In view of Decision No. 2014-599 of 17 December 2014 on the List of eligible candidates in the context of the call for applications under the Decision No. 2014-164 of 9 April 2014 for the edition of a local community-based community television service broadcast in digital mode by terrestrial radio in digital mode in the Department of Martinique;
Due to the deliberation of 25 July 2006 of the amended Supreme Audiovisual Council on the setting of the rules for the sharing of radio resources for terrestrial digital terrestrial television multiplexes;

Given the agreement concluded on 28 July 2015 between the Conseil supérieur de l' audiovisuel et l' Association pour le développement des techniques modem de la communication;

Decides:

Article 1


The Association for the Development of Modern Communication Techniques is authorized to use the frequencies defined at Annex 1 to this Decision for the operation of a local local television service known as KMT broadcast over-the-air terrestrial in the Department of Martinique, as set out in Annex 1 to the Present decision and set out in the abovementioned Convention between the Conseil supérieur de l' audiovisuel et l' association pour le développement des techniques modernes de la communication, appearing in appendix 2 to this decision.

Article 2


The duration of the authorisation shall be ten years from the publication in the Official Journal of the French Republic of this authorisation. If, within a period of three months from that date, the association has not started the effective operation of the service, the Council may declare this authorization.

Article 3


The radio resource corresponding to ROM network 1 is shared by several audiovisual communication services. The amount of useful radio resources allocated to each authorized service on the multiplex is set out in the above amended discharge of 25 July 2006. It allows to determine, as a proportion of the total flow available on the multiplex, the bit rate, nominally allocated to each service, which contains the different flows constituting the latter, and allows the implementation of the necessary mechanisms to Its broadcast.

Any subsequent amendments to this document will be subject to the approval of the Senior Audiovisual Council, after consideration by the Technical Committee of Experts on Digital Earth Television, and will be Publication.

This Decision will be notified to the Association for the Development of Modern Communication Techniques and Published in the Official Journal of the French Republic.

    AGREEMENT BETWEEN THE COUNCIL SUPERVISOR OF THE AUDIOVISUAL AND THE ASSOCIATION FOR THE DEVELOPMENT OF MODERN TECHNIQUES FOR COMMUNICATION CI-AFTER THE EDITOR IN RESPECT OF THE KMT TELEVISION SERVICE


    The responsibilities and commitments of the publisher Are derived from the general principles of Law n ° 86-1067 of 30 September 1986 on freedom of communication, including respect for the dignity of the human person, the protection of children and Adolescence, the pluralistic nature of the expression of currents of thought and opinion, the honesty of information, the quality and diversity of programmes, the development of film and audiovisual production and creation National, defence and illustration of language and culture French.
    On the basis of the provisions of sections 28 and 33-1 of this Act, the parties have agreed to the following provisions.

    • PART I: PURPOSE OF THE CONVENTION AND PRESENTATION OF THE EDITOR Article 1-1 Purpose of the Convention
