Decree of 22 December 2003 on the declaration of a vacancy in the position of lecturer at the University-Hospital-Practitioner for the mutation and recruitment for the year 2004 and fixing the Application procedures

The Minister of Youth, National Education and Research and the Minister of Health, Family and Disabled Persons,
In the light of Decree No. 84-131 of 24 February 1984 amended on the status of hospital practitioners;
In view of the amended Decree No. 84-135 of 24 February 1984 on the status of teaching and hospital staff in hospital and university centres, and in particular Title III thereof, Chapter II;
Having regard to Decree No. 86-10 of 3 January 1986 laying down the conditions for the cooperation of hospital and university staff;
In view of the amended decree of 23 May 1985 fixing the list of titles admitted as equivalent to the diploma Studies and research in human biology or doctoral studies in human biology for the purposes of Article 48 of Decree No. 84-135 of 24 February 1984;
In the light of the decision of 2 January 1986 laying down the conditions under which candidates of Foreign nationality may be allowed to take part in the competitions mentioned in Articles 48 and 61 of Decree No. 84-135 of 24 February 1984;
In the light of the decree of 17 September 1987 laying down the procedure for the recruitment of teachers of the University-hospital practitioners and conference masters of hospital-based medical practitioners;
In light of the December 30, 1992 Order, as amended, pursuant to Articles 48 (2 °), 61 and 62 (a) of Decree No. 84-135 of 24 February 1984, as amended The status of teaching staff and hospital staff in hospital and university centres;
In view of the amended decree of 26 January 1993 laying down the list of disciplines in which a practical pedagogical test is organised in Application of Article 52 of Decree No. 84-135 of 24 February 1984, amended on the status of teaching and hospital staff in hospital and university centres,

Item 1


University Hospital Senior Lecturer in the list attached to the present (Annex I) are declared vacant and may be filled under the conditions set out below.

  • TITLE Ier: MUTATION Item 2


    The conference masters of hospital-based university-practitioners who meet the condition of seniority provided for in Article 47 of Decree No. 84-135 of February 24, 1984, may request their transfer to the jobs listed In Annex I, under the conditions set out below.
    However, in accordance with Article 1 of the aforementioned Decree of 3 January 1986, employment with a cooperative assignment is not available for deployment.

    Article 3


    Within days of publication in the Official Journal of this Order, candidates for deployment Must address the Director of the Training and Medical Research Unit and the Director General of the University Hospital Centre:
    -a request for a transfer in accordance with the template given in Annex IV (downloadable on the Site: http://www.education.gouv.fr under "administrative forms");
    -a detailed curriculum vitae;
    -a list of their titles and works.
    Applicants shall, within the same time frame, send a copy of the letter of application and The curriculum vitae:
    -on the one hand, to the Ministry of Youth, National Education and Research, DPE B 12 (Office of Health Personnel), 61-65, rue Dutot, 75732 Paris Cedex 15;
    -on the other hand, to the Ministry of Health, of the Family and persons with disabilities (direction of hospitalization and organization of care, office M 2), 8, avenue de Ségur, 75350 Paris Cedex 07.

    Article 4


    At the expiration of the time limit set out in Article 3 of this Order, the following procedure shall be applied:
    For each job to be filled:
    -the Director General of the Hospital Centre University shall immediately submit the application (s) received to the Medical Establishment Commission, which shall meet in limited training limited to inpatient-university staff performing duties at least equivalent to those To which the person concerned applies;
    -the Director of the Training and Medical Research Unit shall immediately take the advice of the unit which meets in limited training to teachers at least equal to that of the master of Conferences.
    These two bodies have a period of twenty-one days to make their opinions known by taking, in the case of multiple applications, a ranking of the candidates who have received a favourable opinion.

    Article 5


    The submitted opinions are attached to the applications and addressed within six weeks of the date of the Publication in the Official Journal of this Order, by the Director of the Training and Medical Research Unit at the Ministry of Youth, National Education and Research and by the Director General of the University Hospital Centre Ministry of Health, Family and Disabled Persons.

  • TITLE II: RECRUITMENT CONCURRENT Item 6


    Persons of French nationality and nationals of the European Union or other States party to the Agreement on the European Economic Area may apply to the competitions for the recruitment of masters of Conferences of hospital-based practitioners under the following conditions defined by type of competition.
    These conditions, with the exception of the age-specific condition, are appreciated by the deadline for submission of applications. Article 7 below.


    A. -Type 1 competition organised pursuant to Article 48 (1) of Decree No 84-135 of 24 February 1984 (see Annex II)
    Applications may be considered:
    I.-In clinical disciplines:
    Clinical Heads of the University assistants and former clinical heads of hospitals-hospital assistants, aged under forty-five to January 1 of the year of the competition.
    II. -In biological and mixed disciplines:
    University hospital assistants and former university hospital assistants, who are under forty-five years of age on January 1 of the year of the competition.
    III. -Across all disciplines:
    University hospital practitioners and hospital practitioners.
    These candidates must have at least one year of effective performance in either of these qualifications. One of the following degrees:
    -degree of study and research in human biology;
    -PhD of state in human biology;
    -research authority;
    -comprehensive study diploma; and
    -PhD expected by the Act of January 26, 1984;
    -doctoral graduate;
    -PhD of State of Science;
    -PhD of State of Pharmaceutical Sciences;
    -PhD of State in odontology;
    -degree of Doctor of Engineering;
    -degree of study And research in odontological sciences;
    -foreign degrees and titles that allow access to the teaching-researcher functions of the same rank in the higher education institutions of the country in which they are issued. Candidates will be required to provide to this effect a certificate from the embassy of the country under consideration in France that expressly certifies that the diploma or title obtained in that country by the person concerned provides access to the functions of the teacher-researcher of the same rank In the country's higher education institutions.
    B.-Type 2 competition organised pursuant to Article 48 (2 °) of Decree No 84-135 of 24 February 1984 (see Annex II)
    Nominee:
    Candidates who do not Do not meet the conditions set out in A above and hold one of the following degrees:
    -enabling research;
    -doctorate of state;
    -doctorate provided for in Decree No. 84-573 of 5 July 1984;
    - Doctoral degree;
    -degree-diploma in engineering;
    -foreign degrees and diplomas that provide access to teaching-researcher functions of the same rank in the higher education institutions of the country in which they are Issued. Candidates must provide to this effect a certificate from the embassy of the country under consideration in France that expressly certifies that the diploma or title obtained in that country by the person concerned provides access to the functions of a teaching-scientist of the same rank Those entrusted to the lecturers of the university-medical practitioners in the higher education institutions of the country concerned.

