Notice: the decree is designed and simplifies the provisions relating to the creation of chambers of commerce and industry. It restricts the criteria for the registration of Chambers of Commerce and Territorial Industry to the master plan and removes consultations from the territorial authorities and other chambers of the department. It also specifies the conditions under which the economic weighting study is to be carried out, which includes setting the composition of the general assemblies of the chambers of commerce and industry.

The Prime Minister,
On the report of the Minister of Economy, Industry and Digital Affairs,
Vu le Trade codeincluding articles L. 711-1, L. 711-8, L. 713-11 and L. 713-18;
The State Council (Finance Section) heard,
Decrete:
Title I of Book VII of the Commercial Code is amended as follows:
1° In article R. 711-2, the second sentence is deleted;
2° Section R. 711-36 is replaced by the following provisions:
"Art. R. 711-36.-Ne may be included in the master plan that the Territorial Chambers of Commerce and Industry whose electoral district corresponds to at least one department or, failing that, the number of nationals measured by the economic study referred to in R. 713-66, and that was given to the prefect for the last general renewal, is equal to or greater than 10,000. » ;
3° Article R. 713-66:
(a) In the first paragraph, in the first paragraph, the words "as well as in the case of a fusion between rooms" are deleted and in the second paragraph, after the word "territorial", are inserted the words "local or departmental of Ile-de-France" and after the word "territorial" are inserted the words "local or departmental of Ile-de-France";
(b) In II:
(i) In the first paragraph, after the word "territorial", the words "local or departmental of Ile-de-France" are inserted;
(ii) At 1°, the words "of the territorial chamber" are deleted;
(iii) The last paragraph is replaced by the following:
"The statistical data referred to in the first paragraph are collected no later than September 30 of the year prior to general renewal. The taxation bases of the year prior to the general renewal, provided by institution, are collected from tax services by the regional Chamber of Commerce and Industry. The number of employees of the establishments, established on the date of June 30 of the year prior to the general renewal, is collected from the social security and family allowance collection unions by each Chamber of Commerce and Territorial Industry and each Chamber of Commerce and Industry of the Region for the local and departmental boards of commerce and industry of Ile-de-France. » ;
(c) In the third, after the words: "Territorial Chamber", the words are inserted: ", local or departmental of Ile-de-France" and after the word: "Territorial" are added the words: ", local or departmental of Ile-de-France. » ;
(d) The IV is replaced by the following:
"IV.-The number of occupational subcategories defined under the second paragraph of Article L. 713-11 is limited to two. The distribution of electors between these two sub-categories is decided by the Chamber of Commerce and Industry of the region after consultation with the Chambers of Commerce and Territorial Industry. » ;
(e) In V, the first paragraph is replaced by the following:
"The rooms referred to in the first paragraph of the I transmit the economic weighting studies to the department prefect or to the regional prefect of the chamber's seat at the latest on March 31 of the year of general renewal. The economic study of weighting of the Chamber of Commerce and Industry of the region must correspond to the aggregation of economic studies carried out by the Chambers of Commerce and Territorial, Local or Departmental Industry of Ile-de-France. »
The master plans mentioned in 2° of Article L. 711-8 of the Commercial Code are, if any, brought into conformity with the provisions of 2° of Article 1 of this Order before October 31, 2015.
The Minister of Economy, Industry and Digital Affairs and the Secretary of State for Trade, Crafts, Consumer Affairs and Social and Solidarity Economy are responsible for the execution of this decree, which will be published in the Official Journal of the French Republic.
