ARRETE
Decree of 11 January 2005 on the recognition of natural disaster status

The Minister of the Interior, Internal Security and Local Freedoms, the Minister of Economy, Finance and Industry, the Minister for Overseas Affairs and the Minister Delegate to the Budget and Budget Reform, Government Spokesperson,
In view of the Insurance Code, in particular Articles L. 111-5, L. 122-7, L. 125-1 to L. 125-6 and A 125-1 and following;
In view of the Commission's opinions of 18 November 2004 Established by Circular No. 84-90 of 27 March 1984 on the compensation of victims of natural disasters,

Item 1


In accordance with the Insurance Code, requests for recognition of the state of natural disaster were Examined for damage caused by floods and mudslides and ground movements.
The municipalities subject to a finding of a state of natural disaster are listed in Annex I below for risks and risks
The municipalities whose claims for natural disaster status are rejected are listed in Appendix II below for the specified risks and periods.

Article 2


The state of natural disaster established by decree may open the right to guarantee insured persons against the effects of natural disasters on property Subject to the insurance contracts referred to in the Insurance Code, where the resulting direct material damage has been the determining factor in the effect of that natural agent and the usual measures to be taken to prevent such damage Have been unable to prevent their occurrence or could not be taken.
In addition, if the insured person is covered by a contract referred to in the Insurance Code, the state of natural disaster established may open the right to the aforementioned guarantee, under the conditions laid down The corresponding insurance contract.

Article 3


The applicable deductible is modulated according to the number of findings of the state Natural disaster for the same risk, in the five years preceding the date of signature of this Order, in municipalities that do not have a foreseeable natural risk prevention plan for risk
For these communes, the number of such orders appears in parentheses in Annex I. It takes into account not only the previous orders taken for the same risk, except the order of 29 December 1999, but also the present order.

Article 4


This Order will be published in the Official Journal of the French Republic.
