Decree n ° 2004-60 of 8 January 2004 on the publication of the debt consolidation agreement between the Government of the French Republic and the Government of the Republic of Mozambique, signed in Paris November 20, 2002 (1)

The President of the Republic,
On the report of the Prime Minister and the Minister for Foreign Affairs,
Having regard to Articles 52 to 55 of the Constitution;
Given the Decree No. 53-192 of 14 March 1953, as amended concerning the ratification and publication of international commitments entered into by France,
Décrète:

Article 1


The debt consolidation agreement between the Government of the French Republic and the Government of the The Republic of Mozambique, signed in Paris on 20 November 2002, will be published in the Official Journal of the French Republic.

Article 2


The Prime Minister and the Minister for Foreign Affairs shall each have responsibility for the execution of this Decree, which shall be published in the Official Journal of the French Republic.

A C C O R D


CONSOLIDATION OF DETTES BETWEEN THE GOVERNMENT OF THE FRENCH REPUBLIC AND THE GOVERNMENT OF THE REPUBLIC OF MOZAMBIQUE
The Government of the French Republic and the Government of the Republic of Mozambique, with a view to implementing the recommendations of the Procès-Verbal approved at the meeting held in Paris on 16 and 17 November 2001 and The French Debt Initiative of the Poor Countries Very Indebted, have agreed as follows:


Article I


1. The debt of the Republic of Mozambique in respect of the French Republic concerned by this Agreement shall be composed of all commercial credits initially comprising a credit term of more than one year, guaranteed by the French Company Insurance for foreign trade on behalf of the French Republic and granted to the Government of the Republic of Mozambique or guaranteed by the Government of the Republic of Mozambique in the context of contracts Of export or credit agreements for financing concluded before February 1, 1984.
2. The amounts due on 31 August 2001, unsettled and unpaid, shall be cancelled in respect of the appropriations referred to in paragraph 1, including any interest, interest in delay or standstill.
3. The amount of the cancelled debt referred to in paragraphs 1 and 2, referred to in the Annex to this Agreement, shall be evaluated at the date of this Agreement at EUR 264 869 723.45. The Annex is an integral part of this Agreement. In the event of a mutually agreed evaluation error, the amount so agreed may be modified by agreement between the

In the event that amendments that increase the commitments of the Government of the Republic of Mozambique with respect to the Government of the French Republic would have been or would be made to the contracts or conventions referred to in the As of 1 February 1984, the resulting new commitments would not be covered by the provisions of this Agreement.


Article II


The French Company And the Bank of Mozambique shall, on behalf of their respective Government, be responsible for the application of this Agreement.


Article III


This Agreement Enter into force on the date of its signature.
