President of the Republic,
On the report of the Prime Minister and the Minister for Foreign Affairs and International Development,
Considering the Constitution, in particular articles 52 to 55;
Vu le Decree No. 53-192 of 14 March 1953 amended on the ratification and publication of international commitments undertaken by France,
Decrete:

Article 1


The agreement on bilateral cooperation in the field of agriculture between the Government of the French Republic and the Government of the State of Kuwait, signed in Paris on 18 February 2014, will be published in the Official Journal of the French Republic.

Article 2


The Prime Minister and the Minister for Foreign Affairs and International Development are responsible, each with respect to him, for the execution of this decree, which will be published in the Official Journal of the French Republic.

    CONVENTION
    ON BILATERAL COOPERATION IN THE FIELD OF AGRICULTURE AGAINST THE GOVERNMENT OF THE FRANÇAISE REPUBLIC AND THE GOVERNMENT OF KOWEIT, SIGNED TO PARIS 18 FEBRUARY 2014


    The Government of the French Republic
    and
    The Government of the State of Kuwait,
    hereafter referred to as "the parties",
    Considering the central role played by agriculture in the economy, society and food security of the French Republic and the State of Kuwait;
    Convinced of the interest of strengthening agricultural cooperation and the promotion of trade in agricultural and food goods and services at the Franco-Kuwaitian level to meet the food security challenges of the State of Kuwait;
    Recognizing the strengthening, on a basis of reciprocity and mutual interest, of institutional cooperation and exchanges between competent administrations and between scientific and technical institutions in the fields of agriculture and food security;
    In the spirit of good relations that unite the two countries and fruitful partnerships already committed,
    Consistent with the following provisions:


    Article 1
    Scope


    The parties promote exchanges and cooperation on any subject of common interest identified in the fields of agriculture and food security, including from a sanitary and phytosanitary perspective.
    The areas selected to initiate this cooperation for the development of Kuwaiti agriculture include:


    - supporting agricultural policies;
    - scientific and technical cooperation for:
    - the development of plant and animal sectors, including fisheries and aquaculture;
    - landscape planning.


    On the basis of the links already established between the parties, the strengthening of Kuwaiti dairy and poultry sectors will be the first step in the development of cooperation under this Convention.


    Article 2
    Implementation


    Each of the parties shall, in stages, define its requests for cooperation in the areas referred to in Article 1 and address them to the other party so that the latter may study them.
    This cooperation in each of the selected areas is based, in particular, on:


    - the relationship between the competent public or private entities of the two countries, which may, where appropriate, conclude enforcement agreements between counterpart agencies;
    - the exchange of information;
    - the establishment, if necessary, of French technical assistance in Kuwait of medium to long duration;
    - reception of Kuwaiti delegations in France for international agricultural events or for specific thematic missions;
    - technical expertise missions based on the specific needs of the Kuwaiti party, including the study of projects in Kuwait;
    - trainings, short or long, possibly graduates, in France or Kuwait;
    - promoting common agricultural investment.


    The parties meet as much as necessary and if possible once a year to establish the programming and define the modalities for the continuation of the actions, as well as the identification and monitoring of the cooperation projects.


    Article 3
    Financing


    The requesting party for cooperation in any of the areas cited in this Agreement shall bear all costs associated with this application.
    With respect to the French party, these costs may not exceed, by their amount and nature, the expenditures related to the current operation normally incurred by the administrations concerned within the framework of their usual competence.


    Article 4
    Litigation


    Any dispute arising out of the interpretation and/or application of the provisions of this Agreement shall be settled by diplomatic consultations or negotiations.


    Article 5
    Conditions of application


    1. This Convention has no influence or consequences on the rights and obligations otherwise assumed by one of the parties to a third party. Nevertheless, each of the parties undertakes, during the validity period of this Convention, to respect, for the mutual trade of agricultural and food goods, the relevant international requirements of the OIE, the Codex alimentarius or the CIPV.
    2. This Agreement comes into force from the date on which each of the parties has notified the other of all the procedures necessary for its entry into force in the country.
    3. This Agreement may be amended by mutual agreement between the two parties. These amendments come into force in accordance with the procedure described in paragraph 2 of this article.
    4. This Convention shall take effect on the day of its entry into force for a period of five years, renewable by tacit renewal for new periods of five years. Each party may denounce it at any time by written notification to the other party through diplomatic channels. This denunciation takes effect six months after the date of receipt of the notification. It does not affect the actions being carried out, unless the parties agree otherwise.


    Done in Paris on 18 February 2014, in two original copies, each in French and Arabic, both versions being equally authentic.
