Mindful of Decree No. 88-1009 October 25, 1988, on the publication of the Protocol amending the convention of cooperation for the safety of air navigation air «Eurocontrol» of 13 December 1960, done at Brussels on 12 February 1981, the multilateral agreement on route charges, made in Brussels on February 12, 1981, and the Protocol amending the additional protocol to the convention of cooperation for the safety of navigation air 'Eurocontrol '. signed in Brussels on 21 November 1978;

Having regard to Decree No. 2004-115 of February 2, 2004 publication of the agreement between the Government of the French Republic and the Swiss federal Council concerning the common activities of education and training of the French armies and the Swiss Army signed in Bern on October 27, 2003;
Mindful of Decree No. 2013-1062 25 November 2013 on the publication of the Treaty concerning the establishment of the block of space functional air "Europe Central" between the Federal Republic of Germany, the Kingdom of Belgium, the French Republic, the Grand Duchy of Luxembourg, the Kingdom of the Netherlands and the Swiss Confederation signed in Brussels on 2 December 2010, enacts as follows: Article 1 the agreement between the Government of the French Republic and the Swiss federal Council concerning the establishment of a cross-border training between the France zone and the Switzerland (all an annex), signed in Payerne February 25, 2015, will be published in the Official Journal of the French Republic.


Article 2 the Prime Minister and the Minister of Foreign Affairs and international development are responsible, each in relation to the implementation of this Decree, which shall be published in the Official Journal of the French Republic.

Annex agreement between the Government of the French Republic and the Swiss FEDERAL Council concerning the establishment of a ZONE border to drive between FRANCE and Switzerland (set a schedule), signed at PAYERNE February 25, 2015 the Government of the French Republic and the Council Swiss federal, hereinafter referred to as the "Parties", convinced that the establishment of a cross-border zone contributes appropriately to the operational training of the Air force of the French Republic and the Airforce of the Confederation Switzerland;
Recognizing that the creation of a zone must be balanced with regard to the allocation of air space in the training for both Parties;
Whereas the Convention on the international civil aviation, signed at Chicago, on 7 December 1944 and its annexes;
Whereas the Convention on cooperation for the safety of air navigation «EUROCONTROL» of December 13, 1960, and amended by the Protocol of 12 February 1981;
Whereas the agreement between the States parties to the North Atlantic Treaty and the other States participating in the partnership for peace on the status of their forces, made in Brussels, on 19 June 1995, hereinafter 'SOFA PpP. "
Whereas the agreement between the Government of the French Republic and the Swiss federal Council concerning common activities of instruction and training of the French armies and the Swiss Army, done at Berne, October 27, 2003, hereafter called "agreement of October 27, 2003 ';
Whereas the Treaty concerning the establishment of the functional airspace block "Europe Central" between the Federal Republic of Germany, the Kingdom of Belgium, the French Republic, the Grand Duchy of Luxembourg, the Kingdom of the Netherlands and the Swiss Confederation signed in Brussels on December 2, 2010;
Whereas the agreement between the European Community and the Swiss Confederation on air transport of 21 June 1999 amended and in particular Regulation (EC) No 2150/2005 of the Commission of 23 December 2005 laying down common rules for the flexible use of airspace, referred in the annex to the agreement have agreed as follows: Article 1 purpose this agreement is designed to establish a cross-border area of training between the Parties determine the characteristics and to establish the General principles of management and use.
Section 2 establishment of a cross-border training area 1. The Parties shall establish a cross-border zone over their territory for training joint or exclusive of their air forces.
2. this area is referred to as 'EU Cross-border Area 25' (EUC25).
3. the limits lateral and vertical of the EUC25 and its characteristics are defined in the annex to the present agreement which is inseparable from the latter.
4. this area can be booked partially or wholly by either party. The relying party is permitted to apply its own procedures of operational air traffic throughout the area.
Article 3 sovereignty 1. This agreement is no prejudice to the sovereignty of each party over the airspace above its territory and the jurisdiction of each party to exercise its prerogatives with regard to safety and the defence of its national airspace.
2. each party may, in certain circumstances related to the safety or defence, to restrict or prohibit air traffic from all or part of its national airspace. It shall duly inform the other party as soon as possible.
Article 4 diplomatic clearance 1. The use by part of the portion of the EUC25 above the territory of the other party is under a diplomatic clearance.
2. the diplomatic clearance referred to in the preceding paragraph also allows landings on aerodromes of Payerne (LSMP) and to Luxeuil (LFSX) provided that they are in connection with the use of the EUC25 area.
3. the diplomatic clearance associated with the use of the EUC25 is exempt from notification of flight. Flight with reference to this permission serves as notification.
4. for any flight not covered by the use of the EUC25 a separate diplomatic clearance is required.
Article 5 pre-tactical management 1. Parties are implementing the EUC25 pre-tactical management and ensure that the terms are defined and updates between national cells of management of air space through letters of agreement (LoA) in accordance with Annex 9 of part 3 (recommendations for the management of air space) of the Plan of improvement of air routes in Europe.
2. the reservation of the EUC25 procedures are defined in a LoA between the bodies responsible for the military planning of the two Parties.
Article 6 operation 1. The use of the portion of the EUC25 above the territory of one of the Parties is carried out according to the provisions of the national legislation and publication of aeronautical information in this part.
2. the use of the EUC25 is reserved for aircraft of Parties only.
3. However, a party may conduct joint training with a third party. If the drive uses portions of the area above the other party, it must give its approval. In this case, the third party agrees to respect the conditions of use of this agreement.
4. no training directed only by aircraft from a third party is permitted.
Article 7 rules and operational procedures 1. Each Party shall permit military air traffic control organizations of the other party to exercise control of military aircraft in the portions of the EUC25 located above its territory.

