to the use of other systems of Communication;
-consumer confidence: as a result of the above qualities, operators who use telephone numbers benefit from consumer confidence in this system. This solution therefore remains interesting for the development of services by this means.
Services that use the numbering plan continue to benefit from interesting economic prospects: that is the case in particular of services
The growth in the number of operators in the numbering plan and the number of services calls for the maintenance of clear and protective rules with respect to these characteristics.


4. On the evolutions of the numbering plan


This Decision lays down the structure of the national numbering plan, after consultation with all the players in the sector: operators, equipment suppliers, users. This consultation also helped to develop a long-term vision of the numbering plan and the future needs of the different actors.


Changes in practice and techniques


From the point of view of the user, the use of telephone numbers is to be confronted with the appearance of other forms of naming such as the Internet naming system.
If the development of convergence solutions between the world of the Telephony and the world of the Internet is already in progress, it is very likely that the different systems will cohabited.
In particular, it is difficult to pronounce on the emergence of a unique user ID, be it a number Phone, email address or other identifier. This unique identifier would, however, make it possible to manage the joignability effectively.
There is also a proliferation of identifiers (numbers, email addresses, etc.).) Attention to the development of
machine-to-machine communications


The numbering plan is now used sparsely for machine-to-machine communications (video surveillance, telalarms, etc.) However, the qualities presented by telephone numbers could lead to more extensive use of numbering resources. Indeed, some industrial projects plan to equip objects such as cars or electricity meters with specific numbers to exchange information. Interesting applications are starting to appear, such as sending an SMS in case of an accident, for example. Evolution of the rules for geographical numbers


The geographical organisation of numbers 01 to 05 remains an important constraint on many networks and serves as a basis, in particular for the development of the interconnection market. However, from the consumer's point of view, this system is justified mainly for two other points:
-pricing, as a large number of operators continue to distinguish rates according to the distance between the appellant and the caller and Based on the nature of the numbers;
-the attachment of the number to a geographical area: many users know the beginning of the numbers of their geographical area (the ZAB, or even the ZABPQ) and use this information to identify Their interlocutors and origin.
These two factors are expected to be phased out. For tariffs, the market is moving towards a simplification of tariffs for fixed posts with a single tariff for all communications within the national territory (excluding the overseas departments and territories). With regard to the attachment to a ZAB or a ZABPQ, the increase in the number of actors led the Authority to increase the number of ZABPQ and ZAB associated with each NZ, blurring the references from the historical monopoly. This is already the case today in some regions, for example in Paris.

As with all Interpersonal communication numbers, the number 09 numbers are intended to be integrated in the carrier selection field.


Retention in reserve of slice 07


In view of the number requirements of operators and the use of already open resources, it seems relevant to keep in reserve Z = 7 for future use. Saturation of 06


Mobile service development has grown significantly since the introduction of ¶ s 06. Today, these numbers are more widely used than the combined numbers 01 to 05 and there is still significant growth potential for these services. INTRODUCTION
Scope of this decision

-Guyana (FUIT country code: + 594);
-Martinique (country code of ITU: + 592);
-Meeting (ITU country code: + 262);
-Mayotte (ITU country code: + 269, shared with Comoros);
-Saint-Pierre-et-Miquelon (ITU country code: + 508).
All correspondents in all of these Territories can join each other using the ten-digit French numbering plan, without calling the country code. In Mayotte and Saint-Pierre-et-Miquelon, subscribers can join each territorial community by dialing the last six digits PQMCDU of their numbers.
