Decree No. 2015-1215 of 1 October 2015 on the publication of the cooperation agreement in the field of transport between the Government of the French Republic and the Government of the State of Kuwait, signed in Paris on 18 February 2014 (1)

President of the Republic,
On the report of the Prime Minister and the Minister for Foreign Affairs and International Development,
Considering the Constitution, in particular articles 52 to 55;
Vu le Decree No. 53-192 of 14 March 1953 amended on the ratification and publication of international commitments undertaken by France,
Decrete:

Article 1


The cooperation agreement in the field of transport between the Government of the French Republic and the Government of the State of Kuwait, signed in Paris on 18 February 2014, will be published in the Official Journal of the French Republic.

Article 2


The Prime Minister and the Minister for Foreign Affairs and International Development are responsible, each with respect to him, for the execution of this decree, which will be published in the Official Journal of the French Republic.

    CONVENTION
    COOPERATION IN THE FIELD OF TRANSPORT AGAINST THE GOVERNMENT OF THE FRENCH REPUBLIC AND GOVERNMENT OF KUWAIT, SIGNED TO PARIS on 18 FEBRUARY 2014


    The Government of the French Republic and
    The Government of the State of Kuwait,
    The following are the "Parties",
    Recognizing that cooperation in the field of transport is an essential element in the development of the bilateral relationship between France and Kuwait;
    Desirous of promoting bilateral cooperation in the areas of land transport (road, urban and road), maritime and port transport;
    Consistent with the following provisions:


    Article 1
    Identification of cooperation themes


    The following actions may be taken:
    1. Cooperation in the areas of land transport (ferroviary, urban and road), maritime and port transport. Such actions may cover institutional, legal, economic and technical aspects.
    2. Support and technical assistance actions through an exchange of know-how, expertise and training. They may include the provision of advice in public transport projects, particularly with regard to the establishment of road and transport authority.


    Article 2
    Implementation of cooperation projects


    To facilitate the implementation of this Convention and its follow-up, Parties shall establish a bilateral coordination committee.
    The Kuwaiti president in the bilateral coordination committee is the State Secretary of the Ministry of Communications or his representative. The French president in the committee is the French ambassador to the State of Kuwait or his representative. The bilateral coordination committee is composed of specialists from both countries.
    The bilateral coordination committee meets once a year, or as often as necessary, with the agreement of the two chairs.
    Cooperation in the areas referred to in Article 1 may be implemented through exchanges between experts, the organization of seminars, short-term training, field visits and any other form of partnership approved by the Parties.


    Article 3
    Monitoring and evaluation of cooperation activities


    1. The bilateral coordination committee has the following responsibilities:
    a. To identify means of action that are implemented to achieve the objectives of this Convention, as defined in Article 1;
    b. Monitoring the performance of this Convention;
    c. To agree on the implementation of any other activities that the bilateral coordination committee considers necessary to improve cooperation under this Convention;
    d. Review and propose amendments to this Convention, in a spirit of broad consultation and with the aim of developing it.
    2. The bilateral coordination committee may meet with any person that it considers useful in the application of this agreement.


    Article 4
    Financing


    The requesting Party for cooperation in one of the areas referred to in this Convention shall bear all costs associated with that request. With respect to the French party, these costs may not exceed, by their amount and nature, the expenditures related to the current operation normally incurred by the administrations concerned within the framework of their usual competence.


    Article 5
    Confidentiality


    The Parties agree that the information exchanged and the techniques developed under this Convention shall be confidential and shall not be disclosed to a third party without the explicit consent of the other Party.


    Article 6
    Other provisions


    Any dispute arising out of the interpretation and/or application of the provisions of this Agreement shall be settled by diplomatic consultations or negotiations.


    Article 7
    Entry into force


    1. This Agreement shall enter into force on the date on which each Party has notified the other of all procedures necessary for its entry into force in that country.
    2. This Agreement shall remain in force for a period of three (3) years from the date of its entry into force and shall be renewed automatically for the same period. Each Party may denounce it at any time by written notification to the other through diplomatic channels. This denunciation takes effect six months after its notification date.
    3. This Agreement may be amended by mutual agreement between the two Parties. These amendments come into force as described in subsection (1) of this section.
    4. The termination of this Agreement does not affect the activities already established under this Convention.
    Done in Paris on 18 February 2014, in two original copies, each in French and Arabic, both texts being equally authentic.
