Purpose: To continue the State's support fund for municipalities and public institutions of intercommunal cooperation with the aim of contributing to the development of peri-curricular activities.
Entry into force: the text comes into force on September 1, 2015.
Notice: The purpose of the decree is to maintain, by establishing new terms of allocation, the support fund established by section 67 of the Act of 8 July 2013. The benefit of the funds was extended by Article 32 of the Act of 8 August 2014 to the municipalities and public institutions of intercommunal cooperation, of which one or more public schools were authorized by the academic authority to experiment with adaptations to the organization of the school week in application of the Decree No. 2014-457 of 7 May 2014.
It defines, as of September 1, 2015, the regime of the aids that the fund, now known as the "fund to support the development of peri-curricular activities", attributes to the municipalities and, when the competence in peri-curricular activities has been delegated to them, to the public institutions of inter-communal cooperation (EPCI), which organize for the benefit of students of public schools applying the decree of May 7, 2014 of peri-school activities within the framework of an education projectArticle L. 551-1 of the Education Code. It specifies the nature and rates of the aids (performal aid and lump sum increases), the methods of calculating the aids, the eligibility requirements for these aids and the formalities required to benefit from them.

Decrete:
I. - Municipalities of which one or more public kindergarten or elementary schools have been authorized by the academy rector, under the conditions fixed by the decree of 7 May 2014 referred to above, to experiment with an organization of the school week derogating from provisions of Article D. 521-10 of the Education Code benefit, when organizing out-of-school activities as part of a territorial educational project provided for in theArticle L. 551-1 of the Education Code for the benefit of the students of these schools, funds instituted by theArticle 67 of the Act of 8 July 2013 referred to aboveconsisting of:
1° A lump sum per student;
2° A lump sum increase per pupil, reserved for municipalities mentioned in the 2° of Article 67 of the Act of 8 July 2013 referred to above.
II. - The aids received by a commune under this decree are cumulative with those received under the Decree No. 2015-996 of 17 August 2015 referred to above.
The rates of the lump sum and the lump sum increment provided for at 1° and 2° of I of Article 1 are those fixed respectively for the lump sum and the lump sum increment provided for at 1° and at 2° of Article 67 of the Act of 8 July 2013 referred to above by the order first paragraph of Article 2 of Decree No. 2015-996 of 17 August 2015 referred to above.
The amount of assistance provided under 1° and 2° I of Article 1st is equal to the product of the corresponding rate by the number of students enrolled in public schools meeting the conditions set out in the first paragraph of Article 1st.
The number of eligible students referred to in the previous paragraph is estimated as of October 15 of the school year for which municipalities seek these assistance.
For each school year, are eligible for the lump-sum increase provided for by the 2° of the I of section 1 of the municipalities that have benefited, under the current fiscal year at the school year or the previous fiscal year, from one of the endowments mentioned in the articles L. 2334-18-4 and L. 2334-22-1 the general code of territorial authorities or the code referred to in the fourth paragraph of section L. 2334-13 of the same code, as well as the community of Saint-Martin.
The request for the payment of the grant for students who attend school in public schools whose organization of the school week is subject to an experiment under the Decree No. 2014-457 of 7 May 2014, presented for the duration of this experiment and within the framework of the territorial educational project that is the subject of the convention provided for in the I of Article 1 of the decree of 2 August 2013 referred to above, is addressed by the municipalities to the Service and Payment Agency no later than 30 November following the signing of this Agreement.
The Academic Director of National Education Services ensures that out-of-school activities are organized as part of a territorial education project developed under the conditions provided for in thearticle 1 of the decree of 2 August 2013 referred to above and the validity of experimentation.
On an exceptional basis, taking into account the legitimate reasons given by the municipality, a request for assistance may be granted after the date of November 30 provided for in the first paragraph, upon a specific decision of the Minister for National Education.
For each school year, aids are paid twice:
- a first payment is made before December 31: it is equal to one-third of the lump sum and, if applicable, of the lump sum, calculated on the basis of the number of students recognized in eligible schools during the previous school year;
- a second payment is made before June 30: it corresponds to the balance of the lump sum and, if applicable, of the lump sum, calculated on the basis of the number of students recorded in the schools concerned on October 15 of the current school year.
The Decree No. 2014-1206 of 20 October 2014 applying section 32 of Act No. 2014-891 of August 8, 2014 of Corrigendum Finance for 2014 is repealed.
The provisions of this Decree come into force on 1 September 2015.
The Minister of National Education, Higher Education and Research, the Minister of Finance and Public Accounts and the Secretary of State responsible for the budget are responsible, each with respect to it, for the execution of this decree, which will be published in the Official Journal of the French Republic.
