Decree of 11 January 2005 on the recognition of natural disaster status

The Minister of the Interior, Internal Security and Local Freedoms, the Minister of Economy, Finance and Industry, the Minister for Overseas Affairs and the Minister Delegate to the Budget and Budget Reform, Government Spokesperson,
In view of the Insurance Code, in particular Articles L. 111-5, L. 122-7, L. 125-1 to L. 125-6 and A 125-1 and following;
In view of the opinion rendered on 6 September 2004 by the Committee Established by Circular No. 84-90 of 27 March 1984 on the compensation of victims of natural disasters,

Item 1


In accordance with the Insurance Code, requests for recognition of the state of natural disaster were Examined for flood damage and mudslides, flooding from groundwater upwellings, floods and mechanical shocks related to wave action, ground movements and earthquakes.
The municipalities subject to a finding of a natural disaster are listed in Annex I below for the risks and periods indicated.
Municipalities whose requests for recognition of the state of natural disaster Are rejected as Annex II below for the risks and periods indicated.

Article 2


The state of disaster May open the right to guarantee insured persons against the effects of natural disasters on the property subject to the insurance contracts covered by the insurance code, where the direct material damage which Resulted in the effect of this natural agent and the usual measures to prevent such damage prevented their occurrence or could not be taken.
In addition, if the insured person is covered by a contract Referred to in the Insurance Code, the state of natural disaster established may qualify for the aforementioned guarantee, under the conditions laid down in the relevant insurance contract.

Item 3


The applicable franchise is modulated based on the number of natural disaster findings for the same risk, in the five years preceding the date Of this Order, in the communes which do not have a plan for the prevention of foreseeable natural risks for the risk concerned.
For these communes, the number of such orders shall appear in parentheses in Annex I. It shall take Not only the previous orders taken for the same risk, except the order of 29 December 1999, but also the present order.

Article 4


This Order will be published in the Official Journal of the French Republic.
