President of the Republic,
On the report of the Prime Minister and the Minister for Foreign Affairs and International Development,
Considering the Constitution, in particular articles 52 to 55;
Vu le Decree No. 53-192 of 14 March 1953 amended on the ratification and publication of international commitments undertaken by France,
Decrete:

Article 1


The Agreement on Cultural, Scientific and Technical Cooperation between the Government of the French Republic and the Government of the Republic of Tajikistan, signed in Paris on 4 December 2002, will be published in the Official Journal of the French Republic.

Article 2


The Prime Minister and the Minister for Foreign Affairs and International Development are responsible, each with respect to him, for the execution of this decree, which will be published in the Official Journal of the French Republic.

    AGREEMENT
    CULTURAL, SCIENTIFIC AND TECHNICAL COOPERATION IN THE GOVERNMENT OF THE FRENCH REPUBLIC AND GOVERNMENT OF THE TADJIKISTAN REPUBLIC, SIGNED TO PARIS 2 DECEMBER 2002


    The Government of the French Republic and the Government of the Republic of Tajikistan
    (hereinafter referred to as "the Parties")
    Encouraged by the principles of the Final Act of the Conference on Security and Cooperation in Europe in Helsinki, as well as by the United Nations and UNESCO Conventions ratified by the two States on human rights, cultural and social rights, as well as the protection of cultural heritage,
    Determined to focus on areas of cooperation contributing to the affirmation of democratic values, the modernization of economic and social life, the formation of frameworks, social development and the affirmation of the rule of law,
    Convinced further that dialogue among cultures constitutes, within the framework of the globalization process, a decisive element for the maintenance and development of the cultural identity of nations and for the promotion of cultural and linguistic diversity,
    Incorporating Franco-Tajikistanian cooperation from this perspective and considering that cultural, scientific and technical cooperation has a leading role in the development of relations between the two countries,
    Desiring therefore to develop cooperation between the two Parties in the fields of culture, education, sport, technology, science, technology, tourism and health,
    Recognizing further the importance for the cultural development of the associative movement, in particular with regard to sport, tourism, youth, the promotion of the rights of women,
    To strengthen and deepen existing cultural ties between the two countries, as well as to create new ones,
    agreed that:


    Article 1


    Parties promote dialogue between French and Tajik cultures, mutual knowledge and dissemination of these cultures and their means of expression in each of the two countries.
    Parties shall encourage the activity of permanent, existing or future cultural institutions to be opened in their respective territories by the other Party, such as cultural or research centres or institutes, French alliances, cultural and educational associations, reading rooms. They also welcome and facilitate cultural missions, visits and events, organized by the cultural institutions of the other Party, within the framework of the study and knowledge of national cultures, and their regional, historical and geographical context.
    As part of the development of direct cultural contacts between nationals of the two States, they also facilitate relations between personalities of the intellectual world, the arts and letters, science and technology, youth movements and those aimed at promoting the rights of women. They encourage cultural or sporting activities and events organized by recognized non-governmental organizations and associations.
    They support cooperation between experts in cultural affairs management and training in the fields of culture and heritage.
    They ensure the widest possible exchange and dissemination of books and other publications in either country. They support the cooperation between publishing organizations established in the territory of the two states and to increase the publishing and translation activities.
    They promote exchanges of artistic events (theatre, music, dance, plastic arts...). They favour co-productions, meetings of artists and cultural professionals, as well as training, in particular by organizing internships or awarding scholarships.
    They also promote broadcasts on France and Tajikistan in audiovisual media, including the development of special programmes broadcast during national festivals and other important events.
    They support collaboration in the protection of creative rights (authorities and neighbouring rights).
    They help and promote any form of cooperation between archives conservation institutions, museums, libraries and other cultural institutions by facilitating access to their funds to specialists and researchers from the other State. These facilities will be mutually granted under the regulations in force in the other State and may be subject to special agreements between the specialized institutions concerned.
    Both Parties promote cooperation in the field of the protection of cultural heritage.


