ARRETE
Order of 5 January 2007 establishing the competent regional Joint Administrative Commissions for the framework and application of administrative supervisory staff Penitentiary

The Seals Guard, Minister of Justice, and the Minister of the Public Service,
In the light of Law No. 83-634 of 13 July 1983 as amended bearing the rights and obligations of the Civil servants, together with Act No. 84-16 of 11 January 1984 amending the statutory provisions relating to the public service of the State;
In view of Order No. 58-696 of 6 August 1958 on the special status of staff of the Deconcentrated services of the prison administration;
In light of Decree No. 66-874 of 21 November 1966 on the special status of officials of the deconcentrated services of the prison administration;
In the light of Decree No. 82-451 of 28 May 1982 as amended relating to the Joint Administrative Commissions;
In view of Decree No. 97-3 of 7 January 1997 concerning the deconcentration of the management of certain personnel under the Ministry of Justice;
In light of Decree No. 2006-441 of 14 April 2006 with special status for the prison administration monitoring staff,
Stop:

Item 1
It is hereby established with each regional director of prison services in metropolitan France a joint administrative committee responsible for the individual situations of civil servants Supervision and application of supervisory personnel under the matters referred to in Articles 4 and 5 of this Order.

The representatives of the administration of the regional joint administrative committees referred to in Article 1 shall be appointed by the Regional Director of Prison Services with whom they are Established.

The regional joint administrative committees referred to in Article 1 shall be responsible for the following questions:
-octrois and renewal of availability;
-proposals for Tenure;
-refusal of union training leave;
-rejection of a part-time job application;
-refusal of end-of-business leave;
-dismissal of an application for professional training or authorization leave Absence to follow a preparation for a competition or continuing education.

The regional joint administrative committees referred to in Article 1 shall prepare the work of the Central Joint Administrative Commission of the Coaching and Enforcement Staff Surveillance in the matters defined in Article 58 (1) of the aforementioned Law of 11 January 1984 and in the case of proposals for refusal of tenure and extension of probation.

The amended Order of 17 December 1996 establishing local joint administrative committees for the corps of graders and supervisors is repealed.

The Director of the Prison Service is responsible for the execution of this Order, which will be published in the Official Gazette of the French Republic.
