Summary

Amendment of the provisions of s. D. 242-8 (from art. 3 of Decree 88-772 of 22 June 1988) as they impose a contribution of 1 % on pensions other than that of the general scheme of which nationals of the Member States of the European Union who do not have their tax residence are held in France and not under a French health insurance plan within the 6-month time limit. In order to preserve equal treatment between nationals and non-Community nationals, this Decree aims to exclude from the scope of the levy of 1 % all persons who reside fiscally outside France and who are not Charge, for any reason, of a compulsory French health insurance scheme. Similarly, this Order amends s. D. 711-3 (from art. 2 of Decree 91-613 of 29 June 1991) concerning special schemes to the extent that it is subject to the same claims as s. D. 242-8.

On the report of the Minister of Social Affairs, Labour and Solidarity and the Minister of Health, Family and People with Disabilities,
Having regard to the Social Security Code, in particular Articles L. 241-2, L. 711-2, D. 242-8 and D. 711-3;
In view of the opinion of the Management Board of the Central Agency of Social Security Bodies dated 29 November 2002;
In view of the opinion of the Board of Directors of the National Health Insurance Fund for Employed Workers as of November 26, 2002,

In the first paragraph of Article D. 242-8 of the Social Security Code, after the words: "shall be set to 1 %", the words "shall be added:" for persons fulfilling the conditions laid down in Article L. 136-1 ".
