Order of April 2, 2015 Amending the Order of September 11, 2013 on Civil Aviation Safety Measures

Publics concerned: entities implementing or responsible for the implementation of security measures in the field of civil aviation, including airfield operators, airlines, authorized agents, known air shippers, authorized suppliers, known suppliers, airport security companies, instructors, training agencies, manufacturers and distributors of security equipment, as well as persons with access to a regulated area
Subject: This order aims to update the decision of 11 September 2013 by introducing in its annex, chapter 12, provisions relating to cynotechnic teams arising from Regulation (EU) No 573/2010 of 30 June 2010 amending Commission Regulation (EU) No 185/2010 of 4 March 2010 establishing detailed measures for the implementation of common basic standards in the field of civil aviation safety.
Entry into force: the text comes into force on the day after publication except for the detailed certification requirement in section 12-9-1-2 of the schedule to this Order.
Notice: A certification is required for the dog driver and the cynotechnic team. Educational objectives are defined and the content of courses for dog drivers is approved. The filtering inspection methods to be applied by cynotechnic teams are specified for certain working environments. A table describing the new or amended provisions is placed at the end of the Appendix to this Order.

Considering Regulation (EC) No 300/2008 of the European Parliament and of the Council of 11 March 2008 on the establishment of common rules in the field of civil aviation safety and repealing Regulation (EC) No. 2320/2002, together with Commission Regulation (EU) No. 185/2010 of 4 March 2010 establishing detailed measures for the implementation of common basic standards in the field of civil aviation safety;
Having regard to Commission Regulation (EC) No. 859/2008 of 20 August 2008 amending Council Regulation (EEC) No. 3922/91 with respect to the common technical rules and administrative procedures applicable to commercial air transport;
In view of Commission Regulation (EC) No 272/2009 of 2 April 2009 supplementing the common basic standards for civil aviation safety set out in the Annex to Regulation (EC) No 300/2008 of the European Parliament and the Council;
In view of Commission Regulation (EU) No. 1254/2009 of 18 December 2009, setting out criteria for Member States to derogate from the common core standards for civil aviation safety and to adopt other security measures;

Vu le Decree No. 2012-832 of 29 June 2012 relating to the safety of civil aviation, including Article 16;
Having regard to the amended decision of September 1, 2003, relating to infrastructure, equipment and training in the field of air transportation safety, as well as to certain procedures for the exercise of approvals as an authorized officer, known shipper, known establishment and technical body;
In view of the decree of 25 February 2009 establishing the Civil Aviation Technical Service;
In view of the decision of 24 October 2012 setting out the terms and conditions for approval of training courses, the organization of certification examinations and certain transitional civil aviation safety measures;
Considering the amended decision of 11 September 2013 on civil aviation safety measures;
Having regard to the decision of 13 October 2014 on the organization of the Civil Aviation Safety Directorate, including Articles 10 and 18,

The schedule to the above-mentioned Order of September 11, 2013 is replaced by the Appendix to this Order.

The obligation to possess a certification referred to in paragraph II of section 12-9-1-2 of the schedule to this Order comes into force six months after the publication of this Order.

This Order is applicable in New Caledonia, French Polynesia and Wallis-et-Futuna.

The decision of 24 August 2007 on the use of the "canine odorology" technique applied to the detection of explosives in air cargo shipments is repealed.

The Director General of Civil Aviation, the Director General of Customs and Indirect Rights, the Director General of the National Police, the Director General of the National Gendarmerie and the Director General of the Overseas are responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
