Automated personal data processing called "BOPPO" is implemented by the General Directorate of Public Finance (DGFiP).
This treatment ensures:
- the management of oppositions;
- the calculation of seizable quotities;
- accounting monitoring of oppositions;
- taking into account the release;
- the realization of different impressions;
- the issuance of transfer files to opponent creditors (legal officers, family allowances, DGFiP services, court registry).
The personal data processed are:
1. With respect to the opposing creditor:
- identification of the creditor: designation, address, internal number assigned in chronological order;
- bank references.
2. Concerning the public accountant:
- identification elements: name, first name.
3. Concerning the authorized officers:
- identification elements: civility, name, name, user ID;
- professional elements: assignment structure, application profile.
4. Concerning the opposite debtor:
- identification elements: civility, name, name, address;
- number of dependants;
- compensation elements;
- identification and budget of the employer service supporting the remuneration of the debtor.
5. Concerning the opposition:
- nature of the opposition;
- date of notification of the opposition;
- reference of the opposition;
- amount of opposition;
- the amount of begging to be performed;
- amount of unpaid monthly payments during the six months preceding the notification;
- remains to be recovered;
- number of monthly collection deadlines;
- number of due dates already taken;
- amount of costs;
- monthly fee;
- remains to be recovered on costs;
- amount of levies already made on the costs.
6. With regard to deductions:
- amount of the seizable fraction;
- relatively elusive amount;
- amount of the seizureable fraction for the creditors of food;
- amount of deductions under the main opposition and fees.
The actions of creating, deleting and modifying a file made by agents of the General Directorate of Public Finance are the subject of a historization that results in the preservation, in the application, of the identification elements of the author: user ID, civility, name, name, assignment structure, application profile.
Receives the information processed:
- the authorized officers of the General Directorate of Public Finance;
- opposing creditors.
The data referred to in Article 3 shall be retained as long as the opposition is active, and shall be archived for a period of six years, with the exception of the data relating to the authorized agents that are retained as long as the officer is in service and authorized to use the application.
Rights Section 2 of Chapter V of Law No. 78-17 of 6 January 1978 modified with respect to computing, files and freedoms is exercised with the assignor public accountant.
The Director General of Public Finance is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