    Article 2


    Each Party shall encourage the teaching and dissemination in its territory of the national languages of the other country. Both Parties contribute to all forms of cooperation in the field of education as:


    - the activities of the French and Tajik readerships, especially at the university level;
    - participation, as part of academic cooperation, of students and specialists in courses and seminars in French language and literature and in Tajik languages and literature;
    - the exchange of students and students;
    - cooperation between schools, especially in the context of matching, as between higher education institutions;
    - the exchange of scientific and educational information and publications;
    - the development of the teaching of French in Tajikistan, particularly in the context of early education and in bilingual channels;
    - the development of complementary language and culture education in Tajikistan for Tajikistian children or from Tajikistan and residing in France;
    - educational cooperation aimed at training trainers and distance learning, as well as vocational training and technical education, including the areas of hospitality, tourism, economy and management;
    - cooperation in the field of linguistic research, bilingual dictionaries, grammar and language manuals as well as translation and interpretation.


    Parties shall encourage mutual recognition of certificates, diplomas and titles issued by their educational institutions.


    Article 3


    Parties shall promote the development of direct exchanges in the areas of broadcasting, television, press and cinema, particularly among organizations and professionals. They favour training.


    Article 4


    Parties encourage cooperation between their communities and scientific institutions, including academics, in areas of mutual interest in both the exact and applied sciences, technology and the human and social sciences.
    In particular, they support:


    - cooperation between scientific institutions or institutions;
    - exchanges of scientific information and publications;
    - long-term stays of national researchers from both States at the post-doctoral level;
    - co-directions of theses;
    - exchanges of teachers and researchers for joint studies and research missions;
    - direct links between laboratories;
    - the joint organization of seminars and other meetings involving scientists from both States, on themes of common interest;
    - the protection of intellectual property.


    The Parties, in order to stimulate technical, scientific and technological cooperation, are working together to conduct collaborative projects of mutual interest evaluated by experts from both countries.


    Article 5


    Parties shall continue to cooperate as closely as possible in technical areas, to be agreed upon, as appropriate.
    In particular, Parties support health cooperation activities (hospital management, medical and administrative training, public health, etc.).
    The French Party is also prepared to assist in cooperation in public management assistance, including in the training of administrative frameworks, legal cooperation and assistance in the implementation of economic reforms.
    The French Party is prepared to carry out expertise and offer its advice, if the Tajikistan Party wishes, and then favour training actions on site or in France. Language upgrades will be organized, as appropriate, for future trainees in Tajikistan.


    Article 6


    Parties encourage youth exchanges, both in the cultural and athletic fields. They focus on direct contacts between governmental organizations and between non-governmental organizations, between associations and federations, as well as between organizations specializing in youth training.


    Article 7


    Parties shall encourage the various forms of decentralized cooperation, complementary to cooperation among States: direct relations between universities and other institutions, cooperation and exchanges among local authorities, twinning.


    Article 8


    The Parties shall work together for projects of common interest in multilateral programmes, including those of the Council of Europe and organizations of the United Nations system, including UNESCO, for the harmonization of programmes of cultural, educational, scientific, technological and technical cooperation.


    Article 9


    In order to implement the principles of this Agreement, a Joint Intergovernmental Commission for Cultural, Educational, Scientific and Technical Cooperation is established. It meets as necessary, alternately in France and Tajikistan, to develop programmes for cultural, educational, scientific, technical and technological exchanges, to set the priority areas of cooperation and to define the practical modalities of its implementation. Its composition will be specified by exchange of letters.
    This commission does not exclude the conclusion of cooperation agreements between the French and Tajik technical ministries.


    Article 10


    Each Party shall notify the other of the performance of the internal procedures required for the entry into force of this Agreement; the latter shall take effect on the first day of the second month following the date of receipt of the last notification.
    This Agreement shall be concluded for a period of five years. It will be extended by tacit renewal for new periods of the same duration, unless one of the Parties notify the other, in writing and with a notice of one year before the expiry of the current validity period, its contrary intention.
    Done in Paris on December 4, 2002, in two (2) copies, each in three languages (French, Tajik, Russian). In the event of a discrepancy in the interpretation of this Agreement, the French and Russian versions are equally authentic.