2. the Parties ensure that supervisory air military french and Swiss applied in the whole of the EUC25 procedures of operational air traffic of the State to which they belong.
3. when of common practice between the Parties, these ensure that supervisory air french military and Swiss resolve operational air traffic in a coordinated manner.
4. the use of the EUC25, or a portion thereof, should be known in real time of all the agencies involved.
Article 8 use of arms during training in EUC25, only the carriage and use of the arms of exercise including lures are permitted.
Article 9 liability the liability regime is defined in accordance with article VIII of NATO SOFA.
Article 10 search and rescue the Parties shall provide mutual assistance during the search and rescue.
Article 11 serious Incidents and accidents in the event of accident or serious air incident in the airspace of one of the Parties involved in an aircraft of the other party, military experts of this part are allowed to sit on the commission of inquiry headed by the State of occurrence, in accordance with article 12 of the agreement of 27 October 2003.
Article 12 aeronautical information Publications each Party shall ensure coordination of aeronautical publications related to the EUC25 area.
Article 13 financial provisions the use of 1'EUC25 by aircraft of each party is entitled to any financial compensation between the Parties.
Article 14 settlement of disputes any dispute arising concerning the interpretation, application or execution of this agreement, or its maintenance, is settled by direct negotiations between the Parties.
Article 15 denunciation and suspension 1. This agreement is concluded for an indefinite period. Each party may denounce it at any time by written notification addressed to the other party. The denunciation shall take effect one year after the date of receipt of the notification, unless the Parties decide otherwise.
2. each party may unilaterally suspend this agreement in the event of war, State of siege, crisis or for any other reason of national interest. The effects of the suspension may be immediate if the party suspending this agreement notify as such.
Article 16 amendment this agreement may be amended at any time by mutual written agreement between the Parties.
Article 17 entry into force and termination 1. This agreement shall enter into force on the day of its signature.
2. the arrangement of 9 December 2002 concerning the cross-border air training (CBA) between the France and the Switzerland area is repealed.
