Notice: This decree updates and simplifies the technical conditions of operation of private institutions authorized to carry out the activity of psychiatry care, in order to take into account developments in the organization of the health system and the diversification of the therapeutic care. In accordance with the new rules, these institutions will be required to ensure the adequacy of the conditions of patient reception and care with the nature of their activity and the requirements of quality and safety of care.

The Prime Minister,
On the report of the Minister of Social Affairs, Health and Women ' s Rights,
Vu le Public Health Codeincluding article L. 6124-1;
Considering the opinion of the High Council of Paramedical Professions of 29 June 2015;
Considering the opinion of the National Committee of the Health and Social Organization dated 6 July 2015,
Decrete:
Sub-section 7 of chapter IV, section 4, title II, of Book I of Part VI of the Public Health Code is replaced by the following:
"Subsection 7
"Private health institutions" authorized to carry out the activity of psychiatry care
"Art. O.C. 6124-463.-The general organization, equipment and premises of private health facilities authorized to carry out the activity of psychiatry care are adapted to the nature and volume of the care provided by the medical project referred to in Article D. 6161-4.
"Art. D. 6124-464.-The number and specialty or qualification of medical personnel, medical assistants, social workers within the meaning of code of social action and families, as well as all other staff of the facility are adapted to the health needs of the patients receiving, the technical characteristics of the care provided and the volume of activity.
"Art. O.C. 6124-465.-A nurse is permanently present in the establishment, subject to, where applicable, periods during which, pursuant to the medical project referred to in D. 6161-4, no patient is present in the hospitalization units.
"Art. D. 6124-466.-Any private health institution authorized to carry out the psychiatric care activity organizes access to the somatic care of the persons in charge, both as an outpatient and in hospital, especially in the event of an emergency. It may conclude a convention with health facilities that are capable of providing the necessary care.
"Art. D. 6124-467.- Physicians involved in the psychiatric treatment of patients are qualified psychiatry specialists.
"Art. D. 6124-468.-A qualified psychiatry specialist is permanently in the facility.
"By derogation from the previous paragraph and from the full-time hospitalization activity, the establishment may, in accordance with the medical project mentioned in article D. 6161-4, organize this permanence in the form of a stay, provided that the arrival time on the site of the qualified psychiatry specialist is compatible with the security imperative.
"Art. D. 6124-469.-An operating charter defines the organization of continuity of care within the health care institution, including the modalities for the implementation of the permanence defined in sections D. 6124-465 and D. 6124-468.
"The draft charter, prepared by the director of establishment, is subject to the prior notice of the commission of relations with users and the quality of care.
"The charter is amended by the director of the institution, following the advice of the user relations commission and the quality of the care, to take into account, where appropriate, the evolution of the nature or volume of the care provided by the health care establishment. »
The Minister of Social Affairs, Health and Women's Rights is responsible for the execution of this decree, which will be published in the Official Journal of the French Republic.
