ARRETE
Order of 31 December 2002 on individual substitutable volumes for certain controlled appellations of origin of the 2002 harvest

Due to Order in Council No. 91-368 of 15 April 1991 on the organisation and operation of the National Institute for Appellations of Origin;
In view of Decree No. 2001-1163 of 7 December 2001 concerning the analytical and organoleptic examinations of wines with name Controlled origin;
In view of Decree No. 2002-1325 of 5 November 2002 on the conditions of production and performance of vineyards producing wines with a controlled designation of origin;
In view of the proposals of the National Wine Committee and Eaux-life of the National Institute of Appellations of Origin on 4 and 5 September 2002,

Article 1


As part of the 2002 harvest for all of the controlled appeals of the Gironde department, to The exception of designations " Cadillac, " Let's hope, " Loupiac "," Sainte-Croix-du-Mont ", any producer may, in his declaration of harvest, claim as a controlled appellation of origin an individual substituted volume, called" VSI ", Exceeds the maximum allowable volume for the current year, but does not exceed the performance limit provided for in the third paragraph of Article 4 of the decree of 5 November 2002.

Article 2


For the 2002 harvest for the controlled appellation of origin " Chinon ", any producer may, in his or her declaration of harvest, claim as a controlled appellation of origin a" VSI " Above the maximum volume allowed for the current year, but not exceed the yield of 60 hl per hectare.

Item 3


For the 2002 harvest for controlled appellations of origin " Beaujolais "," Beaujolais Villages "," Beaujolais Superior "," Beaujolais " Followed by the name of the original municipality, " Brouilly "," Chénas "," Surgery "," Coast of Brouilly "," Fleurie "," Juliénas "," Morgon "," Windmill "," Redenied "," Saint-Amour ", for red and rosé wines, any producer may, in his declaration of harvest, claim as a controlled appellation of origin a" VSI " Greater than Maximum volume allowed for the current year, but not exceeding 5 hl per hectare beyond this maximum allowable volume for the current year.

Article 4


The right to the AOC may be granted to " VSI " By the National Institute of Appellations of Origin, subject to:
-the conditions for the production of all wines produced in the operation for which The designation of controlled origin is claimed;
-the individual substitutable volume has successfully undergone the analytical and organoleptic examinations provided for in the aforementioned Decree of 7 December 2001 at the same time and in the The same conditions as the maximum permissible volume;
-the producer destroys by distillation and by no later than 31 July 2003 a volume of wine equivalent to the same appellation and the same colour of earlier vintage, produced on the Same operation. The distillation must be carried out in the department of Gironde for the AOC provided for in Article 1 of this Order, in the department of Indre-et-Loire for the AOC " Chinon " And in the departments of the Rhône and Saône-et-Loire for the AOC Pursuant to Article 3 of this Order.

Article 5


The certificate of approval provided for in Article 1 of the Decree of 7 December 2001 Shall be issued to the producer, in a single case for the individual substitutable volume, after presentation no later than 31 July 2003 of proof of the destruction provided for in the fourth paragraph of Article 4 of this
. Destruction, which must be provided no later than 31 July 2003 at the National Institute of Appellations of Origin, consists of:
-proof of delivery of the operation to the distillery, corresponding to the transfer of the wines referred to in the Fourth paragraph of Article 4 of this Order. This certificate, bearing in mind the identity of the holding in question (social reason, number ONIVINS) and containing the characteristics of the distilled volumes, is covered by the services of the Directorate-General for Customs and Human Rights and Transmitted by the producer to the National Institute of Appellations of Origin;
-a certificate of destruction corresponding to the distillation of wines established by the official services.

Article 6


In the event of non-compliance with all or part of the provisions of this Order, the quantities claimed under the individual substitutable volume are sent to Distillation under the conditions laid down in Article 8 of the aforementioned Decree of 5 November 2002.

Article 7


The Director of Economic and International Policy at the Ministry of Agriculture, Food, Fisheries and Rural Affairs, the Director General of Competition, Consumer Affairs and Enforcement, and the Director General of Customs And indirect rights to the Ministry of Economy, Finance and Industry, each as far as it is concerned, are responsible for the execution of this Order, which shall be published in the Official Journal of the French Republic.
