In view of the opinion of the Board of Directors of the National Pension Fund for Employed Employees as of the date of 18 December 2002;
In view of the opinion of the Board of the National Fund for Health Insurance of Workers' Compensation dated 17 December 2002;
In view of the advice of the Board of Directors of the National Fund for the Autonomous Organization Old-age insurance for industrial and commercial professions as of 20 December 2002;
In view of the opinion of the board of directors of the National Autonomous Fund for the Clearing of Home-made Old Age Insurance as of 20 December 2002,
Describes:
The amount of EUR 2 849.84 per year from 1 January 2003 is:
1 ° The amount of the allowance for old employees, the allowance for mothers or mothers mentioned under the heading Ier Book VIII of the Code of Social Security;
2 ° The amount of the minimum old-age pension provided for in Article L. 350 of the former Code of Social Security and Article 13 of Order No. 45-170 of 2 February 1945, as amended by The amount of the minimum invalidity pension provided for in Article 10 of the Decree of 28 shall be provided for in the case of old-age pension and social insurance invalidity pension
. October 1935 amended amending the social insurance scheme and Articles L. 341-5 and L. 357-8 of the Social Security Code;
4 ° The amount of the minimum pension allocated to the surviving spouse provided for in Articles L. 342-4 and L. 357-11 of the Social Security Code;
5 ° The minimum amount of the old-age allowance or retirement allowance paid to insured persons and surviving spouses by the organisations referred to in Article L. 621-3 of the Social Security Code, the The amount of the old-age allowance and the life assistance provided for in Articles D. 812-2 to D. 812-8 and the amount of the special allowance provided for in Article L. 814-1 of the said code;
6 ° The amount of old-age pensions With a date of effect prior to 1 April 1983, at the basic minimum amount provided for in Articles L. 345 and L. 379 of the former Social Security Code;
7 ° The amount of the beneficiaries' pensions of the provisions of the Decree of 14 March 1984 above.
The minimum amount of the pension allocated to the surviving spouse provided for in Articles L. 353-1 and L. 357-10 of the Social Security Code is increased to EUR 2 886.53 per year as from 1 January 2003.
The maximum amount of the additional allowance provided for in Articles L. 815-2 and L. 815-3 of the Social Security Code is fixed:
(a) For single persons, at EUR 4 085.23 per year as from 1 January 2003;
b) For married couples, at EUR 6 741.19 per year from 1 January 2003.
For the application of Title I of Book VIII of the Social Security Code, the annual limit amounts provided for in Articles L. 811-13, L. 814-1 and L. 815-8 of that code shall be fixed at EUR 7 102.71 for a person Only EUR 12 440.87 for two spouses as from 1 January 2003.
Notwithstanding the provisions of the first two paragraphs of Article L. 815-10 of the Social Security Code, organizations and services shall be authorized to carry the full amount of the benefits Provided by them to beneficiaries of the additional allocation to the annual amount of EUR 6 935.07 for a single person and EUR 12 440.87 for two spouses from 1 January 2003.
This option ends when you review the benefits Of the old age of interest. In no case shall it be exercised beyond 1 January 2004 in respect of the recovery which occurred on 1 January 2003.
The provisions of this Article shall not apply to holders of several old-age benefits Served by different agencies or services.
The Minister of Social Affairs, Labour and Solidarity, the Minister of Economy, Finance and Industry, the Minister of Health, Family and Disability, the Minister of Agriculture, food, fishing and rural affairs and the Minister responsible for the budget and budgetary reform shall each have responsibility for the implementation of this Decree, which shall be published in the Official Journal of the French Republic.
