An implementing Decree No. 2002 - 1613 of 31 December 2002 relating to the entry into force of decrees and orders abstract the present decree aims to raise the minimum pension amounts, of the minimum pension reversion and consequently of the allowance for disabled adults. The terms of revalorisation of minimum pension are fixed by any text. They are the subject of a decree on the upgrading of various benefits of old age and disability and the additional allocation referred to in art. L. 815-2 and L. 815 - 3 of the above-mentioned code, taken every year at the same time as the Decree of revaluation of pension insurance. It is proposed to upgrade, as of January 1, 2003, the amount of the minimum pension and the minimum surviving spouse's pension of 1.5%. This rate, identical to that used for contributory pensions in the Bill for funding for 2003, to preserve the purchasing power of retirees. The result is an identical increase in allowance for adults with disabilities in accordance with the provisions of art. D. 821-3 (para. 1) of the code.

(2) the amount of the minimum pension to old-age pension under article L. 350 of the former code of social security and article 13 of Ordinance No. 45-170 of 2 February 1945 changed organizing new basis allowances for old employees and changing the system of pensions for old age and disability insurance;
(3) the amount of the minimum pension of invalidity provided for in article 10 of the Decree of 28 October 1935 amended amending the system of social insurance and articles L. 341 - 5 and L. 357 - 8 of the code of social security;
(4) the amount of the minimum pension for the surviving spouse provided for in articles L. 342 - 4 and L. 357 - 11 of the code of social security;
(5) the amount of the allowance or pension old age pension paid to insured persons and surviving spouses by the organizations referred to in article L. 621 - 3 of the code of social security, the amount of the allowance to the old self-employed and lifetime relief provided for in sections D. 812 - 2 to D. 812 - 8 as well as the amount of the special allowance referred to in article L.814 - 1 of the code;
(6) the amount of pension laid, with an effective date prior to April 1, 1983, to the minimum base amount provided for in articles L. 345 and L. 379 of the former code of social security;
(7) the pension of the beneficiaries of the provisions of the Decree of March 14, 1984, referred to above.

The minimum amount of the pension for the surviving spouse provided for in articles L. 353 - 1 and L. 357 - 10 of the code of social security is 2 886,53 EUR per year beginning January 1, 2003.

The maximum amount of the additional allowance provided for in articles L. 815 - 2 and L. 815 - 3 of the code of social security is fixed: has) for individuals, to 4 EUR 085,23 per year as of 1 January 2003;
(b) for married couples, to 6 741,19 EUR per year as of January 1, 2003.

For the purposes of title I of Book VIII of the code of social security, annual limits provided for in articles L. 811 - 13, L. 814 - 1 and L. 815 - 8 of the code are fixed at 7 102,71 EUR for a single person and to EUR 12 440,87 for both spouses from January 1, 2003.

Notwithstanding the provisions of the first two paragraphs of article L. 815 - 10 of the code of social security, agencies and services are allowed to carry, provisionally, the total amount of the benefits served by them to recipients of the supplement to the annual amount of 6 935,07 EUR for a single person and of EUR 12 440,87 for both spouses as of January 1, 2003.
This option ends revision benefits of old age which are licensed. She can in no way be exercised beyond January 1, 2004 regarding the revaluation took place on January 1, 2003.
The provisions of this article shall not apply to holders of several old age benefits served by different services or organizations.
