ARRETE
Decree of 8 January 2003 fixing for 2003 the rate of contributions due to the system of compulsory insurance for agricultural workers against accidents at work and occupational diseases And the share of contributions allocated to each expense category of this plan

The Minister of Economy, Finance and Industry, and the Minister of Agriculture, Food, Fisheries and Rural Affairs,
In view of Chapter I of Title V of Book VII Rural code;
Given the Labour Code, in particular Articles L. 127-1 to L. 127-7 and L. 322-4-16-3;
Given the social security code;
In view of Act No. 77-1454 of 29 December 1977 establishing compensation between the general scheme of Social security for employees in trade and industry and the system of agricultural workers for insurance pensions against accidents at work and occupational diseases;
Given Decree No. 73-523 of 8 June 1973 Fixing the rules for calculating the contributions of the compulsory insurance scheme for agricultural workers against accidents at work and occupational diseases;
Having regard to Decree No 78-467 of 22 March 1978 laying down the procedure The application of Law No 77-1454 of 29 December 1977 establishing a compensation between the social security scheme for employed persons in trade and industry and the scheme of agricultural workers for insurance pensions against Accidents at work and occupational diseases;
In the light of the amended decree of 24 October 1984 laying down the rules for the individualised pricing of the compulsory insurance scheme for agricultural workers against accidents at work and Occupational diseases;
Having regard to the Decree of 21 December 1995 for the application of Article L. 751-22 of the Rural Code;
In the opinion of the National Commission for the Prevention of Workers' Compensation and Occupational Diseases Agricultural as of 17 December 2002;
In view of the opinion of the Higher Council for Agricultural Social Benefits (section of the insurance of agricultural workers against accidents at work and occupational diseases) of 17 December 2002,
Stop:

Article 1


Pursuant to Article L. 751-24 of the Rural Code, contributions due under the insurance scheme Compulsory agricultural workers against accidents at work and occupational diseases are allocated to cover the expenses of this scheme under the following conditions:
-expenditure on management, medical supervision and action Health and social: 5.77 %;
-national prevention fund: 5.06 %;
-advances granted under objective agreements: 0.39 %;
-technical charges: 88.78 %.

Article 2


The percentage referred to in A-3 of Article 2 of the Decree of 8 June 1973 is set at 0 %.

Article 3


The correction coefficient referred to in the A of Article 2 of the Decree of 8 June 1973 shall be fixed at 1.189 0.
The risk rate of travel referred to in the second subparagraph of Article 2 of the Decree of 8 June 1973 referred to above shall be 0.247 0.
The flat-rate increase referred to in Article 2 of the Decree of 8 June 1973 shall be fixed at 0.039 9 %.
The agricultural occupational sectors, categories of Risks depending on each of them, the rates of contributions referred to in Article 1 of the Decree of 8 June 1973 above and the fixed flat-rate increase in the impact of individualisation are fixed as follows:

Article 4


Co-operatives or organizations operating in a professional category listed in sectors 1 to 4 should be classified in this category.

Article 5


The rate of contribution applicable to staff working exclusively at the head office and in the offices of farms, enterprises and agricultural bodies belonging to the different Sectors of professional activity referred to in Article 4 shall be set at 1.50 %.

Article 6


The contribution rate applicable to the Groups of employers defined in Articles L. 127-1 to L. 127-7 and L. 127-9 of the Labour Code is that of the main activity carried out by the employees of each of these groups.
The contribution rate applicable to associations Intermediaries defined in Article L. 322-4-16-3 of the Labour Code in respect of persons who are not employed for pecuniary purposes at the disposal of natural or legal persons for a period of more than the duration provided for in the Article D. 241-6 of the Social Security Code is that of the main activity carried out by the employees of each of these intermediary associations.

Article 7


The premium rate for students in agricultural technical and vocational education institutions (including Upper Rhine, Bas-Rhin and Moselle) is 0.38 %.

Article 8


The Director of the Budget in the Ministry of Economy, Finance and Industry and the Director of Operations, Social Policy and Employment in the Ministry of Agriculture, Food, Fisheries and Rural Affairs shall each have responsibility for the implementation of this Order, which shall take effect from 1 January 2003 and shall be published in the Official Gazette of the Republic French.
