ARRETE
Decree of 8 December 2006 concerning general requirements for classified installations subject to declaration under heading No. 2120

The Minister of Ecology and Sustainable Development,
Given the Environmental Code, and in particular articles L. 211-1, L. 512-10 and L. 512-12;
Given the Order No. 53-578 of 20 May 1953, as amended fixing the classification of classified installations;
Having regard to Decree No. 77-1133 of 21 September 1977 as amended for the purposes of Act No. 76-663 of 19 July 1976 on installations classified for the Protection of the environment;
In the opinion of the Senior Facilities Council of June 27, 2006,
Stop:

Article 1


Classified installations subject to declaration under heading No. 2120 (livestock establishments, sales, Transit, ... dogs) are subject to the provisions of Annex I (1). These provisions shall be without prejudice to other legislation.

Article 2


The provisions of Annex I shall be Applicable to installations declared after the date of publication of this Order in the Official Journal, increased by four months.
The provisions of this Annex shall apply to existing installations, declared before the date Publication of this Order in the Official Journal increased by four months, subject to the conditions laid down in Annex II. The requirements to which existing installations are already subject shall remain applicable until the entry into force of these provisions.
The provisions of Annex I shall also apply to classified installations subject to Declaration included in an establishment that has at least one installation subject to the authorisation scheme, provided that such installations are not governed by the prefectural authorization decree.

Article 3


The Prefect may, for a given installation, adapt the provisions of the Annexes in accordance with the conditions laid down in Article L. 512-12 of the Code of The environment and section 30 of the aforementioned decree of 21 September 1977.

Article 4


The Director of Pollution Prevention and Responsible for the execution of this Order, which shall be published in the Official Journal of the French Republic.
