ARRETE
Order of 18 December 2002 designating the representative of the Minister for Agriculture, Food, Fisheries and Rural Affairs pursuant to Article 746 of the Rural Code

The Minister of Agriculture, Food, Fisheries and Rural Affairs,
Given the Rural Code, and in particular its amended Article 746;
Law No. 88-50 of 18 January 1988 on the mutualisation of the National Farm Credit Fund, in particular Article 16 (IX and X);
In view of Decree No. 47-233 of 23 January 1947, as last amended by Decree No. 87-390 of 15 June 1987, authorising the Ministers to delegate, by order, their signature;
In view of Decree No. 99-555 of 2 July 1999 fixing the organisation of the central administration of the Ministry of Agriculture and Fisheries;
Having regard to the Order of 2 July 1999 on the organisation and Responsibilities of the Financial Affairs Directorate,

Item 1


The Director of Financial Affairs is designated as the representative of the Minister of Agriculture, Food, fishing and rural affairs:
-to sign on behalf of the State and to set up in minute the acts of release of mortgage entries taken as collateral for loans granted by Crédit Agricole SA and the Mutual fund commitments for regional credit unions of mutual agricultural credit, initially taken under administrative acts;
-to sign renewal slips for mortgage registrations Initially for the benefit of the State and, in general, to sign, if necessary, any document relating to the conservation and enforcement of the rights attaching to all the registration of mortgages taken on behalf of the State as security for loans granted By Crédit Agricole SA and the commitments of the mutual fund guarantee fund of the regional agricultural credit unions.

Item 2


In Case of absence or incapacity of the Director of Financial Affairs, delegation shall be given to the Assistant Director of Financial Affairs.

Item 3


In case of absence or incapacity of the Director of Financial Affairs and the Assistant Director of Financial Affairs, delegation is given to the Deputy Director of Agricultural Financing.

Article 4


In case of absence or incapacity of the Director of Financial Affairs, the Assistant Director of Financial Affairs and the Deputy Director Agriculture, delegation is given to the head of the credit bureau.

Article 5


The acts prepared by the representative of the Minister of Agriculture, Food, Fishing and Rural Affairs under this Order shall be retained by Crédit Agricole SA. All binding copies and shipments may be issued by the same representative on behalf of the Minister of Agriculture, Food, Fisheries and Rural Affairs.

Article 6


This Order will be published in the Official Journal of the French Republic.