    Article 7


    The Candidator File shall be sent, preferably in the form of a simple registered mail (without notice of receipt), no later than January 21, 2004, at midnight (the postmark), to the addressee hereinafter referred to in Function of the competition discipline:
    -for the biological and mixed disciplines listed on list A (Annex III), to the Ministry of Youth, National Education and Research (Office of the Organisation for the Recruitment of Staff of higher education, DPE A 10), 110, rue de Grenelle, 75357 Paris 07 SP;
    -for the clinical disciplines listed in List B (Annex III), to the Ministry of Health, Family and Disabled Persons (direction of L' hospitalisation et de l' organisation des soins, bureau des competitions HRI, M 4), 8, avenue de Ségur, 75350 Paris Cedex 07.

    The application package must include the following documents:
    (a) A duplicate application form set out in the model of Annex V;
    (b) A photocopy of the national identity card or, failing that, A certificate of nationality;
    (c) A photocopy of the diplomas (for foreign degrees and diplomas: a certificate from the embassy of the country under consideration in France);
    (d) An administrative certificate showing the duration of the duties Required to appear under section 48 (1 °) (type 1 competition), copy of appointment orders;
    e) For candidates who wish to be enrolled in a hospital discipline other than university discipline, a A free paper application specifying the heading of the academic and hospital disciplines considered (the academic discipline being that indicated on the nomination paper) and tending to have this hospital discipline In the case of their names in the event of entry on the list of admission referred to in Article 52 of Decree No 84-135 of 24 February 1984; only candidates registered in the relevant hospital discipline will be able to apply for jobs Referring to this discipline in hospital;
    f) A detailed curriculum vitae;
    (g) Two envelopes of format 162 x 229 mm, written at the address of the candidate and cleared at the rate in effect;
    (h) For those seeking A reduction or waiver of age limit, an application based on the model of Annex VI and any document enabling the application to be assessed.
    Only files with all required parts will be reviewed.

    Article 9


    For the purposes of Articles 48 and 50 of Decree No. 84-135 of 24 February 1984, the date of commencement of the tests shall be 7 April 2004.
    The Candidates, in a discipline of which at least one job has been filled by deployment, are notified by individual letter either of the decrease in the number of jobs offered or of the elimination of the competition if all the jobs offered were Provided by way of transfer. In the latter case, the application is automatically cancelled.
    Candidates who wish to withdraw may do so before the date fixed for the start of the tests, exclusively by registered letter to the office that registered Their registration.

    Article 10


    The list of candidates allowed to compete is agreed upon by the Minister of Health, Family and persons with disabilities and the Minister of Youth, National Education and Research.

    Item 11


    Candidates who are allowed to compete are required to send directly, on a date and at the addresses indicated to them:
    1 ° To all the members of the competent jury:
    a) A statement of their titles and works;
    b) The case A copy of the application referred to in Article 8, above;
    2 ° To the chairman of the competent jury and to the rapporteurs, in addition to the document referred to above:
    (a) A copy of the certificates, diplomas and certificates deposited in the Registration;
    b) At their choice, all or part of their books and abstracts from their publications.

  • TITLE III: FOREIGN CANDIDATES Article 12


    Persons of foreign nationality fulfilling the conditions laid down in Article 1 (paragraphs 2 and 3) of the decree of 2 January 1986 may apply in The award of the title of lecturer at the University-Medical Practitioner University in a foreign capacity.

    Item 13


    For All disciplines, the files must be addressed by the departmental department responsible for relations between the French Republic and the country concerned, no later than 21 January 2004, at midnight (postmark), to the Ministry De la santé, de la famille et des personnes handicapées (Direction de l' hospitalisation et de l' organisation des soins, bureau des competitions HRI, M 4), 8, avenue de Ségur, 75350 Paris Cedex 07.

    a) An individual registration notice, duly completed, with a reasoned opinion from the local authorities responsible for the teaching activities, also relating to the quality of the titles and The applicant's work and the prospects for his professional future in his country of origin;
    b) A certified copy of the diplomas referred to in Article 1 of the decree of 2 January 1986;
    (c) One Certification for three years of teaching activities related to the preparation of a doctor's degree;
    d) A detailed curriculum vitae.
    Only folders with all required parts will be the object of a Examination.
    Any document in foreign language must be translated into French.

    Article 14


    The provisions of Articles 9, 10 and 11 Are applicable to candidates in a foreign capacity.

    Article 15


    The Director of Teachers and the Director of The hospital and the organisation of care shall each be responsible for the execution of this Decree, which shall be published as well as its annexes in the Official Journal of the French Republic.
