President of the Republic,
On the report of the Prime Minister and the Minister for Foreign Affairs and International Development,
Considering the Constitution, in particular articles 52 to 55;
Vu la Act No. 2015-359 of 30 March 2015 authorizing the approval of the fifth party to the 19 January 1967 Convention, as amended by the 6 July 1971 Advant between the Government of the French Republic and the Government of the Federal Republic of Germany on the construction and operation of a very high-flow reactor and subsequently amended by the 19 July 1974 Agreement between the two above-mentioned Governments and the Government of the United Kingdom of Great Britain and Northern Ireland on the accession of the latter Government to the convention and by the advent of 27 July 1976, the second coming of 9 December 1981, the third coming of 25 March 1993 and the fourth coming of 4 December 2002 between the three above-mentioned Governments;
Vu le Decree No. 53-192 of 14 March 1953 amended on the ratification and publication of international commitments undertaken by France;
Vu le Decree No. 67-524 of 17 June 1967 publishing the 19 January 1967 agreement between the Government of the French Republic and the Government of the Federal Republic of Germany on the construction and operation of a very high-flow reactor;
Vu le Decree No. 2012-1228 of 2 November 2012 issuing the fourth amendment to the 19 January 1967 Convention, as amended by the 6 July 1971 Agreement between the Government of the French Republic and the Government of the Federal Republic of Germany on the construction and operation of a very high-flow reactor and subsequently amended by the 19 July 1974 Agreement between the two above-mentioned Governments and the Government of the United Kingdom of Great Britain and Northern Ireland on the accession of the latter Government to the convention and by the advent of 27 July 1976, the second coming of 9 December 1981 and the third coming of 25 March 1993 between the three above-mentioned Governments, signed in Paris on 4 December 2002,
Decrete:

Article 1


The fifth came to the 19 January 1967 convention, amended by the 6 July 1971 advent of the Government of the French Republic and the Government of the Federal Republic of Germany on the construction and operation of a very high-flow reactor and subsequently amended by the 19 July 1974 agreement between the two above-mentioned Governments and the Government of the United Kingdom of Great Britain and Northern Ireland on the accession of the latter. Government to the convention and by the advent of 27 July 1976, the second coming of 9 December 1981, the third coming of 25 March 1993 and the fourth coming of 4 December 2002 between the three above-mentioned Governments, signed in Paris on 1 July 2013, will be published in the Official Journal of the French Republic.

Article 2


The Prime Minister and the Minister for Foreign Affairs and International Development are responsible, each with respect to him, for the execution of this decree, which will be published in the Official Journal of the French Republic.

    FIFTH FUTURE
    THE CONVENTION OF 19 JANUARY 1967, ADDRESSED TO THE PRESIDENT OF THE SECURITY COUNCIL ADVENANT OF 27 JULY 1976, THE SECOND EVENANT OF 9 DECEMBER 1981, THE THIRD EVENANT OF 25 MARCH 1993 AND THE FOURTH EVENANT OF 4 DECEMBER 2002 TO THE THIRD GOVERNMENTS SUBMITTED, SIGNED TO PARIS on 1 JULY 2013


    The Government of the French Republic, the Government of the Federal Republic of Germany and the Government of the United Kingdom of Great Britain and Northern Ireland,
    Considering their successful forty-year collaboration at the Laue-Langevin Institute (ILL) and their desire to maintain their mutual commitment to European collaboration in the neutronic sciences,
    Considering their desire to maintain for the years to come the unchanged position of world leader of this research reactor because of its performance in the neutron sciences,
    Considering the growing interest of the European neutronic community, in particular in the life sciences, to have access to a reactor at the highest available flux currently in the world allowing unique experiments,
    For the continuation of their collaboration,
    The following agreed:


    Article 1


    Paragraph 1 of Article 2 of the Convention of 19 January 1967, as amended by Article 1 of the coming of 6 July 1971, Article 3 (b) of the Convention of 19 July 1974, Article 1, paragraph 1, of the coming of 27 July 1976 and Article 1, paragraph 1, of the Second coming of 9 December 1981, is replaced by the following provision:
    1. The Government of the French Republic, the Government of the Federal Republic of Germany and the Government of the United Kingdom ensure that an annual grant is made available to the French, German and British Associates, respectively, as part of the appropriations in the budgets of the French Republic, the Federal Republic of Germany and the United Kingdom. These annual grants are intended to cover the Institute's expenditures. These expenses are set unanimously each year by the Institute's Management Committee and the Associates as part of a medium-term financial plan.
    The Institute's expenditures related to the dismantling and management of radioactive waste are determined and fully funded by the above-mentioned Governments on the basis of their participation as defined in paragraph 2 of this article and in accordance with French legislation and enforcement measures.


    Article 2


    Paragraph 2 of Article 7 of the Convention of 19 January 1967, as amended by Article 6 of the Convention of 19 July 1974, Article 1, paragraph 2, of the Second As of 9 December 1981, Article 1 of the Third As of 25 March 1993 and Article 1 of the Fourth As of 4 December 2002, is replaced by the following provisions:
    1. The Convention will remain in force until 31 December 2023. From that date on, it will be re-entered from year to year unless one of the Governments notify the other Governments in writing of its intention to withdraw from the Convention. Such withdrawal shall take effect upon the expiration of two years from the date of receipt of the notification by the last of the other Governments or at a later date specified in notification 2. The withdrawal of the Convention does not affect the rights or obligations arising from its implementation prior to its withdrawal. In the period preceding the effective date of the withdrawal of a Government, the three Governments shall jointly determine the terms and conditions for the performance of all financial commitments relating to the dismantling and management of radioactive waste by the Government having notified its intention to withdraw from the Convention, in accordance with the provisions of paragraph 1 of this Article.


    Article 3


    Each Government shall notify the other Governments of the fulfilment of the constitutional procedures required for the entry into force of this Agreement of 19 January 1967, which takes effect on the first day of the second month following the day on which the last notification was received.
    Done in Paris on 1 July 2013, in three copies, in French, German and English, the three texts being equally authentic.
