ARRETE
Order of 15 December 2004 concerning the imposition of public service obligations relating to the air link between Agen and Paris

The Minister of Equipment, Transport, Spatial Planning, Tourism and the Sea,
In view of Council Regulation (EEC) No 2408/92 of 23 July 1992 Concerning the access of Community air carriers to intra-Community air routes, in particular the provisions of Article 4 (1) (a);
Given the Civil Aviation Code, and in particular Article R. 330-7;
On Joint union proposal for the departmental aerodrome,
Stop:

Article 1


Scheduled air services between the airport of Agen (La Garenne) and Paris (Orly) are subject to Public service obligations, the content of which is annexed to this Order.

Article 2


Without prejudice to Article 4 (1) (d) of the abovementioned Regulation, any carrier operating scheduled air services between the airport of Agen (La Garenne) and the Paris (Orly) airport shall do so in accordance with public service obligations in Vigor.

Article 3


The order of 20 August 2004 on the imposition of public service obligations relating to the air link Between Agen and Paris is repealed.

Article 4


The Director General of Civil Aviation shall be responsible for the execution of this Order, which shall Will be published in the Official Journal of the French Republic.

A N N E X E


Bonds Of public service imposed on scheduled air services between the airport of Agen (La Garenne) and Paris (Orly) are as follows:
In terms of minimum frequencies:
With the exception of four weeks in August and one week in December, the services must be operated, at least because of:
-three returns per day, Monday to Friday included, 225 days a year;
-one way and return on Sunday evening, 45 times a year.
Services must be Operated without an intermediate stop between Agen (La Garenne) and Paris (Orly).
In terms of the types of equipment used and the capacity available:
Services must be provided by means of a turbo-prop or turbojet pressurized device A minimum capacity of thirty seats.
In terms of schedules:
Hourly hours must allow passengers travelling on business grounds to go and return to the day at Agen Airport (La Garenne). With an amplitude of at least eight hours in Paris.
In terms of trade policy:
Flights must be marketed by at least one computer reservation system.
In terms of service continuity:
Except for force cases The number of flights cancelled for reasons directly attributable to the carrier shall not exceed, by IATA aviation season, 3 % of the number of scheduled flights. In addition, services may be discontinued by the carrier only after six months' notice.
Community carriers are informed that a breach of public service obligations may result in sanctions Administrative and/or jurisdictional.
