President of the Republic,
On the report of the Prime Minister and the Minister for Foreign Affairs and International Development,
Considering the Constitution, in particular articles 52 to 55;
Vu le Decree No. 53-192 of 14 March 1953 amended on the ratification and publication of international commitments undertaken by France;
Vu le Decree No. 58-905 of 27 September 1958 publishing the Convention on the Establishment of the Intergovernmental Consultative Organization for Maritime Navigation, signed at Geneva on 6 March 1948;
Vu le Decree No. 69-89 of 20 January 1969 publishing the international convention on charging lines and its annex of 5 April 1966;
Vu le Decree No. 80-369 of 14 May 1980 publishing the 1974 International Convention for the Protection of Human Life at Sea (as a whole annex), made in London on 1 November 1974;
Vu le Decree No. 81-474 of 7 May 1981 publishing the 1978 Protocol on the 1974 International Convention for the Protection of Human Life at Sea, done in London on 17 February 1978;
Vu le Decree No. 95-1264 of 27 November 1995 publishing the 1988 Protocol on the 1974 International Convention for the Protection of Human Life at Sea, made in London on 11 November 1988, signed by France on 23 January 1990;
Vu le Decree No. 2001-73 of 24 January 2001 publication of the 1988 Protocol on the 1966 International Convention on Charge Lines, made in London on 11 November 1988, signed by France on 23 January 1990,
Decrete:

Article 1


Resolution MSC.345(91) on the adoption of amendments to the 1988 Protocol relating to the 1966 International Convention on Charge Lines (a consolidated annex), adopted in London on 30 November 2012, will be published in the Official Journal of the French Republic.

Article 2


The Prime Minister and the Minister for Foreign Affairs and International Development are responsible, each with respect to him, for the execution of this decree, which will be published in the Official Journal of the French Republic.

    RESOLUTION MSC.345(91)
    RELATIVE À L'ADOPTION D'AMENDEMENTS AU PROTOCOLE DE 1988 RELATIF À LA CONVENTION INTERNATIONALE DE 1966 SUR LES LIGNES DE CHARGE (ENSEMBLE ANNEX), ADOPTED À LONDRES LE 30 NOVEMBER 2012


    Maritime Safety Committee,
    RECALLING Article 28 (b) of the Convention establishing the International Maritime Organization, which deals with the functions of the Committee,
    OVERVIEW Article VI of the 1988 Protocol to the 1966 International Convention on Load Lines (hereinafter referred to as the "1988 Protocol on Load Lines"), which concerns the amending procedures,
    RECOGNIZING the need to improve clarity and to standardize the application of the after-variate stability requirements with respect to the initial loading states and balance states required by oil tankers, chemical carriers and gas carriers,
    EXAMINated YANT, at its ninety-first session, the amendments to the 1988 Protocol on Lines of Charge that had been proposed and circulated in accordance with Article VI, paragraph 2 (a), of that Protocol,
    1. ADOPTE, in accordance with Article VI, paragraph 2 (d), of the 1988 Protocol on Lines of Charge, the amendments to the 1988 Protocol on Lines of Charge annexed to this resolution;
    2. DECIDE that, pursuant to paragraph 2 (f) (ii) (b) of Article VI of the 1988 Protocol on Lines of Charge, these amendments will be deemed to have been accepted on 1 January 2014, unless, before that date, more than one third of the Parties to the 1988 Protocol on Lines of Charge, or Parties whose merchant fleets represent a total of 50 per cent of the gross tonnage of the fleet of commercial vessels of all the amendments
    3. REQUESTS interested Parties to note that, in accordance with Article VI, paragraph 2 (g) (ii), of the 1988 Load Lines Protocol, these amendments will come into force on 1 July 2014, when they have been accepted under the conditions set out in paragraph 2 above;
    4. Requests the Secretary-General, in accordance with Article VI, paragraph 2 (e), of the 1988 Protocol on Lines of Charge, to transmit certified copies of this resolution and the text of the amendments annexed to it to all Parties to the 1988 Protocol on Lines of Charge;
    5. PRIE AUSSI le Secrétaire général de transmis des copies de la présente résolution et de son annexe aux Membres de l'Organisation qui ne sont pas Parties au Protocole de 1988 sur leslines de charge.

    AMENDMENTS TO THE ANNEX B OF THE 1988 PROTOCOL RELATING TO THE 1966 INTERNATIONAL CONVENTION ON CHARGE LINES, TEL TEL QUE MODIFIÉ
    Annex I
    Rules for determining charge lines

    • Chapter III: Francs-bords


      Rule 27 - Types of ships
      Rule 27 11 - Initial loading state
      1. The text of the first sentence of paragraph (b) (iv) is replaced by the following:
      "The tanks and spaces of the vessel equipped to contain each type of consumables and provisions are considered to be filled to 50% of their total capacity. »
      2. After the current paragraph (b) (iv) is inserted the following new paragraph (b) (v):
      “(v) Ballast tanks are normally considered empty and no correction for liquid carenes shall be applied to take this into account. "
      and current paragraphs (b) (v) and (b) (vi) are therefore renumbered (b) (vi) and (b) (vii).
      3. The text of renumbered paragraph (b) (vi) is replaced by the following:
      “(vi) Another method may be considered to take into account the liquid carenes when the final state is established for the application of the grind described in Rule 27 12)
      (aa) Method No. 1 (value for virtual corrections); the virtual centre of gravity in the initial state is determined as follows:
      i. the loading state shall be established in accordance with paragraphs (i) to (iv);
      ii. the correction for liquid carenes is added to the height of the centre of gravity;
      iii. a virtual initial state with all empty compartments is established at the water draught corresponding to the summer load line with zero plate, using the height of the gravity center of the cargo state above; and
      iv. compliance with the after avariate stability criteria is verified for avariate cases using the initial state above.
      (bb) Method No. 2 (valued for the use of the actual moments of liquid carenes corresponding to the hypothetical fillings of tanks in the case of agar) the virtual centre of gravity in the initial state is determined as follows:
      i. the loading state shall be established in accordance with paragraphs (i) to (iv);
      ii. a virtual initial state by agrarian case with liquid-filled compartments can be established at the water draught corresponding to the summer load line with zero plate, using the virtual initial state with filled compartments established at the water draught corresponding to the summer load line with zero plate. Using the height of the centre of gravity and the correction for liquid carenes of the above loading state, separate calculations are made for each grinding case but the compartments filled with liquid to undergo the grinding are empty before the grinding; and
      iii. compliance with the after avariate stability criteria is verified for avariate cases using the above initial states (an initial state per avariate case). »
      Rule 27 13) - Balance
      4. The following new paragraph (g) is added after the current paragraph (f):
      “(g) It is not mandatory to demonstrate compliance with the residual stability criteria described in paragraphs (a), (c), (d) and (e) above in the in-service loading states using a stability calculator, stability software or other approved method. »
