Stop:
In accordance with the Insurance Code, requests for recognition of the state of natural disaster were Examined for damage caused by land movements, floods and mudslides.
The municipalities subject to a finding of natural disaster are listed in Annex I, below, for risks and Specified periods.
The communes whose requests for recognition of the state of natural disaster are rejected are listed in Annex II below, for the risks and periods indicated.
The state of natural disaster established by decree may open the right to guarantee insured persons against the effects of natural disasters on property Subject to the insurance contracts referred to in the Insurance Code, where the resulting direct material damage has been the determining factor in the effect of that natural agent and the usual measures to be taken to prevent such damage Were unable to prevent their occurrence or could not be taken.
In addition, if the insured person is covered by a contract referred to in the Insurance Code, the state of natural disaster established may open the right to the aforementioned guarantee, under the conditions laid down To the corresponding insurance contract.
The applicable franchise is modulated based on the number of findings in the report Natural disaster for the same risk, in the five years preceding the date of signature of this Order, in municipalities that do not have a foreseeable natural risk prevention plan for risk Concerned.
For these municipalities, the number of findings is shown in parentheses in Appendix I. It takes into account not only the earlier findings of the same risk, except the findings of the 29 December 1999, but also this finding.
This Order will be published in the Official Gazette of the Republic French.
