Decree of 24 December 2015 specifying the conditions of free access to railway or guided transport vehicles of the national police and gendarmerie services or units responsible for securing public passenger transport

The Minister of the Interior,
Vu le Transport codeincluding article L. 2241-1-1;
Vu le Code of Criminal Procedureincluding articles R. 15-30, R. 15-32 and R. 15-33;
Vu la Act No. 2009-971 of 3 August 2009 relating to the national gendarmerie;
Vu le Decree No. 2003-932 of 1 October 2003 establishing a decented police service responsible for the security of persons and goods on the rail passenger transit networks in the Ile-de-France region and amending the Code of Criminal Procedure ;
Vu le Decree No. 2006-186 of 15 February 2006 taken for application ofArticle 1 of Decree No. 2005-1664 of 28 December 2005 on the establishment of interdepartmental police services responsible for the security of persons and goods on public passenger transport networks and amending Code of Criminal Procedure ;
Vu le Decree No. 2015-1759 of 24 December 2015 relating to access to railway or guided transport vehicles of national police officers and national gendarmerie personnel in the exercise of their security missions for persons and goods in the public transport of passengers by rail or guided;
In view of the decision of 1 February 2011 on the missions and organization of the Central Directorate of the Border Police, including Articles 3 and 8,

In the conditions fixed by thearticle 1 of Decree No. 2015-1759 of 24 December 2015 referred to above, are provided with free access to railway vehicles or guided by the following services and units:


- the National Railway Police Service;
- the zonal brigades of the railways of the zonal branches of the police at the border;
- the regional sub-direction of the transport police of the Paris police prefecture;
- interdepartmental public transport security services;
- the public transport security units of the departmental branches of public security;
- the basic units of the national gendarmerie on a mission to secure railway or guided transport.

The function certificate provided forarticle 1 of Decree No. 2015-1759 of 24 December 2015 referred to above is issued by the chief of service. It includes:


- the service or unit responsible for the security of public passenger transport in which the agent is assigned;
- the geographic area in which the attestation is valid;
- the date on which the certificate ceases to be valid;
- identifiable security elements.

The Director General of the National Police, the Police Commissioner of Paris and the Director General of the National Gendarmerie are responsible, each with regard to him, for the execution of this Order, which will be published in the Official Journal of the French Republic.
