In light of Decree No. 86-382 of 12 March 1986 as amended on the organisation and functioning of the National Institute for Demographic Studies;
In view of Decree No. 88-451 of 21 April 1988 on Specific statutes of the bodies of officials of the National Institute for Demographic Studies, as amended by Decree No. 93-771 of 26 March 1993, by Decree No. 94-1044 of 2 December 1994 and by Decree No. 96-857 of 2 October 1996;
In the opinion of the Central Joint Technical Committee of the National Institute for Population Studies as of November 4, 2004;
The Conseil d' Etat (Finance Section) heard,
Describes:
Article 1 of the decree of 21 April 1988 is replaced by the following provisions:
" Art. 1. -Officials of the National Institute for Population Studies (INED) are divided into the following bodies:
1 ° Supervisors;
2 ° Search officers;
3 ° Research engineers;
4 ° Study engineers;
5 ° Engineering Assistants;
6 ° Research Technicians;
7 ° Research Technical Assistants;
8 ° Research Technical Agents.
These officials are governed by the provisions of the aforementioned Decree of December 30, 1983. And by those of this Decree. "
In the same order, the words: " Title 1: Permanent provisions " Are deleted.
In Article 4 of the same decree, the words: " The reporting of their activities " Are replaced by the words: " A record describing the tracking of their activities ".
In section 7 of the Order, the last paragraph is deleted.
In Article 10 of the same decree, the last two sentences are deleted.
The heading of Chapter II of Title I of the Order is replaced by the following title:
"Chapter II
" Related Provisions To the bodies of
engineers and research personnel "
Section 15 of the Order is replaced by the following:
" Art. 15. - By way of derogation from the provisions of Article 236 of the Decree of 30 December 1983 referred to above, the Selection Board designated for each recruitment competition by the Director of INED shall comprise:
1 ° The Director of the Institute or its representative, President ;
2 ° The person (s) responsible for the unit or service of the institute concerned by the recruitment or their representatives, in the case where the assignment of the officials received to the competitions was specified when the competitions were opened;
3 ° Less than three members on the list of scientific and technical experts provided for in Article 235 of the aforementioned decree of 30 December 1983. "
Section 17 of the Order is replaced by the following:
" Art. 17. - The engineers and technical staff of the research shall be subject, in accordance with the provisions of Title III of the aforementioned Decree of 30 December 1983, to a periodic evaluation of their activities and their results. This assessment includes an individual interview which gives rise to an account.
Individual evaluation maintenance, which is carried out by the direct supervisor of the official, is intended in particular to take stock of the activity Of the officer and to measure his or her professional performance over the period since the previous individual assessment interview. It shall also cover the conditions for the development of this activity within the working environment, the training needs of the agent, taking into account, inter alia, the tasks assigned to it and its prospects for development Professional in terms of career and mobility.
The record of individual assessment maintenance is established by the direct supervisor of the employee. It shall include, in particular, a description of the activities and tasks of the agent, a review of his professional results and a written assessment. It shall also include, where appropriate, the training needs and professional development opportunities of the officer identified during the evaluation interview.
This record is communicated to the officer who, if any, is complete By commenting on his training needs and career and mobility perspectives. It shall be signed by the official and paid to his file.
The periodicity of the individual evaluation maintenance, its contents and its organisational arrangements shall be fixed by body or group of bodies, after the opinion of the Joint Technical Committee of The establishment, by decision of the director of INED.
The results of the assessment are taken into account in the management of the career, mobility and training of the employee. "
Section 20 of the Order is replaced by the following:
" Art. 20. - The official who does not possess the French nationality required to fulfil his military obligations vis-à-vis his State of origin is entitled to apply the provisions of Article 53 of the aforementioned Act of 11 January 1984. "
Sections 14, 16 and 19 and Division II of the Order are repealed.
