Order of September 7, 2015 amending the Order of December 19, 2013 concerning the fight against golden flavescence of the vine and its vector agent

Minister of Agriculture, Agri-Food and Forestry, Government Spokesperson,
In light of Council Directive 2000/29/EC of 8 May 2000 on measures to protect against the introduction in the Community of pests to plants or plant products and their spread within the Community;
Vu le Rural Code and Maritime Fishingincluding the title V of Book II;
Having regard to the amended decision of 31 July 2000 establishing a list of plant pests, plant products and other objects subject to mandatory control measures;
Considering the decision of 9 July 2003 concerning the fight against golden flavescence of the vine and its vector;
Considering the amended decision of May 24, 2006 on the health requirements of plants, plant products and other objects;
In view of the decree of 20 September 2006 concerning the selection, production, circulation and distribution of vegetative reproduction materials of the vine;
Considering the decree of 19 December 2013 concerning the fight against the golden flavescence of the vine and its vector agent,

Section 15 of the above-mentioned Order of 19 December 2013 is replaced by the following text:


"Art. 15.-1. In the vineyards and vineyards of vineyards or grapevines, the fight against the vector of golden flavescence is mandatory throughout the country. It is carried out by means of phytopharmaceutical products authorized to market against this insect with sufficient remanence, the list of which is established by the general management of the food. The number of applications is three in the production campaign for the mother-of-pearl vines or grafts. Treatment dates are broadcast by the regional food, agriculture and forest management. For wine nurseries, the number of applications is such that it allows to cover the entire period of presence of the vector in view of the product's remanence.
2. In derogation from paragraph 1, for parcels of grafting mother vines located outside the control area, insecticide treatments referred to in paragraph 1 may be replaced under the control of the regional plant protection services or their delegates by a hot water treatment of multiplication equipment. Requests for exemptions should be made from the Regional Food, Agriculture and Forestry Directorate by March 31 of each year.
3. In derogation from paragraph 1, for parcels of grafting mother vines located in the control areas, insecticide treatment referred to in paragraph 1 may be carried out under the control of the regional plant protection services or their delegates by means of phytopharmaceutical products authorized to market against that insect and not listed in paragraph 1. These treatments are then made using three applications of these products during the production campaign, and the multiplication material is subjected to hot water treatment. Requests for exemptions should be made from the Regional Directorate of Food, Agriculture and Forestry by March 31 of each year, which teaches them in the context of a risk analysis that takes into account, inter alia, the density of the populations of the vector of golden flavescence: Scaphoideus titanus in the environment of the plot.
4. In derogation from paragraph 1, for parcels of mother-of-pearl vines located outside the control area, insecticide treatments referred to in paragraph 1 may be carried out under the control of the regional plant protection services or their delegates by means of phytopharmaceutical products authorized to market against that insect and not listed in paragraph 1. These treatments are then made using three applications of these products during the production campaign, and the multiplication material is subjected to hot water treatment. Requests for exemptions should be made from the Regional Food, Agriculture and Forestry Directorate by March 31 of each year.
5. In derogation from paragraph 1, specific provisions concerning the control of the vector in areas that have status of areas protected against golden flavescence as part of the European phytosanitary passport system may be taken by the Regional Directorate of Food, Agriculture and Forestry."
