Order of June 30, 2015 setting the organization in sub-directions of the prison administration

The Seal Guard, Minister of Justice,
Vu le Decree No. 2008-689 of 9 July 2008 amended on the organization of the Ministry of Justice;
Vu le Decree No. 2010-1668 of 29 December 2010 relating to the functions and organization of the missions of the Inspector General of Judicial Services;
Vu le Decree No. 2014-834 of 24 July 2014 General Secretaries of Ministries;
In view of the decision of 4 September 1998 on the mission and skills of the prison service;
Based on the advice of the Department of Justice's Central Administrative Committee dated March 2, 2015,

The Prison Administration Directorate consists of four sub-directions:


- the sub-direction of missions;
- the sub-direction of trades and the organization of services;
- the sub-direction of service management and security;
- the sub-direction of human resources and social relations.


It also includes:


- the management office;
- the service of communication;
- inspection of penitentiary services;
- the prison service, a national service.


The Director of Corrections is assisted by a Chief of Service, Assistant to the Director, responsible for the coordination of cross-cutting cases. He is also assisted by a Director of Staff.

Mission sub-direction:


- designs and implements policies for the care, in a closed and open environment, of persons convicted and accused, under a judicial, custodial or restrictive measure of freedom;
- develops standards for the execution of judicial decisions in conjunction with the management of criminal cases and pardons;
- conducts and monitors integration policies with the assistance of other ministerial departments and services of the State, territorial authorities, associations and other public or private persons;
- conducts the policy of developing activities in detention, including prison work; as such, it ensures the guardianship of the prison service;
- contributes to the development of alternatives to imprisonment and sentencing;
- participates in the policy of security of personnel and correctional facilities and services;
- manages, with the support of other sub-directions and communication services, crisis situations and any other events occurring in institutions and services;
- ensures the collection and operation of information relevant to the security of such information.

The sub-direction of trades and services organization:


- develops, by involving professional organizations, the trade repositories of all prison staff;
- defines and assesses the professional practices of staff in all penitentiary institutions and services;
- conducts reflections, defines methods of intervention and care for persons placed under the rule of law, develops their references;
- ensures the proper application of professional repositories;
- defines and implements the quality of the processes for the care of persons under the control of justice;
- determines and controls the organization of services;
- defines, in conjunction with the National School of Prison Administration, the interregional branches and the mission of overseas penitentiary services, the training policy on prison professions;
- contributes to the generalist continuing training policy established by the General Secretariat;
- organize the recruitment of specific bodies in connection with the General Secretariat;
- defines its needs and contributes to the recruitment of common bodies under the guidance of the General Secretariat;
- contributes to the definition and evolution of information systems used by personnel;
- animates the return of experience, disseminates good practices and innovative practices;
- develops and coordinates the research policy, defines the methodology of statistical evaluation and production in the prison field;
- ensures, in terms of training and research, the guardianship of the National School of Prison Administration.

The sub-direction of services management and security, in conjunction with the General Secretariat:


- produces the budgetary synthesis for all means of the prison administration;
- ensures the monitoring and innovation of equipment and technology;
- manages real estate programmes;
- ensures the governance of prison information systems;
- participates in the departmental procurement policy led by the departmental procurement officer of the General Secretariat and pilots the procurement policy specific to the management of the penitentiary administration;
- ensures management control;
- ensures national ownership of delegated management markets and partnerships contracts;
- piloting internal accounting control within management;
- coordinates the opening and closing of institutions and services;
- coordinates the development of impact studies of any normative project.

The sub-direction of human resources and social relations, in conjunction with the General Secretariat:


- implement, within the penitentiary administration, the human resources and social relations management policy of the Ministry of Justice and monitors its results;
- animates the social dialogue of management;
- implements, under the coordination of the General Secretariat, departmental policies for social, health and safety action at the work of staff;
- is a guarantee of the quality of social relations and ensures that the charter of social dialogue of the Ministry of Justice is implemented in the decentralized services;
- develop the statutory and compensation texts specific to the specific bodies of the staff of the deconcentrated services, within the framework of the single ministerial window;
- implements the common body compensation policy established by the General Secretariat;
- transmits to the General Secretariat the information necessary for the processing of contentious cases;
- investigating disciplinary cases;
- ensures predictive job management;
- authorizes and coordinates staff assignment, administrative and budgetary operations;
- ensures a qualitative and individualized management of the careers of certain categories of prison managers.

The firm:


- assists the Director in the coordination and monitoring of the work of all sub-directions and services;
- ensures, in conjunction with the services of the General Secretariat, the management of human resources proximity to management;
- develops and coordinates, in conjunction with the European and international affairs department of the General Secretariat, relations with foreign penitentiary services and with international public or private bodies dealing with prison issues;
- ensures, in liaison with the Secretary-General, Senior Defence and Security Officer, the implementation of the protection and security policy for information systems;
- ensures compliance with the computer law and freedoms for national and local applications;
- follows parliamentary and written questions;
- ensures, in connection with the General Secretariat, relations with the services of the human rights defender and the general controller of places of deprivation of liberty;
- prepares and monitors responses to the reports of the Court of Auditors in conjunction with the General Secretariat;
- centralizes proposals to honorary distinctions processed by the management of judicial services;
- is responsible for orders relating to professional movement of management officers and their follow-up;
- ensures relations with the general secretariat necessary for the logistical needs of the management.

The Communications Service:


- advises management in the areas of external and internal communication;
- designs, in conjunction with the Department of Information and Communications of the General Secretariat, and implements the communication activities of management;
- advises and coordinates the decentralized services for communication actions.

Without prejudice to the general competence for the inspection of the inspector general of the judicial services and the coordination powers vested in him, the inspection of the penitentiary services, under the authority of a deputy inspector general designated for that purpose by order of the seal guard, Minister of Justice:


- controls the services of the prison administration and the National School of Prison Administration;
- conducts visits, investigations and controls within its jurisdiction;
- ensure compliance with existing legislation and regulations;
- all advice and preconization. Its annual action program is developed jointly by the Director of Prison Administration and the Inspector General of Judicial Services ensuring consistency check with the inspection program subject to seal clearance. The Inspector General of Judicial Services is kept regularly informed of the missions being inspected for penitentiary services, at a monthly meeting held with the Director of Prison Administration;
- also provides a technical advisory mission to the director of the prison administration; in this context, undertakes the missions and studies entrusted to him;
- for the purposes of these missions, provides liaison with inspection services dependent on other jurisdictions. The Inspector General of the Judicial Services shall receive reports of the inspection of the penitentiary services. He may ask what suites were reserved for them;
- may be required by the security guard, Minister of Justice, or by the Inspector General of Judicial Services; to assist the latter in the execution of his missions. Prison Service Inspection Members are associated, at the request of the Inspector General of Judicial Services, with meetings with Assistant Inspectors General and Inspectors, and are involved in the reflections he conducts on professional practices. The Inspector General of Judicial Services ensures the validity and consistency of ethical rules applied by the inspection of penitentiary services.

The decision of 9 July 2008 establishing the organization in sub-directions of the prison administration is repealed.

This Order, which comes into force on 15 September 2015, will be published in the Official Journal of the French Republic.
