Summary


Created in 1993 to promote the training of members of public administrations and enterprises in all fields of cross-border cooperation, the Euro-Institute of Kehi has been established between the Land of Baden-Württemberg, the French State, the Alsace Region, the Bas-Rhin department, the urban community of Strasbourg, the city of Kehi, the Robert Schuman University Strasbourg III and the Kehi Fachhochschule in the form of a European grouping Of economic interest (EEIG), in the absence of a more appropriate structure at the time. In order to find a more suitable framework, allowing the permanent establishment of the institute, the partners decided to turn this EEIG into a local cooperation group CTQs are sui generis transfrontier co-operation bodies with legal personality and financial autonomy. The possibility for French territorial authorities and their groups to set up such structures with German, Swiss or Luxembourg territorial authorities and their groupings is provided for in the Franco-German agreement. German-Luxembourg-Swiss signed in Karlsruhe on 23 January 1996, approved by Law 97-103 of 5 February 1997 and entered into force on 1 September 1997. They are intended, in accordance with Article 11 of the Treaty, to carry out missions and services of interest to each of their founders. They shall be subject to the internal law applicable to public institutions of inter-communal cooperation where they have their seats. The future GLCT shall be established between the Alsace region, the Bas-Rhin department, the urban community of Strasbourg, The Land of Baden-Württemberg, the OrtenauKreis and the city of Kehl. The French state, the Robert Schuman University and the Kehl Fachhochschule will not be able to be members but may be associated with its activity under conventions. The seat will remain in Kehl, in Germany. The accession of the French territorial authorities and the urban community of Strasbourg is subject to prior authorisation, given by decree in the Council of State in accordance with Article L. 1112-4 of the Code. Given Article L. 1112-4 of the General Code of Communities
No. 97-103 of 5 February 1997 authorizing the approval of the agreement between the Government of the French Republic, the Government of the Federal Republic of Germany, the Government of the Grand Duchy of Luxembourg and the Government of the Swiss Federal Council, acting on behalf of the cantons of Solothurn, Basle-ville, Basle countryside, Argovie and Jura, signed in Karlsruhe on 23 January 1996, on cross-border cooperation between local authorities and public bodies Premises;
In view of Decree No. 97-798 of 22 August 1997 on the publication of this agreement;
In view of the deliberation of the Standing Committee of the Regional Council of Alsace dated 6 July 2001;
Seen the deliberation of the urban community Strasbourg as of 28 September 2001;
In view of the deliberation of the General Council of Bas-Rhin of 15 October 2001;
In view of the draft convention on cross-border cooperation between the Land of Baden-Württemberg, the Alsace region, the Département of Bas-Rhin, the Ortenaukreis d' Offenbourg, the urban community of Strasbourg and the city of Kehl established for the creation of the local grouping of cross-border cooperation called " Institute for Cooperation Cross-Border/Euro-Institute " ;
