DECISION
Decision No. 2003-706 of 16 December 2003 authorizing SARL Cannes Radio Broadcasting to operate a terrestrial radio broadcasting service in frequency modulation entitled Cannes Radio

The Conseil supérieur de l' audiovisuel,
In view of Act No. 86-1067 of 30 September 1986 on freedom of communication, in particular Articles 28, 29 and 29-1;
In view of Decree No. 87-239 of 6 April 1987, adopted for the application of Article 27 (1 °) of Act No. 86-1067 of 30 September 1986, concerning freedom of communication and fixing, for the private broadcasting services broadcast on Hertzian routes Ground or satellite, the regime applicable to advertising and sponsorship;
In light of Decree No. 89-632 of 7 September 1989 on the technical committees provided for in Article 29-1 of Act No. 86-1067 of 30 September 1986, as amended Freedom of communication;
Having regard to Decree No 94-972 of 9 November 1994 for the application of the 1 ° of Article 27 of Act No. 86-1067 of 30 September 1986 on freedom of communication and defining obligations relating to Access to local advertising and local sponsorship of authorised audio broadcasting services;
In the light of the decision of the National Commission on Communication and Freedoms 87-23 of 6 March 1987, as amended by the Council Decision 90-829 of 7 December 1990, defining the technical conditions for the use of frequencies for the broadcasting of radio signals in frequency modulation;
In view of Decision No 92-230 of 31 March 1992 fixing The rules of procedure of the radio technical committees and specifying the procedures for the exercise of the tasks conferred on them by Article 29 (1) of the Law of 30 September 1986 as amended;
Having regard to Decision No 2001-81 of 6 February 2001 A call for applications for the operation of terrestrial over-the-air radio broadcasting services in frequency modulation;
In view of Decision No. 2001-285 of 29 May 2001 on the list of candidates eligible to compete in the Framework for the call for applications within the jurisdiction of the Radio Technical Committee of Marseille;
In view of Decision No. 2002-839 of 17 December 2002 on the publication of the list of frequencies in the Official Journal of the French Republic of 19 January 2003;
In view of the opinions of the Radio Technical Committee of Marseille;
In view of the application for authorisation registered under the number 01MAB025 presented by the SARL Cannes Radio Diffusion;
In view of the agreement concluded between the Council Audiovisual superior and the SARL Cannes Radio Diffusion, in accordance with Article 28 of Law No. 86-1067 of 30 September 1986, as amended above;
Having regard to the opinion of the National Frequency Agency;
After having deliberated,
Decides:

Item 1


The above company is authorized to use the frequency set out in the Annex, in accordance with the Convention Above and in the schedule to this Decision, for the operation of a terrestrial over-the-air radio broadcasting service in frequency modulation called Cannes Radio.

Article 2


This authorization is issued for a period of five years from its date of publication in the Official Journal. The Conseil supérieur de l' Audiovisuel will be able to approve this authorization if the effective operation did not start one month after the date of publication of the authorization.

Article 3


1 ° The holder of this authorisation is required to communicate to the High Audiovisual Council the following information, which it attests Accuracy:
Information communicated within two months after commissioning:
-technical description of the installation (type and rated power of the transmitter, antenna system ...) ;
-maximum effective radiated power (PAR) and horizontal and vertical theoretical radiation diagram;
-date of commissioning.
Information provided without delay, if available:
-radiation diagram Measured;
-frequency excursion (statistical percentage of exceedance of 75 kHz over a minimum of 15 min).
This information is due at the express request of the board.
2 ° If the information mentioned in 1 ° is changed The holder shall, at a later date, communicate to the Council an updated version within one month.
3 ° The holder is also required to communicate to the Council all information in his possession on the cover of the issuer, in particular The results of the coverage measures carried out in the area of service.
4 ° If the Council finds that the technical requirements of this authorisation have not been complied with, the holder is required to have, by a recognised organisation, a Verification of the conformity of its installation with the requirements set out in the Technical Annex to the authorisation. It shall forward to the Board the results of this audit.

Article 4


This authorization is not transferable.

Article 5


Any use of a sub-carrier must be authorized by the Conseil supérieur de l' audiovisuel.

Article 6


This decision will be notified to SARL Cannes Radio Diffusion and published in the Official Journal of the French Republic.
