In the light of the decree of 8 September 1997 and the successive orders, in particular the decree of 22 December 1999, extending the national collective agreement of the technical aircrew of the helicopter operators of 13 November 1996 and a supplementary amendment;
Having regard to the amendment of 18 July 2003 establishing Annex 2 on working time and salaries to the above-mentioned national collective agreement;
Due to the request for extension submitted by The signatory organizations;
In view of the opinion published in the Official Journal of 3 September 2003;
In view of the opinions gathered during the inquiry;
In view of the reasoned opinion of the National Commission for Collective Bargaining (Sub-Committee on Conventions and agreements), delivered in session on November 24, 2003,
Stop:
Are made mandatory for all employers and employees included in the scope of the National collective agreement of helicopter operators' technical aircrew, the provisions of the amendment of 18 July 2003 establishing Annex 2 on working time and wages to the collective agreement
2 and 3 of Article 3 (Organisation, Programme of Work and Business cycles) and the second and third paragraphs of Article 10 (Periodical Rounds) shall be extended subject to the application of the provisions Articles L. 221-2 and L. 221-4 of the Labour Code, which require not to occupy an employee for more than six consecutive days per week and to give him a twenty-four hour rest period plus daily rest per week
Article 4 (b) (Duration and scheduling of permanence) and Article 5 (Equivalence and duration of service time) shall be extended subject to the application of the provisions of the last paragraph of Article L. 212-4 of the Code
The extension of the effects and sanctions of the endorsement referred to above shall be made from the date of publication of this Order For the period remaining to be run and the conditions laid down by that rider.
The Director of Labour Relations at Ministry of Social Affairs, Labour and Solidarity and the Director General of Civil Aviation at the Ministry of Equipment, Transport, Housing, Tourism and the Sea shall each be responsible for the execution of the This Order, which will be published in the Official Gazette of the French Republic.
