DECISION
Decision 2005-1052 of 20 December 2005 on the allocation of frequencies to the European cultural chain

The Supreme Council of the Audiovisual,
In light of the amended Act No. 86-1067 of 30 September 1986 on freedom of communication, in particular the second paragraph of Article 26 and its Articles 30-1 and 44;
Having regard to the Treaty of 2 October 1990 signed between France and the Länder of the Federal Republic of Germany concerning the Franco-German cultural chain;
In view of the contract concluded on 30 April 1991 between the European Company Television programmes (SEPT) and Deutschland TV GmbH for the formation of a European economic interest group;
Having regard to Decision 2001-387 of 24 July 2001 as amended on a call for applications for the publishing of services Digital terrestrial television broadcasting, and in particular its Annex IV;
In view of Decision No 92-575 of 23 June 1992, as amended and supplemented with the allocation of terrestrial radio frequencies for the dissemination of Programmes of the European cultural chain;
Considering that the deployment of terrestrial digital television requires the redevelopment of certain analogue frequencies, currently assigned to the European cultural chain, but of which Use is directly or indirectly incompatible with scheduled frequencies for digital terrestrial television;
After deliberation,
Decides:

Article 1


The use of the frequencies set out in the Annex to this Decision shall be attributed to the European Cultural Chain for Dissemination, from 19 hours to 3 hours, of its programs. The allocation of these frequencies is subject to the conditions set out in the attached Annex.
These frequencies replace those previously attributed to the European cultural chain by Decision No 92-575 of 23 June 1992, as amended and Completed above for the dissemination of its programme in the areas of Gourdon 1 (46), Hyères 2, Lalevade-d ' Ardèche, Toulon 2.
These substitutions will have to be made before 30 April 2006 for the site of Gourdon 1 (46) and before 30 September 2006 for the other sites.
These substitutions will not be made if alternative solutions to ensure continuity of service are in place after agreement between the Council and the European Cultural Chain.

Article 2


This Decision will be notified to the European Cultural Chain and published in the Official Journal of the Republic French.

Information communicated within two months after commissioning:
-technical description of the facility (type and Transmitter power rating, antenna system ...) ;
-maximum PAR and theoretical radiation diagram (H and V);
-date of commissioning;
-comprehensive reporting of offset realization, offset changes, channel changes, and other changes
Information communicated without delay if available:
-measured radiation chart.
This information is due upon express request from the board.
2. In the event that the information referred to in 1 is subsequently amended, the beneficiary shall communicate to the CSA an updated version within one
. The Recipient is also required to provide the CSA with all information in its possession on the coverage of the issuer, in particular, the results of the coverage measures performed in the service area.

If the CSA has found non-compliance with the technical requirements of the authorisation, the beneficiary shall be required to carry out a verification of the conformity of its installation with the requirements set out in the technical annex by a recognised organisation Of the authorization.
