DECISION
Decision No. 2005-1108 of 6 December 2005 authorizing SARL Com 1-Concept to operate a Category B terrestrial radio service in frequency modulation entitled NRJ Guiana

The Conseil supérieur de l' audiovisuel,
In view of Act No. 86-1067 of 30 September 1986 on freedom of communication, in particular Articles 28, 29 and 29-3;
In view of Decree No. 87-239 of 6 April 1987, taken for the purposes of Article 27 (1) of Act No. 86-1067 of 30 September 1986, as amended above, relating to freedom of communication and fixing, for private broadcasting services broadcast by means of Terrestrial or satellite radio, the regime applicable to advertising and sponsorship;
Given Decree No. 89-632 of 7 September 1989 on technical committees;
In view of Decree No. 92-1047 of 23 September 1992 on propaganda and Advertising for alcoholic beverages by sound broadcasting;
Having regard to Decree No 94-972 of 9 November 1994 for the application of the 1 ° of Article 27 of Act No. 86-1067 of 30 September 1986 on the freedom of Communication and defining the obligations relating to access to local advertising and local sponsorship of authorised sound broadcasting services;
In the light of the decision of the National Commission on Communication and Freedoms 87-23 of the 6 March 1987, as amended by the decision of the Conseil supérieur de l' audiovisuel n ° 90-829 of 7 December 1990, defining the technical conditions for the use of frequencies for the broadcasting of radio signals in frequency modulation;
In view of the decision of the Conseil supérieur de l' audiovisuel n ° 92-230 of 31 March 1992 laying down the rules of procedure of the radio technical committees and specifying the procedures for the performance of the tasks conferred on them;
In view of the decision of the Council 2003-102 of 11 March 2003 on a call for applications for the operation of terrestrial terrestrial radio services in frequency modulation;
In view of the decision of the Conseil supérieur de l' audiovisuel n ° 2003-420 of 15 July 2003 on the list of candidates eligible to compete in the context of the call for applications under the jurisdiction of the Radio Technical Committee of the Antilles-Guyana;
In view of the decision of the Conseil supérieur de l' audiovisuel n ° 2003-672 of 2 December 2003 concerning the publication of the list of frequencies in the Official Journal of the French Republic of 3 January 2004;
Due to the application for authorisation by SARL Com 1-Concept;
In view of the opinions of the Committee Radio technique des Antilles-Guyane;
Vu l' avis du Conseil régional de la Guadeloupe;
Vu la convention entre le Conseil supérieur de l' audiovisuel et la SARL Com 1-Concept, pursuant to Article 28 of Law No. 86-1067 du 30 September 1986 as amended;
Due to the opinion of the National Frequency Agency;
After deliberation,
Decides:

Item 1


SARL Com 1-Concept is authorized to use the frequencies specified in the Annex, in accordance with the The aforementioned agreement and the annexes to this Decision, for the operation of a Category B radio service by terrestrial hertzian frequency modulation called NRJ Guyana.

Article 2


This authorization is issued for a period of five years from the date of publication in the Official Journal. The Conseil supérieur de l' Audiovisuel will be able to approve this authorization if the effective operation did not start one month after the date of publication of the authorization.

Article 3


1 ° The holder of this authorisation is required to provide the following information to the Senior Audiovisual Council: Accuracy:
Information communicated within two months after commissioning:
-technical description of the installation (type and rated power of the transmitter, antenna system ...) ;
-maximum effective radiated power (PAR) and horizontal and vertical theoretical radiation diagram;
-date of commissioning.
Information provided without delay if available:
-radiation diagram Measured;
-frequency excursion (statistical percentage of exceedance of 75 kHz over a minimum of 15 min).
This information is due at the express request of the board.
2 ° If the information mentioned in 1 ° is changed The holder shall, at a later date, communicate to the Council an updated version within one month.
3 ° The holder is also required to provide the Council with any information in his possession on the coverage of the issuer, in particular the Results of the coverage measures carried out in the service area.
4. If the Council finds that the technical requirements of this authorisation are not complied with, the holder is required to carry out, by an approved body, a Verification of the conformity of its installation with the requirements set out in the Technical Annex to the authorisation. It shall forward to the Board the results of this audit.

Article 4


This authorization is not transferable.

Article 5


Any use of a sub-carrier must be authorized by the Conseil supérieur de l' audiovisuel.

Article 6


This decision will be notified to SARL Com 1-Concept and published in the Official Journal of the French Republic.
