Decision n ° 2003-723 of 19 December 2003 amending and supplementing Decision No 2003-224 of 14 May 2003 on the allocation of frequencies for the broadcasting of the European Cultural Chain Programme

Le Conseil supérieur de l' audiovisuel,
Vu le treaty entre la République française et les Länder de Bade-Wurtemberg, de l' Etat libre de Bavaria, de Berlin, de la ville libre hanséatique de Bremen, the Hanseatic Free City of Hamburg, Hesse, Lower Saxony, North Rhine-Westphalia, Rhineland-Palatinate, Saarland, Schleswig-Holstein on the European Cultural Chain, signed in Berlin on 2 October 1990 and published by the Decree No. 92-805 of 19 August 1992;
In light of the amended Act No. 86-1067 of 30 September 1986 on freedom of communication, and in particular the second paragraph of its article 26 and articles 30-1 and 44;
In light of Decree No. 2003-620 of 4 July 2003 adopted for the application of Article 30 (1) of Act No. 86-1067 of 30 September 1986 concerning the allocation and pre-financing of the cost of rearrangements of the frequencies, and in particular Article 7 thereof;
Having regard to Decision No 92-575 of 23 June 1992 amended and completed on the allocation of terrestrial radio frequencies for the broadcasting of the programmes of the European cultural chain;
In view of Decision No 2003-224 of 14 May 2003 allocating frequencies for broadcasting The programme of the European Cultural Chain, as amended by Decision No 2003-440 of 22 July 2003;
In view of the contract concluded on 30 April 1991 between the European Television Programme Company (SEPT) and Deutschland TV GmbH for training A European grouping of economic interest;
Considering that the deployment of digital terrestrial television, the first phase of which is planned before the end of 2004, requires the redevelopment of certain analogue frequencies, Currently allocated to the national program company The Fifth, but whose use is directly or indirectly inconsistent with scheduled frequencies for terrestrial digital television;
After deliberation,
Decides :

Article 1


The use of the frequencies set out in the Annex to this Decision shall be attributed to the European Cultural Chain for Broadcast from 19 hours to 3 hours of its programs. The allocation of these frequencies is subject to the conditions set out in the said Annex.
These frequencies replace those previously attributed to the European cultural chain, by Decision No 92-575 of 23 June 1992 as amended Above, for the dissemination of its programme in the areas of Mareuil-sur-Lay, Nonancourt, Ribérac, La Baule-Escoublac.

Article 2


The date on which the frequency substitutions are to be carried out by Decision No. 2003-224 of 14 May 2003 for the areas of Chézy-sur-Marne and Segré is postponed to 28 May 2004.

Article 3


This decision will be notified to the European Cultural Chain and published in the Official Journal of the French Republic.

2. In the event that the information referred to in 1 is subsequently amended, the beneficiary shall communicate to the CSA an updated version within one

If the CSA has found non-compliance with the technical requirements of the authorisation, the beneficiary shall be required to carry out a verification of the conformity of its installation with the requirements set out in the technical annex by a recognised organisation Of the authorization.
