In view of articles L. 133-1 et seq. Of the Labour Code;
In the light of the decree of 25 April 1988 and the successive orders, The Order of 24 November 2003, extending the collective agreement for the metallurgy of the Pas-de-Calais of 25 September 1987 and of texts amending or supplementing it;
Having regard to the amendment of 9 July 2004 relating to the special premium, to The above collective agreement;
Having regard to the agreement of 9 July 2004 on hierarchical minimum remuneration and the basket indemnity, entered into under the aforementioned collective agreement;
Having regard to the rider of 9 July 2004, relative The annual minimum actual remuneration, to the above collective agreement;
Given the request for extension submitted by the signatory organisations;
In view of the opinion published in the Official Journal of 27 November 2004;
In view of the opinions Collected during the course of the investigation;
Given the reasoned opinion of the National Commission for Collective Bargaining (Sub-Committee on Conventions and Agreements), collected in accordance with the procedure laid down in Article R. 133-2 of the Labour Code,
:
Are made mandatory for all employers and employees included in the scope of the Collective agreement on the metallurgy of the Pas-de-Calais of 25 September 1987, as amended by the agreement of 7 July 1995, as extended by order of 23 October 1995, the provisions of:
-the amendment of 9 July 2004 relating to the special bonus, to the Collective agreement referred to above;
-the agreement of 9 July 2004 on hierarchical minimum remuneration and the basket indemnity, concluded in the framework of the abovementioned collective agreement;
-the amendment of 9 July 2004, relating to Annual minimum actual remuneration, to the aforementioned collective agreement.
The extension of the effects and sanctions of the Agreements referred to above shall be made from the date of publication of this Order for the period remaining to be run and the conditions laid down in the aforementioned agreements.
The Director of Labour Relations shall be responsible for the execution of this Order, which shall be published in the Official Journal of the French Republic.
